Background Information This is a request to reconsider the agenda item R-27 of April 4, 2006 pertaining to Resolution 2006-98 (2), Approval of the amendments to the 2000-2005 and 2005-2010 Consolidated Plans and 2004-2005 and 2005-2006 Annual Action Plans and reconsideration of the CDBG fund allocation of $862,784 used for the Code Enforcement Demolition Strategy Plan. A review of the backup provided to the Mayor and Council on April 4, 2006 shows that the amendments referred to in Item 2) of the Resolution were not provided to the Mayor and Council before the vote approving them was taken at that meeting. The Code Enforcement department has apparently presumed, possibly mistakenly, that the Mayor and Council took action formally approving the demolition strategy. This has resulted in complaints generated from businesses and residents of the inconsistencies in a strategy that may not have been formally adopted by this body. (Apparently the strategy was reviewed by the Redevelopment Committee on March 21 , 2006.) Financial Impact None. Recommendation 1 . Outline of events for Demolition Strategy • March 21, 2006 —The Redevelopment Committee recommended that$862,784 be allocated to the Demolition Fund (Attachment A-Agenda and meeting minutes). This action included a proposed Demolition Strategy which sought to target the most deteriorated properties (substandard and hazardous) in the City in an effort to improve the community. The list of properties included the property at 1588 W Highland Ave (Attachment B). • March 29, 2006—The Mayor and Council approved a resolution authorizing the reallocation of CDBG Funding, which included the $862,784 to the Demolition Fund as recommended by the Redevelopment Committee (Attachment Q. • The Code Enforcement Department then established demolition criteria in an effort to rank the properties identified in the Demolition Strategy and ranked the properties accordingly (Attachment D). The property located at 1588 W Highland Ave ranked eleven points (twelve being the greatest)to receive a demolition order. • Attachment E is the current status of the properties ranked for demolition. The property at 1588 W Highland Ave is in Group 2 and was demolished by the owner approximately four months ago. ROLL CALL Roll call was taken by Secretary Chantha with the following being present: Committee Members Estrada, McGinnis, and Johnson; Interim Executive Director Pacheco; Senior Assistant City Attorney Calkins; Project Manager Strange; Assistant Project Manager Espinoza; Code Compliance Director Baude; Senior Code Compliance Officer Mansfield; Marketing/Public Affairs/Public Information Officer Director Durr. Also present: Jim Mulvihill, Private Citizen. 1. PUBLIC COMMENTS/ANNOUNCEMENTS There were no public comments at this meeting. 2. MINUTES Committee Member McGinnis made a motion, seconded by Committee Member Johnson that the minutes for the Redevelopment Committee meeting of February 21, 2006, be approved as submitted in typewritten form. At 4:40 p.m., Assistant to the Mayor/Community Liaison Hazlett and City Manager Wilson entered the meeting. 3. PROPOSED DEMOLITION STRATEGY — "PRESENTATION BY CODE COMPLIANCE DIRECTOR GLENN BAUDE Code Compliance Director Baude provided the Committee with a "Draft" copy of the Strategic Plan and Demolition of Substandard Buildings and explained that he would like the Committee's input before it is finalized. Mr. Baude stated that the purpose of the demolition plan is to seek out the most deteriorated properties in the City as well as the properties that will give the City the most physical impact to improve the community and are substandard and hazardous. Mr. Baude gave a presentation highlighting briefly on the following categories in the handout: vision, mission statement, strengths, weaknesses, opportunities and threats, strategies and actions, prioritization and implementation schedule and reporting. At 4:44 p.m., a member of the public entered the meeting. I March 21, 2006 Mr. Baude informed the Committee that the demolition criteria and evaluation chart in the handout listed properties, which are ranked by highest priority under the total column and asked the Committee to let him know of changes that needed to be made. At 4:46 p.m., a reporter entered the meeting. Mr. Baude continued with the next stage after the demolition criteria by identifying the 12 major thoroughfares, which were surveyed, and stated that 71 properties were identified as being vacant and that there are hearing orders for current commercial properties on the demolition list followed by the Code Compliance survey regarding vacant commercial property update and the URM building list prepared by Development Services Department. Mr. Baude then provided a brief overview of the map illustrating the colors and areas of unreinforced masonry and vacant commercial properties. Questions and comments were raised by the Committee and answers were provided by Mr. Baude. For a full detailed presentation, refer to the tape. At 4:48 p.m., Executive Assistant to Council Carlos entered the meeting. Ms. Pacheco added that Staff is proceeding with the Committee's recommendation that $849,000 which the Committee previously acted on, be forwarded to the Mayor and Common Council on April 3 so it will create the revenue source that Mr. Baude is referring to for the demolitions under his program. Committee Member Estrada inquired if a copy of the map presented will be provided to the Committee and Mr. Baude responded yes, once it is reviewed and in the final form. Committee Member Estrada inquired if the Committee needed to take action and Ms. Pacheco responded'no, that it was her understanding that at the time the Committee allocated the monies, it was requested to get a feel of what the strategy would be and if a recommendation is needed, she has allowed for it on the agenda, but not necessary. At 4:51 p.m., Assistant Project Manager Espinoza left the meeting. 