STAFF REPORT
A total of three bids were received, ranging from
$18,727.71 to $30,940.00. However, a bid bond was not included
with the low bid as required by the special provision. This
failure to comply with the Notice Inviting Bids renders this bid
invalid, and dictates that it be rejected.
The second low bid of $26,544.98 is 11.5% over the Engi-
neer's Estimate of $23,800.00.
Listed below is an estimate of the total project cost,
based upon the second actual low bid price.
Construction Contract $ 26,544.98
Engr. & Insp. (w.O. #1343 & 1470) 12,000.00
Sub-Total $ 38,544.98
Contingencies (10%):1: 3,855.02
TOTAL ESTIMATED PROJECT COST $ 42,400.00
An amount of $20,000 has been allocated, under Account
No. 121-544-57557, for the storage building. Additional funds
in the amount of $15,000 will be provided from the Community
Development Appropriated reserve, in accordance with an agenda
item prepared by the Community 'Development Department. *
We recommend that a contract be awarded to the second
low bidder.

held March 20, 1989.

RESOLUTION OF THE CITY OF
CONTRACT TO HUBBS. EQUIPMENT AND
CONSTRUCTION OF STORAGE BUILDING FOR
DISABILITIES.
SAN BERNARDINO AWARDING A
CONSTRUCTION COMPANY FOR
CENTER FOR INDIVIDUALS WITH
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Hubbs Equipment and Construction Company is
7 the lowest responsible bidder for:
Construction of Storage
8 Building for Center for Individuals with Disabilities, in
9 accordance with Plan No. 7279, for the total amount of
10 $26,544.98, and a contract is awarded to said hidder accordingly,
11 but such award shc:;.ll he effective only. upon the contract being
12 fully executed by the parties; all other bids therefore are
13 hereby rejected; and the Mayor is hereby authorized and directed
14 to execute said contract on behalf of the City; a copy of the.
15 contract is attached hereto, marked Exhibit "A" and incorporated
16 herein by reference as fully as though set forth at length.
SECTION 2. This contract and any amendment or modificc:;.-
tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No
oral agreements, amendments, modifications or waivers are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San
