Staff Report
Subiect:
Resolution of the City of San Bernardino approving Amendment No. 1 to Agreement for
Professional Services with David Evans & Associates, Inc. for additional design services
associated with the widening of Del Rosa Drive and 3'" Street at the San Bernardino
International Airport.
Backl!round:
On February 19, 2002, a Professional Services Agreement in the amount of $45,946.00 was
approved with David Evans & Associates, Inc. for design of the widening of Del Rosa Drive
and 3'. Street at the San Bernardino International Airport.
After start of design, Inland Valley Development Agency (IVDA) staff requested that the
landscaping along the west side of Del Rosa Drive, between Art Townsend Drive and 3'"
Street, be upgraded to enhance the appearance of the entrance to the San Bernardino
International Airport, and it was determined that the frontage road on the south side of 3'"
Street fronting the Loma Linda Clinic could be redesigned to provide improved access to the
clinic. David Evans & Associates, Inc. has proposed to provide a landscape and irrigation
plan to be incorporated into the construction contract documents and redesign the frontage road
in front of the Loma Linda Clinic on the south side of 3'. Street for a total additional design
cost of $12,300.00. This will bring the total cost of the Agreement to $58,246.00.
The above changes were not covered in the "Scope of Services" in the original Agreement and
we feel the proposed fee for these additional design services is reasonable. Therefore, staff
recommends approval of this Amendment No. 1 to the Agreement with David Evans &
Associates, Inc.
Financial Impact:
The cost for additional services associated with Amendment No. 1 to the Agreement is
$12,300.00. Adequate funding for these design services is available in Account No. 242-362-
5504-7093 (Otto Gericke Realigmnent) and all costs incurred will be charged to that account.
The cost of this Amendment No.1 is reimbursable from the Federal Economic Development
Agency (FedEDA).
Recommendation:

RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING
AMENDMENT NO.1 TO AGREEMENT FOR PROFESSIONAL SERVICES WITH
DAVID EVANS AND ASSOCIATES, INC. FOR ADDITIONAL DESIGN SERVICES
ASSOCIATED WITH THE DESIGN OF THE WIDENING OF DEL ROSA DRIVE AND
THIRD STREET AT THE SAN BERNARDINO INTERNATIONAL AIRPORT.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The attached Proposal dated May 20, 2002, and marked Exhibit
"B", submitted by DAVID EVANS & ASSOCIATES, INC. to perform extra work for a fixed
10 fee of $12,300.00, under the terms of an Agreement for Professional Services with said

Engineer authorized by Resolution No. 2002-52, is hereby approved. Such approval shall be
effective only upon Amendment No. 1 being fully executed by both parties. The Mayor is
hereby authorized and directed to execute said Amendment No.1 on behalf of the City. A

15 copy of Amendment NO.1 is attached as Exhibit "A" and incorporated herein by reference as
16 fully as though set forth at length.

SECTION 2. This Amendment shall not take effect until the Amendment is fully
signed and executed by the parties, and no party shall be obligated hereunder until the time of
20 such full execution. No oral Contracts, amendments, modifications or waivers are intended or
21 authorized and shall not be implied from any act or course of conduct of any party.
22 SECTION 3. This resolution is rescinded if the parties to the Amendment fail to
23
execute it within sixty (60) days of the passage of the resolution.

AMENDMENT NO. I TO AGREEMENT FOR PROFESSIONAL SERVICES
'-
This AMENDMENT NO.1 is made and entered into this of
2002, by and between the CITY OF SAN BERNARDINO, California, a municipal
corporation, hereinafter referred to as the "CITY" and David Evans & Associates, Inc.,
hereinafter referred to as "ENGINEER".
WITNESSETH
WHEREAS, the San Bernardino City Council, on February 19, 2002,
adopted Resolution No. 2002-52 approving an Agreement for Professional Services with
Engineer for preparation of plans, specifications, and estimates for the design of the
widening of Del Rosa Drive and 3'd Street at San Bernardino International Airport
(hereinafter "Agreement"); and
WHEREAS, City has requested the Engineer to perform additional design
services described, in general, as design of landscaping and irrigation along the west side of
Del Rosa Drive between Art Townsend Drive and 3'd Street; and
WHEREAS, City has also requested the Engineer to perform additional
design services described, in general, as design of a frontage road adjacent to the Lorna
Linda Clinic located along the south side of 3'd Street between Tippecanoe Avenue and Del
'- Rosa Drive; and
WHEREAS, Engineer has requested an amendment to the Agreement to
cover the cost of the additional design services as described in a letter proposal from
Engineer dated May 20, 2002, marked as Exhibit "B" attached hereto and made a part
hereof; and
WHEREAS, paragraph 5.B. of the Agreement allows adjustment to the total
cost of services when the Engineer and City agree in writing that there has been, or will be,
a significant change in the scope, complexity or character of the services to be performed;
and
WHEREAS, City agrees that the requested revisions are not within the scope
of services covered in the Agreement; and
NOW, THEREFORE, it is mutually agreed, as follows:
1. SCOPE OF SERVICES
Engineer shall perform those additional services identified in Exhibit "B".

