CI1Y OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT SUBJECT: Resolution of the City of San Bernardino authorizing execution of a services agreement, in the amount ofS488,OOO, with Los Padrinos Youth Services Inc. a non-profit organization for fiscal year 2002-2003. BACKGROUND: Since June of 1992 the City of San Bernardino has contracted with Los Padrinos Youth Services to provide citywide graffiti removal. On July 3,2001 the City Council expanded the services Agreement to include weed, litter and debris removal and staffing for Project Curb Appeal. The proposal fur 2002-2003 continues the expanded services and graffiti abatement program as follows: > Three full graffiti crews to respond daily, except Sundays and holidays, to requests for graffiti abatement. > A fun time Project Curb Appeal crew to work on common areas around sidewalks and curbs on North, South, East and West main corridors. Streets win include but not be limited to: Mount Vernon, Medical Center, E Street, D Street, Mountain View, Arrowhead, Sierra, Waterman, Baseline, Highland, Kendall, Del Rosa and 401h Street between Electric and Waterman. > A crew assigned to do weed abatement and pick-up of illegal dumping. This crew, along with the graffiti abatement crews win provide focused weed, litter, debris and graffiti removal in the special project areas of Delman Heights and Arden/Guthrie. }> Other Projects as assigned: the Saturday program with probation youth, assisting on an as needed basis to help elderly, disabled or other persons that are financially unable to take care of weeds/debris on their property; removal of temporary signs; large projects such as: the Soap Box Derby, the Chili Cook-off, helping pass out flyers for neighborhood associations, helping with community clean-ups and numerous other events and maintaining as necessary Economic Development Agency owned properties. The Los Padrinos contract is administered by Code Compliance. Financial Impact: A total of $488,000 is included in the FY 02-03 Code Compliance budget. Of this amount, $189,000 will be reimbursed back to the City from CDBG. This reimbursement payment has already been included in the FY 02-03 budget. Recommendation: Adopt Resolution. WHEREAS, CITY has need for graffitL weed and debris removal services within the SERVICES AGREEMENT THE EFFECTIVE DATE OF THIS AGREEMENT is day of , 2002 between ("CONTRACTOR") and the CITY OF SAN BERNARDINO ("CITY"), WITNESSETH: 10 CITY and, 11 B. In all instances, paint will be matched 24 completely repainted in a color which is aesthetically consistent with that of surrounding 25 structures. 26 b) Natural unpainted surfaces (i.e., brick walls, concrete curbs, sidewalks and 27 metal railings) will be waterblasted, whenever possible. 28 r \- 10 11 12 13 ~ 14 , \..- 15 16 17 .- '- 1 2 c) Over time, all structures (which previously have been spot painted) will be 3 recovered to conform to the primary color of the structure, or completely repainted. 4 d) CONTRACTOR shall respond to abatement requests two (2) times daily. 5 CONTRACTOR'S turnaround time for completion of abatement requests will be 24- 6 7 hours from receipt of the electronic report from the CITY For purposes of this agreement, 24-hours is defined in terms of consecutive hours. 8 9 e) CONTRACTOR shall provide a full time Project Curb Appeal crew to work on common areas around sidewalks and curbs on North, South, East and West main corridors. Streets will include but not be limited to: Mount Vernon, Medical Center, E Street, D Street, Mountain View, Arrowhead, Sierra, Waterman, Baaseline, Highland, Kendall, Del Rosa and 40th Street between Electric and Waterman. This crew will remove weeds from the front three (3) feet on all vacant lots, remove weeds and litter from the parkway, sidewalk, curbs and gutters. CONTRACTOR will provide the City with a maintenance schedule for each street. 18 t) CONTRACTOR shall assign a full time crew to do weed abatement and trash 19 pick-up of illegal dumping. This crew, along with the graffiti abatement crews will provide 20 focused weed, litter, debris and graffiti removal in the special project areas of Delman 21 Heights and Arden/Guthrie. They will provide service two full days in the Delman Heights 22 area and two half days in the Arden/Guthrie area. 23 24 g) CONTRACTOR will continue to help the Economic Development Agency with 25 their maintenance responsibilities on Agency owned properties, as needed. 26 i) CONTRACTOR shall perform special services at the direction of the City 27 Administrator or Executive Director of the Economic Development Agency. 28 1 ,-- '-' 2 3. 3 5 6 7 8 9 10 11 12 13 14 '-- 15 23 24 25 26 C 27 28 Over the tenn of this Agreement, CONTRACTOR shall be paid $488,000 for such services. Payments will be made monthly in amounts equal to 1/]2 of the contract 4 amount 4. CONTRACTOR shall provide the Director of Code Compliance with a monthly invoice in arrears and shall be provided payment within thirty (30) days therefrom. CITY retains the right to challenge all or any part of an invoice. Financial records shall be maintained in accordance with generally accepted accounting principles by CONTRACTOR in such manner as to permit CITY to easily trace the expenditure of funds. All books and records of CONTRACTOR are to be kept open for inspection at any time during the business day by the CITY or its officers or agents. Failure to submit the financial records in accordance with this section will result in the CONTRACTOR reimbursing the CITY in the full amount received by CONTRACTOR. 16 5. The tenn of this Agreement shall be from July I, 2002 to June 30, 2003. It 17 may be canceled by thirty days written notice by either party. The Mayor, or her 18 designee, is authorized to extend this agreement for up to thirty (30) days and approve 19 20 line item adjustments to the Agreement's program budget as long as any such extension 21 is upon the same tenns and conditions as specified herein. 22 6. By mutual agreement between the City of San Bernardino and CONTRACTOR this contract will replace all previous service contracts between the City of San Bernardino, the San Bernardino Economic Development Agency and said CONTRACTOR. 7. CONTRACTOR shall indemnify, defend and hold CITY AND ECONOMIC DEVELOPMENT AGENCY, its officers, employees and agents hannless from any claim, I~.- - .r' \....- 24 25 26 - 27 .~ 28 1 demand, liability, suit, judgement of expenses (including, without limitation, reasonable 2 3 costs of defense) arising out of or related to CONTRACTOR'S performance of this agreement, except that such duty to indemnify, defend and hold harmless shall not apply 4 5 where injury to person or property is caused by CITY'S OR ECONOMIC 6 DEVELOPMENT AGENCY'S willful misconduct or sole negligence. 7 8. While not restricting or limiting the foregoing, during the term of this 8 Agreement, CONTRACTOR shall maintain in effect policies of comprehensive public, 9 general and automobile liability insurance, in the amount of$2,000,000.00, per 10 11 occurrence combined single limit, naming the City of San Bernardino and Economic Development Agency as additional named insureds. CONTRACTOR shall also maintain 12 13 statutory worker's compensation coverage, and shall file copies of said policies with the 14 CITY'S Risk Manager prior to undertaking any work under this Agreement. City shall be 15 given thirty (30) days written notice if the insurance is cancelled or substantially altered. 16 9. 17 18 19 CONTRACTOR shall perform work tasks as directed by the Code Compliance Director but for all intents and purposes CONTRACTOR shall be an independent contractor and not an agent or employee of the CITY 20 10. In the performance of this Agreement and in the hiring and recruitment of the 21 employees, CONTRACTOR shall not discriminate on the basis of race, creed, color, 22 religion, sex, physical handicap, ethnic background or country of origin. 23 11. Any notice to be given pursuant to this Agreement shall be deposited with the United States Postal Services, postage prepaid and addressed as follows: TO THE CI1Y: Glenn Baude.
