AGENDA ITEM: RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO REQUIRING ALL RESOLUTIONS AND
MOTIONS TO INCLUDE LANGUAGE REQUIRING STAFF TO BRING
BACK TO COUNCIL FOR CONSIDERATION ALL DEVIATIONS,
CHANGES, AND/OR REVISIONS TO DIRECTIONS CONTAINED IN
PREVIOUSLY APPROVED AGENDA ITEMS.
SUBJECT:
RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO REQUIRING ALL RESOLUTIONS AND MOTIONS TO INCLUDE
LANGUAGE REQUIRING STAFF TO BRING BACKTO COUNCIL FOR CONSIDERATION
ALL DEVIATIONS, CHANGES, AND/OR REVISIONS TO DIRECTIONS CONTAINED IN
PREVIOUSLY APPROVED AGENDA ITEMS.
BACKGROUND:
On December 4, 2007, the Legislative Review Committee directed staff to draft
language, to be presented to the full Council, requiring any deviations, changes, and/or
revisions to the directions contained in motions or resolutions previously approved by the
Council to be brought back to the Mayor and Council for consideration at the next council
meeting after such deviation, change, and/or revision occurs.
Currently, there is no formal mechanism in place requiring staff to notify the Council
of any internal changes made to the directions contained in motions and resolutions
previously approved by the Council. By adding the proposed language to all resolutions and
motions approved by Council, staff will be required to bring back to the Mayor and Council
for consideration any and all deviations, changes, and/or revisions to the directions
contained in previously approved agenda items at the next council meeting after such
deviation, change, and/or revision is made. This Resolution is intended to cover any
deviations, changes, and/or revisions from the spirit of any previously approved resolution
or motion, as well as the letter of such resolution or motion.
RECOMMENDED MOTION:
That said Resolution be adopted.
I RESOLUTION NO.
2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO REQUIRING ALL RESOLUTIONS AND MOTIONS TO INCLUDE
3 LANGUAGE REQUIRING STAFF TO BRING BACK TO COUNCIL FOR
CONSIDERATION ALL DEVIATIONS, CHANGES, AND/OR REVISIONS TO
4 DIRECTIONS CONTAINED IN PREVIOUSLY APPROVED AGENDA ITEMS.
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
6 OF SAN BERNARDINO AS FOLLOWS:
7 SECTION 1. Staff is hereby directed to include in all Resolutions and Motions presented
8 to the Mayor and Common Council the following language:
9 "Any and all deviation(s), change(s), and/or revision(s) to the
10 directions contained in this [resolution] [motion] shall be brought
11 back to the Mayor and Common Council for consideration at the
12 next meeting after such deviation, change, and/or revision occurs."
13 SECTION 2. Any such deviation(s), change(s), and/or revision(s) shall be placed on the
14 next agenda for action by the Mayor and Common Council.
15 SECTION 3. This policy shall cover any deviation(s), change(s), and/or revision(s) from
16 the spirit of any said direction, as well as the letter of such direction.