4. GENERAL COUNSEL LEGAL SERVICES CONTRACT FOR THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF SAN BERNARDINO (ON BEHALF OF THE ECONOMIC DEVELOPMENT AGENCY) Interim Executive Director Pacheco informed the Committee that she has attempted to provide as much background information in the Staff Report as she is aware of, relative to this matter and stated that the report is comprehensive and offers extensive background. Ms. Pacheco stated that at this point in time, there is nothing more to add to the Staff Report unless there are specific questions and that the recommendation is clear and it is up to the Committee to act upon. At 4:53 p.m., Senior Code Compliance Officer Mansfield left the meeting and a member of the public entered the meeting. 2 March 21, 2006 Committee Member Johnson inquired at which time did the City Attorney became part of the Economic Development Agency process and Ms. Pacheco responded that it is unclear to her because the chronology of events dates back to 1994 or 1995. Ms. Pacheco stated not having been around and by looking at the files beyond that whether there was a formal obligation on the part of the Agency or whether the City Attorney's office has always served as counsel to the Agency and asked Senior Assistant City Attorney Calkins if he has any further information beyond and Mr. Calkins responded no. Committee Member Johnson inquired if the Agency was under the City at one time and Ms. Pacheco responded that she had understood the Agency was part of the City; however, according to recent discussions with Barbara Lindseth, the Agency was never really part of the City, only the Community Development Department, about 10 years ago. Discussions ensued regarding how the Community Development Department, which handled CDBG became part of the City, how the different departments in the last five years have all been incorporated into the Economic Development Agency as an organization and the Commission as the legal entity overseeing the Economic Development Agency. Ms. Pacheco informed the Committee that Staff is out with an RFP per the Committee/Commission's direction, the proposals are due at the end of March, and that Staff will be evaluating them once received and returning to the Commission with a recommendation on the selected firm. CLOSED SESSION . Ms. Pacheco recommended that the following closed session items be deferred at this time. Chantha, Secretary 4 March 21, 2006 ATTACHMENT "B " DRAFT CITY OF SAN BERNARDINO STRATEGIC PLAN DEMOLITION OF SUBSTANDARD BUILDINGS VISION We will seek to improve the commercial and residential environment of San Bernardino by demolishing the most blighted, substandard and hazardous buildings. The focus will be on buildings that have been vacant for an extended period of time, have deteriorated and become a public nuisance and have lost their viability for reuse. MISSION STATEM E1�IT We will evaluate all current vacant commercial buildings and rank them as to their condition and capability for reuse. Those who have become so deteriorated or out of conformance that there is no chance of reuse will be prioritized for demolition. Additional priorities will be buildings that are unreinforced masonry and buildings that are along our main thoroughfares. S NGRTS EAKNESSES OPPORTUNITIES AND THREATS —Code Compliance has experience and a process in place to facilitate demolitions. There is a recommendation to provide funding of close to a million dollars; the most ever budgeted for demolition. Council also recently passed a new ordinance to deal with unreinforced masonry buildings. WEAKNESSES—The legal process to demolish a building is labor intensive and time consuming. If challenged, the process can also lead to lengthy appeals and legal challenges. Although a million dollars is a substantial amount of demolition money commercial buildings, especially if they contain large amounts of hazardous materials, can.be very expensive to demolish. Also the results of demolition is a vacant lot which will have to be maintained. OPPORTUAII77ES— This could be a great opportunity to begin a systematic process of removing the most deteriorated properties from our commercial corridors. It is also an opportunity, if used as part of a comprehensive program, to improve our older business areas. This is also and opportunity to bunch demolitions to improve the appearance and economic viability of our commercial areas. THREATS—As long as the program has council support the only threat would be through legal challenges from property owners. Those have happened before, and although it tends to lengthen the process, we have always prevailed. STRATEGIES & ACTIONS Although we will continue our normal process of dealing with substandard residential properties under this program focus will be given to commercial buildings in our