BACKGROUND: On April 1 , 2002, Resolution No. 2002-98 was adopted, authorizing the filing of an application with the Local Agency Formation Commission (LAFCO) for a Sphere ofInfluence amendment and a reorganization of territory between the City of San Bernardino and the City of Highland generally located along a portion of Third Street, east of Tippecanoe Avenue. The purpose of this proposal is to realign the present boundary between the City of San Bernardino and the City of Highland. The boundary is presently the south side of Third Street. Since the City of Highland has jurisdiction over the entire portion of Third Street for this area, any permit for street improvements that would occur as a result of any development in the airport has to be processed through the City of Highland. The proposed reorganization will make the centerline of Third Street the boundary between the two Cities and eliminate any dual jurisdiction involvement for any development that occurs along this portion of the airport. As part of this proposal, the City of Highland has requested a change of boundaries for a portion along the north side of Third Street, lying between Del Rosa Drive and Del Rosa A venue, south of Court Street, since the portion along Third Street, between Tippecanoe Avenue and just east of Shirley Avenue is within their jurisdiction. A vicinity map and a map depicting the present and proposed boundary change is attached. Pursuant to Section 99 of the Revenue and Taxation Code, agencies affected by a change of jurisdictional boundaries must negotiate the re-distribution of property taxes of property within the affected area and respond with a resolution. This must be accomplished within 60 days of receiving a response from the Auditor-Controller relative to the existing distribution, which was received on May 30, 2002. A resolution making a determination of the amount of property tax revenues to be exchanged is attached for your action. Essentially, the City of San Bernardino will not receive any additional tax revenues for the portion being annexed to the City since the area only involves right of way. The portion north of Third Street generated $953 in tax revenues to the City of San Bernardino for the 2001-02 fiscal year. As shown on the Exhibit "C" of the resolution, $881.77 of this amount will be transferred to the City of Highland, and the balance of $71.23 will be transferred to the County Library System, of which Highland is a part. FINANCIAL IMPACT: Property tax revenues of $953 will no longer be received by the City. However, the City will no longer be responsible for any maintenance or services to the area being detached. RESOLUTION OF THE CITY OF SAN BERNARDINO DETERMINING THE 3 AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN AND AMONG THE CITY OF SAN BERNARDINO AND THE CITY OF HIGHLAND 4 RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFCO 2890 5 FOR THE AREA GENERALLY ALONG THIRD STREET, EAST OF TIPPECANOE AVENUE. 6 7 8 9 10 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council of the City of San Bernardino hereby find and determine that: A. Pursuant to Section 99 ofthe Revenue and Taxation Code, prior to the 11 12 issuance of a certificate of filing by the Local Agency Formation Commission Executive Officer, 13 the governing bodies of all local agencies whose service area or service responsibilities will be 14 altered by a proposed jurisdictional change shall negotiate and determine by resolution the 15 16 17 amount of property tax revenues to be exchanged between and among such local agencies. B. The Mayor and Common Council of the City of San Bernardino and the 18 Mayor and Council of the City of Highland have determined the amount of property tax revenues 19 to be exchanged as a result of jurisdictional change described by LAFCO 2890, reorganization 20 21 between the City of San Bernardino and the City of Highland, generally located along a portion of Third Street, east of Tippecanoe A venue. 22 SECTION 2.
