STAFF REPORT The Mayor and COIIIIIOn Council approved authorization on September 19, 1988 to implement one time per week Refuse collections in five (5) residential locations and seven (7) mobile home parks and the Mayor and COIIIIIOn Council also authorized by voice vote a $7.00 per month charge for additional ninety (90) gallon automated container. Mayor and Common Council held a public hearing on August 15, 1988 for Refuse rate increase on commercial drop-bodies and approved this rate increase on September 19, 1988, Resolution 88-308. The fees and charges set forth herein shall apply to refuse 7 collection services provided by the City. 8 SECTION 2. A minimum twenty-five ($25.00) deposit shall be required for 9 each new commercial refuse account. Said deposit must be paid prior to the 10 City commencing refuse collection service. This deposit shall be retained by 11 City and applied to any closing bill upon termination of service. Any excess 12 amount shall be refunded. 13 SECTION 3. Collection and Disposal of Refuse - Single Family residences. 14 For collection and disposal of refuse the owner, or authorized agent, of any 15 si ngle-family resi denti al premi ses, or porti ons, thereof, located withi n the 16 territorial limits of the City of San Bernardino, shall pay the following fee: 17 $7.00 per month for regular curbside or alley service. 18 $7.00 per month for one (1) time per week automated refuse service plus 19 $7.00 per month for each additional ninety (90) gallon automated container 20 requested. City is to provide each residence with one (1) ninety (90) gallon 21 container for automated collection only. Request( s) for additi ona 1 22 container(s) must have approval of property owner. Service is to be 23 implemented for approximately 8,000 single-family dwellings and will be in five 24 (5) sections throughout the territorial 1 imits of the City of San Bernardino 25 hich are on file in the Department of Public Services. SECTION 4. Yd. $68.80 $83.80 $15.00 10 *Includes monthly Bin Rental Fee. 11 (b) All fees pursuant to this Section shall be reviewed periodically and, 12 on the basis of findings; monthly fees shall be adjusted to maintain 13 conformance with the fee schedule set forth in Subsection (a) above, except 14 that monthly fees shall not be adjusted in relation to temporary variationsof 15 refuse due to seasonal factors, where such variations from the average do not 16 extend beyond a three-month period. 17 (c) When a City-owned bin is requested for use on a temporary basis; a 18 special delivery charge of ten dollars ($10.00) shall be made for each such 19 bin, in addition to the regular monthly bin rental fee; said monthly rental fee 20 shall be prorated for the period of such use, in increments of not less than 21 one (1) week. A service fee equal to twenty-five percent (25%) of the regular 22 monthly collection and disposal fee for the size of bin so-utilized shall be 23 charged for each time the bin is serviced. 24 SECTION 7. Collection and Oisposal of refuse utilizing compaction-type 9 containers and commercial dro -bodies. 10 (a) When the service performed by the City is the collection and disposal 11 of refuse placed for collection in City-approved compaction-type containers or 12 commercial drop-bodies, having a capacity of 10, 20; 30, or 40 cubic yards, the 13 fee for each time of collection shall be as listed below. A monthly rental fee 14 shall be charged for the use of City-owned containers and shall be in addition 15 to the collection and disposal fee. 16 17 18 19 20 21 CONTAINER CAPACITY 10 Cu. Yds. Yds. $130.00 (legal tonnage)** *Includes monthly Container Rental Fee. 22 **Customer will pay in excess of legal tonnage allowed per container size. 23 (b) In the event the City is required to pay a disposal charge for 24 construction material, or other refuse which is classified as "Hard to Handle", 25 the amount of any such additional disposal charge; or for weight charges in 26 excess of eight (8) tons, shall be a debt of the customer and shall be added to 27 the base fee due the Ci ty. 28 (c) Removal of tires shall be at the rate of thirty-five dollars and 03-16-89 4 o o 1 twenty cents ($35.20) per ton Disposal Fee plus thirty dollars ($30.00) Service 2 Charge. 3 SECTION 9. The Director of Public Services; upon request, may provide for 4 the special collection and removal of refuse from any place or premises at any 5 time, in addition to or beyond the regular collection service schedule, or in a 6 manner different from normal collection practice and procedures. The rate for 7 any such special service shall be thirty dollars ($30.00) per hour with a 8 minimum charge of seven dollars and fifty cents ($7.50). 9 SECTION 10. All fees and charges set forth in this resolution shall be 10 collected monthly. 11 SECTION 11. Any service for the collection and disposal of refuse as set 12 forth in this resolution may be discontinued by the Director of Public Services 13 if any fees or charges, as levied herein, are not paid within ninety (90) days 14 from the date of said assessment is billed. 15 SECTION 12. The Mayor and Common Council may exempt from the fee 16 provi si ons and charges of thi s resol uti on certai n nonprofi t events in the 17 public interest. The exemption shall be subject to any conditions imposed by 18 the Director of Public Services. 19 SECTION 13. The Director of Public Services may provide collection and 20 disposal service without charge in emergency situations and when, in the 21 opi ni on of the Di rector, such acti on is necessary to correct fi re hazards, or 22 other conditions which present an imminent threat to health and safety. 23 SECTION 14.