most visible areas. Code Compliance staff has identified vacant properties along the older commercial corridors in San Bernardino. Additionally, the Building Division has identified unreinforced masonry buildings throughout the city. These fists will be cross- referenced and priority given to vacant unreinforced masonry buildings that are the most deteriorated and least likely to ever be reused. Also the length of time it has been vacant and deteriorating without owner attention will be considered. Attention will be paid to properties on the list that are in close proximity of each other to provide the greatest impact and save costs on demolition. A Code Compliance team has been set up to evaluate and prioritize properties for demolition. The team consists of Supervising Code Compliance Officer Jodi Mansfield (our current demolition senior officer), Code Compliance Officer Curtis Stone(currently assigned to business improvement), and Glenn Baude, Director of Code Compliance. The following demolition process will be used (most is required by law): • Verify, recheck and cross reference the lists • Prioritize buildings for demolition • Begin notification process to owners • Set properties for hearing to obtain demolition order • Take properties through hearing process, appeals or legal cha s • As properties clear due process requirements schedule otio ob walks and obtain bids • Accept bids and demolish property PRIOIZH ATION AND MOL.EMENTATION SUZOI .F. Code Compliance is currently gearing up in anticipation that the funding will be approved. By the end of April we would expect to have the properties checked and cross-referenced, and by the end of May have completed our analysis and prioritization. Properties will be evaluated by the following criteria, subject to review and input by council members: l) Condition of the property Z) URM properties 3) Lack of opportunity for reuse 4) Years of neglect 5) Demolitions that will provide the most positive results for the commercial neighborhood b) Properties on high visibility main thoroughfares 7) Properties with existing hearing orders for demolition �tirtril Once the properties are evaluated we will look for opportunities do demolitions that are close to each other providing cost savings and a greater opportunity to improve the economic viability of the area_ By July 1, 2006 we hope to be at step four by setting properties for hearing to obtain demolition orders. REPORTING Each month, with our departmental monthly report, we will include a matrix showing the progress on each of the properties selected. The status of each property will be provided. The City is the recipient of these federal funds and the Economic Development Agency functions as the administrator and is responsible for the oversight, implementation, and compliance of said Programs. CDBG funds may be used for a variety of activities that include but are not limited to, acquisition, disposition, public facilities and improvements, street improvements, clearance and demolition activities, public services, relocation expenses, and homeownership assistance. Organizations that receive CDBG funds enter into a contract with the Agency that requires them to expend their allocation by the end of each program year, typically ending June 30th. It has been the Agency's policy not to carry over any unexpended public service funds and Staff has identified these unspent expenditures in order to allocate CDBG funds to other projects that are needed in the community. Section A of Attachment I shows the Staff recommended projects and programs that were subsequently modified by the Redevelopment Committee as per Attachment I, Section B on February 21, 2006. In February, there was an additional $13,580 in CDBG program income. The total amount of CDBG funds for these two (2) proposed projects is $600,000. The Redevelopment Committee recommended that the $600,000 be added to the Demolition Fund and also asked that Code Compliance Director present a City-wide demolition plan to the Committee, which occurred on March 21, 2006. The Redevelopment Committee also recommended that the $13,580 of additional program income also be allocated to the Demolition Fund, bringing the total Demolition Fund to $862,784. California Theatre Second Phase Renovation(Phase II) $400,000 The Agency plans to renovate,modernize,and enlarge the inefficient and aged first floor men and women restrooms. In addition,for safety reasons,the Agency will install a new fire sprinkler system throughout the Theatre. 2. Police Department(Public Safety) $350,000 This proposed allocation will allow for the hiring of 3 police officers,per recommendation of the City Manager. 3. Installation of Traffic Signal(Highland&Central) $250,000 Per recommendation of Engineering and Police departments,the project consists of installation of a 4-phase traffic signal that has"spread-spectrum" interconnection capability to Orange Street,and signalized main entrance to Patton State Hospital. An analysis of the accident history at this intersection indicates a high frequency of turning accidents that could be reduced by installation of a traffic signal. 4. YWCA Installation of Security Fencing(Parks and Recreation) $50,000 Installation of a 6'wrought iron fence located at the east side of the YWCA's main office. This will allow access to the facility via the rear side of the fence,and provide security against vandalism,and potential crime in general. 