Resolution awarding a contract to Nikola Construction Corporation for Sewer and Street
Improvements for Cedar St. from Baseline St. to Gilbert St., Canyon Rd. from Baseline St. to Gilbert
St., Wallace Ct. from Richardson St. to the easterly terminus, 24th St. from "H" St. to "G" St. (SW07-
02, SW07-01, SW06-01 & SW06-09), per Project Plan No. 11868.
Background:
This project involves the installation of new sewer main lines in four (4) locations. The first three
locations include Cedar St., Canyon Rd., and Wallace Ct., all of which serve areas annexed into the
City in 1990 and 1991. Residents in these three areas requested the installation of sewer improvements.
Since the pavement for these streets is in poor condition, the scope of the project also includes
rehabilitation of the pavement after the sewer installation. The installation of new sewer in these areas
will benefit the environment by reducing potential groundwater contamination.
In 2006, residents of the 24th Street location reported sewage system overflows in this area. Calls to our
Public Services Department with overflows of sewage prompted a fix. The project is different than
what was described in the CIP because the source of the problem was identified to be located west of
"G" Street, north of 24th Street (in the rear of properties along 24th Street and 25th Street). This area
was initially believed to flow south along "G" Street, but staff has determined that the best way to
correct the problem is to install a parallel sewer line in 24th Street between "G" Street and "H" Street.
This will reduce the flow in the line along the rear of the properties, reducing the potential for
overflow.
This project consists of the following:
I. Cutting the existing street and installing the new sewer line with laterals.
2. Filling, compacting, and patching the trenches.
3. Grinding and overlaying the entire street from curb to curb except 24th Street.
The plans and specifications for this project were completed and the project was opened to public
bidding on October 16,2007. The project was advertised locally in the San Bernardino County Sun
Newspaper, F. W. Dodge, Construction Bid Board, High Desert Plan Room, San Diego Daily
Transcript, Sub-Hub Online Plan Room, Reed Construction Data, Bid America Online, Construction
Bid Source, Bid Ocean, the City's web sites, and with the San Bernardino Area Chamber of
Commerce.

Based on review of the sealed competitive bids received, staff has determined that Nikola Construction
Corporation of Irvine, the apparent low bidder, has met the minimum requirements of the
specifications and bid guidelines; and, therefore, recommends that the Mayor and Common Council
award the referenced contract to Nikola Construction Corporation.
The estimated project costs are as follows:
$ 915,594.21
S 137,339.13
$ 147,066.66
S 1,200,000.00
If approved, this project is expected to begin construction in January of 2008 and be completed by July
of 2008.

9 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Nikola Construction Corporation, dba Nikola Corporation, 18012

12 Cowan, Suite 290, Irvine, CA 92614, is the lowest responsible bidder for Sewer and Street
13 Improvements, Cedar Street from Baseline Street to Gilbert Street, Canyon Road from Baseline
14 Street to Gilbert Street, Wallace Court from Richardson Street to East End, 24th Street from
15 "H" Street to "G" Street (SW07-02, SW07-01, SW06-01, & SW06-09), per Project Plan
16 No.11868. A contract is awarded accordingly to said bidder in a total amount of$915,594.21,
17 with a contingency amount of$147,066.66, but such award shall be effective only upon being
18
fully executed by both parties. All other bids, therefore, are hereby rejected. The City
19
20 Manager is hereby authorized and directed to execute said contract on behalf of the City; a
21 copy of the contract is on file in the office of the City Clerk and incorporated herein by
22 reference as fully as though set forth at length.
23 SECTION 2. This contract and any amendment or modifications thereto shall not take
24 effect or become operative until fully signed and executed by the parties and no party shall be
25
obligated hereunder until the time of such full execution. No oral agreements, amendments,
26
27 modifications or waivers are intended or authorized and shall not be implied from any act or
28 course of conduct of any party.
