Synopsis of Previous Council Action:
October 18, 2005— Legislative Review Committee recommends implementation of a Mills Act Program.
November 7, 2005 -Council adopts Resolution 2005-363 establishing the application process, review
procedures, and required contract provisions for the implementation of a Mills Act Program in the City of
San Bernardino pursuant to Government Code Section 50280, et seq., and setting an application fee and
an annual administrative fee.
December 18, 2006—Mayor and Common Council amend resolution 2005-363, changing the application
period from November to October.

Resolution of the Mayor and Common Council amending Resolution 2005-363 to include the
use of a City Register of Historical and Architecturally Significant Properties for the purposes of
Mills Act eligibility.
Background:
On November 7, 2005, the Mayor and Common Council adopted Resolution Number 2005-363
creating the Mills Act Preservation Program in the City of San Bernardino. The Mills Act is a
state law designed to provide financial incentives for property owners that restore and maintain
historic residential and commercial properties.
Resolution 2005-363 states that in order for a property to be eligible for a Mills Act Preservation
Agreement, it must be listed in any state, city or county official register of historical
I architecturally significant sites, places and landmarks. For the purpose of the Mills Act Program,
the City designated the San Bernardino Historic Resources Reconnaissance Survey, Volume 2-
Tabular List of all Surveyed Historical Resources, dated April 30, 1991 as the official City
register of historical properties.
Research by local historians has discovered the absence of a number of historically significant
structures in the 1991 Tabular. For example, a recent article in the SUN Newspaper features a
home built in 1889 by city pioneer Fred Perris, for whom Perris Hill Park is named, which is not
included in the survey.
Under the current method of determination, many homes that might otherwise be qualified for
Mills Act Preservation Agreements are not, and a separate action is needed to amend Resolution
2005-363 each time one of these properties is identified for a Mills Act agreement. For this
reason, it is recommended that the Historic Preservation Commission be asked to create and
maintain a City Register of Historical and Architecturally Significant Properties to be used as an
addendum to the 1991 tabular. This register will follow a similar process of qualification to take
account of qualified properties excluded in the prior study.
It is anticipated that the creation of a City Register will make it easier for City staff to verify
qualifications for the program and streamline the Mills Act application process. It will also end
the need to amend Resolution 2005-363 each time there is an applicant whose property is not in
the 1991 survey.
The proposed amendment to Resolution 2005-363 incorporates the use of the new City Register.

5 WHEREAS, California Government Code, Article 12, Section 50280, more commonly
known as the Mills Act, established legislation providing property tax relief for owners of
6 qualified historic properties who contract with a city to abide by reasonable preservation
7 requirements; and
8 WHEREAS, under the current method of determination, many homes that might
otherwise be qualified for Mills Act Preservation Agreements are not contained in a 1991
9 survey of historically significant structures;
10 THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
11 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
12 SECTION 1. Section 5 of Resolution 2005-363 is hereby amended to read as follows:
13 "SECTION 5. Eligibility for a Preservation Agreement shall be limited
14 to the owners of those properties identified in the San Bernardino Historic
Resources Reconnaissance Survey, Volume 2 — Tabular List of All Surveyed
15 Historic Resources, dated April 30, 1991, and/or the official City Register of
Historical and Architecturally Significant Properties, which may be created by
16 the Historic Preservation Commission. The Mayor and Council hereby find that
all properties contained in these lists shall be considered Qualified Historic
17 Properties for purposes of the Mills Act, pursuant to California Government
18 Code Section 50280.1(b) ."