5. Construction of"F"Street Parking Lot $350,000 A conceptual plan for a new parking lot was drawn by the Agency and with the assistance of the City's Engineering Department. The"F"Street parking lot will provide an additional 52 parking spaces to serve both the 20-plex Cinema Star and the Historic California Theatre. The design of the parking lot will include landscaping,lighting,handicap spaces,and a decorative pole sign. 6. Reconstruction of Bus Stop on"E"Street $50,000 This project consists of the removal of a dirt planter and replacement with flagstone paving,with decorative boulders and two serpentine bus benches. Existing street trees will remain. 7. Reconstruction of East King Street and street improvements(Meadowbrook Housing Development) $200,000 This project consists of the reconstruction and repaving of an existing street to allow proper surface drainage onto Sierra Way. Installation of a new sidewalk on the northwest corner of Allen and King Street;will include an accessible ramp. These improvements will enhance the quality of the Meadowbrook Housing Development for homebuyers that will purchase homes in this new urban infill project. 8. The process starts with identification of potential demolition properties. These properties are identified through an internal procedure that ranks properties based on objective criteria: 1) Condition of property 2) URM status 3) Lack of opportunity for reuse 4) Years of neglect 5) Demolition that will provide the most positive results for commercial neighborhoods 6) Properties on high visibility main thoroughfares Not all properties identified are eventually demolished. There are instances where the property owner brings the property into compliance prior to demolition. Once the properties are identified a detailed process is followed to proceed to demolition. That process was created in conjunction with, and approved by,the City Attorneys' Office and outlines procedures to insure due diligence and due process. A simple overview of the process would be: 1) Notice of violation 2) Notice of Hearing 3) Hearing 4) Asbestos warrant 5) Demolition warrant 6) Demolition This process is closely overseen by the City Attorneys' Office who signs off on the Notice of Hearing(only for rehab demos), Hearing Order and all Warrants. The process cannot be completed without City Attorney review and approval. Additionally you have asked me for information specific to 2206 Ramona which is the property located adjacent to The Mug Restaurant and has a separate parcel number from the property on which The Mug Restaurant is located. Mr. Anthony"Tony" Trozera,the owner of The Mug Restaurant is listed as one of the owners of the Ramona property. The Property was originally inspected by Officer Curtis Stone on June 15, 2005. A Notice of Hearing and Statement of Costs was sent to all interested parties on June 1, 2007. The hearing was held on June 14, 2007 and Mr. Trozera attended the hearing. The basis for recommending demolition of the building included the overall dilapidated condition of the structure, the fact that the property had been vacant for over 30 years (based on no water service for that length of time) and that the property had been rezoned from residential to commercial and therefore the Single Family residence on the property had lost its non-conforming use and therefore could not be rehabilitated. The Hearing Officer issued an order on June 28, 2007 which ordered the property owner to obtain permits within ten days to either rehab or demolish the property and to complete all work within ninety days. The Hearing Order also provided that if the demolition was completed within the 90 day timeframe,that all hearing costs would be waived. The Hearing Order was signed by the Hearing Officer and by a City Attorney representative. The Order also included language that allowed appeal of the order to the Board of Building Commissioners. Mr. Trozera did not file an appeal. The owner subsequently demolished the building and the building department finalized it on July 25th, 2007. If the owner fails to comply with the order of the Hearing Officer, within the time specified, the City may initiate action, including 8 demolition, removal of unpermitted construction and any other actions necessary to 9 abate the nuisance. 10 11 SECTION 4. It was determined that the City was required to initiate abatement 12 proceedings and incurred costs in the amount of $1,052.58. The costs of$1,052.58 13 shall be waived if the property is in compliance within the timeframes as required by 14 Section 2 of this order. Due to the failure of the owner(s) of record to respond or comply 15 within the time frame stated on the previous notice of violation issued, the owner(s) shall 16 incur these direct costs and any additional abatement costs as a lien upon record. Upon receipt of an application from the person required to conform s to the order and by agreement of such person to comply with the order if allowed 9 10 additional time, the Supervising Building Official may grant an extension of time, not to 11 exceed an additional 120 days, within which to complete said repair, rehabilitation or 12 demolition, if the Supervising Building Official determines that such an extension of time 13 will not create or perpetuate a situation imminently dangerous to life or property. The 14 Supervising Building Official's authority to extend time is limited to the physical repair, 15 rehabilitation or demolition of the premises and will not in any way affect or extend the 16 time to appeal the notice and order. 