COMPENSATION
Upon satisfactory completion of the additional services contained herein City
shall pay to Engineer an additional fixed fee of $12,300.00.

3. NO ADDITIONAL CHANGES
Except as otherwise stated in this Amendment No. I, all terms of the original
Agreement, as approved by City on February 19, 2002, shall remain in full
force and effect.

At our meeting on May 9'. on the subject project, a request was made to try and minimize driveway approaches on
3rd Street. Since thi~ time, the City has discussed Ihis issue with the businesse.~ along 3'" Street and come up with a
resolution to eliminate 3 driveways by placing II private driveway/frontage road along the south side of 3rd Street.
Kirk Shimek of our office and Mike Gmbbs melon May 17, 2002 to review the details of Ihis option and eame up
with a fea.~ible solution:HoWt:\'er, this revision will require some additional design revisions to OUr ~treet
improvement plans to incorporate this additional frontage road.
Thus we are requesting a'change order to our existing contract No. 2002-52 to incorporate the design of the
frontage rond into our existing ,:treet improvement plans. In addition. we requested a change order on May J,
2002 to provide landscape arehltecturalservices. Thus, OUr current contract should be amended as follows:

On behalf of David Evans aru/ Associates. Inc. (DEA). we would like to thank you for the opportunity to provide
you with a proposal for land,;cape architectural services for the 3"' Street and Del Rosa Drive Street Improvement
Project. DBA landscape architect. have been involved in numerous streetscape projects for local municipalities
lIJ1d thcrcfore feel ideally suitt.d to a project of this nature. We have had the opportunity to visit the site with our
projcct engineers and recommend the following project approach.

DEA landscape architects will utilize the existing base maps provided by our civil engineers to create 20 scale
plans for Del Rosa Drive only. It is our professional opinion that improvements within the right-of-way along 3"'
Street could be handled with (onstruction notes for clarification regarding the necessary modifications to any
existing irrigation systems. Likewise. general notes will provide the required infonnation for planting areas
where existing turf or planted areas need to be returned to "like new" conditions. There does not appear to be an
opportunity to provide new plantings along 3"' Street; although. should you like us to perform additional services
willlin this corridor. we can I"o"idc you with a revised proposal.
The c)(i8ting tree. along Del Rosa Drive (including the palm trees and heritage Oak trees) shall be prOleCled in
place during the construction ()fthe new curb & gutter, and the meandering sidewalk. DEA lando;cape architect~
shall provide planting and in"i~ation plans for the limits of new work including the west side of Del Rosa Drive
from 3"' Street to Townsend Drive (approximately 800 linear feet). The existing irrigat.ion systcm will be
replaced and may necessitatt, the placement of a new waler meter with backflow prevention, in addition to a new
automatic controller. The planting plan will indicatc the placement of all proposed plant material including the
introduction of hardscape materials such as decorative rock cobble under the Oak trees. This application would
be attmctive and appropriate given thc desire 10 limit the use of excessive water in and around the Oak trees. We
would recommend the use of .~round covers and low I medium height shrubs - no turf is anticipated at this time.
Technical specifications, construction details. and cost estimates shall also be provided for bidding purposes.
DEA shall include these drawings within the overall bid package. AI this lime, we have excluded any assistance
with bidding, construction obM:rvation. or the preparation of As-Built drawings; however. we can pro"ide such
services al a later date should that be desired. In summary. DEA land~eape architect. shalt provide the following
tasks for the fees indicated:
