STAFF REPORT
Bids for the construction of Phase I-B of Seccombe Lake
Park were received at 2:00 p.m. on Tuesday, 2-21-89.
A total of 5 bids were received, ranging from
$2,018,625.32 to $2,675,758.80. The low bid of $2,018,625.32
is 3.7% under the Architect/Engineer's Estimate of
$2,096,692.00.
Listed below is an estimate of the total project cost,
based upon the actual low bid price.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO MARINA CONTRACTORS, INC. FOR CONSTRUCTION OF SECCOMBE
LAKE STATE URBAN RECREATION AREA, PHASE I-B.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
Marina Contractors, Inc. is the lowest
responsible bidder for:
Construction of Seccombe Lake State
Urban Recreation Area, Phase I-B, in accordance with Plan No.
7444, for the total amount of $2,018,625.32, and a contract for
the Basic Bid and Additive Alternates No.1, 5a, 5b, 5c, 5d, 5e,
5f, and 5g; is awarded to said bidder accordingly, but such award
shall be effective only upon the contract being fully executed by
the parties; all other bids therefore are hereby rejected; ilnd
the Mayor is hereby authorized and directed to execute said
contract on behalf of the City;

reference as fully as though set forth at length.
SECTION 2. This contract and any amendment or modifica-
tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No
oral agreements, amendments, modifications or waivers are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