17 18 SECTION 7. Any person aggrieved by this order may appeal to the Board of 19 Building Commissioners by filing a written statement with the City Clerk. Samples were taken of all suspect asbestos containing building materials at the request of the client named above. Various removed samples were submitted to Tec-An, Inc. in Oklahoma City, OK j (NVLAP Code 200325-0) to estimate the percentage of asbestos by volume and determine the type(s) present. . Tec-An, Inc. determines percentages and type of asbestos by using EPA approved method 600/R-93/116, the principles of polarized light microscopy and dispersion staining. Asbestos is quantified by using the visual arena estimation technique and can only determine the approximate percentage of asbestos present. After a thorough search is conducted and no asbestos is detected "none detected" will be noted in the report. The essence of polarized light microscopy is not to emphatically determine that no asbestos is present, merely that none was detected or, if it was, it was likely to be less than 1.0% of the sample. When findings reveal less than 1.0% asbestos contained in a sample, further analysis may be called for on additional samples to confirm or denounce the initial findings. The South Coast Air Quality Management District (SCAQMD) recommends three or more samples from a homogeneous area be analyzed before any building material is determined to be nonhazardous. The samples listed and described below were taken from reasonably accessible areas of the building. Any materials located in areas of the building that were inaccessible were not tested. Such areas include, but are not limited to, narrow crawl spaces and unstable/dangerous roof or floor areas. Agenda Item #33 was transmitted to the City Clerk and placed the agenda on late Friday afternoon, many days after the official agenda deadline for our meetings. Also, there was no prior discussion of the issues raised in Agenda Item 433 with either the City Manager or the affected department head prior to its placement on the agenda. While I understand that there are late-breaking, emergency items that require immediate action by the Mayor and Common Council and necessitate ignoring our agenda deadlines, but this item appears to meet none of those standards. Instead, Agenda Item 433 relates to concerns expressed by a council member about administrative Code Enforcement procedures, for which no apparent emergency exists, and for which there was no prior discussion with the City Manager or Code Enforcement Director prior to placing the matter on the agenda. Which brings me to my fundamental concern — I am concerned about the process by which items are placed on our meeting agendas. Agenda items that concern our city departments, their procedures, services, or management, must be discussed with the City Manager and the affected department head, prior to being brought before the Mayor and Common Council. There are several fundamentally sound public policy goals behind this critical procedure: • Our City Charter delegates the city manager the authority to supervise and manage our city departments. To allow our city manager to perform his job, concerns about city departments must be discussed with the city manager, so he can thoroughly investigate concerns, facts can be obtained, and issues can be addressed at the city manager's administrative level. If city department concerns -1- cannot be successfully resolved at the city manager's administrative level, only then should the issue, with all its facts and a recommended action by our professional staff, be laid before the Mayor and Common Council for discussion and possible action. • If the above-procedure is not followed, we will substantially undermine the city manager form of government that was created by voters when our City Charter was amended in 2005. One of the fundamental purposes of creating a city manager form of government is efficiency. With a city manager, administrative decisions that can improve the function and operation of city services can be made quickly and efficiently on a regular basis, without the need for multiple meetings and consensus building among elected officials. But if elected officials consistently bypass this efficiency, and place items on the agenda that the city manager has never been given an opportunity to address, that have not been investigated to determine the facts or issues, and for which there is no professional recommendation for the elected officials to consider at the meeting, then we are wasting our taxpayer's money. Our city government is only as efficient as we make it. We must agree to abide by some procedures that ensure we are empowering our city manager to do his job. While I am not recommending the adoption of some formal procedures, I hope you will join me in agreeing to abide by an informal rule that agenda items relating to the operations, procedures, and management of our city departments that have not been previously placed before city manager for his action and resolution, should be immediately referred by the Mayor and Common Council to the city manager without debate or discussion.
