BACKGROUND On July 16,2007, the Mayor and Common Council approved Resolution #2007-310 approving and adopting the City of San Bernardino's final budget for Fiscal Year 2007-2008. The expenditure budget includes $3,000 for rechargeable Taser batteries in Account #001-212-5111 and $90,000 for Tasers. holsters and accessories in Account #001-223-5704 (Measure Z funding). On August 6, 2007, the Mayor and Common Council approved a motion to authorizing the Director of Finance to amend the FY 2007-2008 budget to add both revenue and expenditure budgets for the nine (9) Development Impact Funds (DIFF). The approved 261-Law Enforcement Development Impact Fund expenditure budget includes $27,500 for the purchase of Tasers, holsters and accessories. The Police Department currently deploys Taser International M26 Tasers, as availability allows. The department has 30 functioning Tasers, which are deployed across four patrol shifts per day, seven days a week, with an average deployment of 8-10 Tasers per shift. As each patrol shift deploys 15-18 officers, this leaves about 50% of officers deployed without a Taser on a regular basis. The last major purchase of M26 Tasers occurred in FY 2000-2001 and they are approaching replacement age. Chief Billdt has established a Taser deployment plan that will issue a Taser to every Patrol officer and supervisor to reduce the lag time for the arrival of a Taser to a scene where it is needed. Law enforcement agencies deploying Tasers in a similar fashion .have realized reductions in civil liability claims, injuries to officers, injuries to suspects, workers comp claims and costs associated with injuries to suspects by using impact weapons or other law enforcement tools. Currently only two companies, Stinger Stun Systems and Taser International, manufacture law enforcement grade Electronic Control Devices that meet accepted police industry standards. The independent research firm of Critical Research and Training in Less Lethal Systems conducted a study on the effectiveness of the Stinger S-200 and the Taser X26E. The research was conducted using protocols set by the International Association of Chiefs of Police. The study concluded that the effectiveness of the X26E was far superior to the Stinger S-200. Additionally, the Riverside County Sheriffs Department and California Highway Patrol recently tested both Stinger and Taser Electronic Control Devices and have opted to purchase Taser International e e e ~;1 Products. Taser International has a solid reputation in the law enforcement industry for producing an effective weapon. Currently, only Taser International Tasers are utilized by California Law Enforcement agencies. As the Police Department currently utilizes the Taser International M26 Taser, the familiarity with this Taser will accelerate the transition to the X26E Taser and promote confidence among officers. The core differences between M26 and X26E Tasers are improved weapon capability, improved battery life, reduction in battery cost and a streamlined product for simplicity in carrying the weapon. Additionally, the X26E allows information associated with the usage from each Taser to be downloaded to provide greater accountability. In preparation of this purchase, the Police Department researched Taser product information, developed specifications, reviewed test studies and inspected and evaluated all law enforcement grade Tasers currently on the market. The only Taser that meets or exceeds department specifications is the X26E Taser manufactured by Taser International. Proforce Law Enforcement in Brea, CA has exclusive distribution rights for Taser International products in the 10 western states. The Police Department is requesting an exemption from the formal bid process pursuant to Section 3.04.010(b)(3) of the San Bernardino Municipal Code. The FY 2007-2008 budget includes $120,500 for the purchase of 120 Tasers and equipment. The department anticipates the need for an additional 120 Tasers and equipment by the end of FY 2008-09. An inventory of 240 Tasers would allow for the issuance of one Taser for each Patrol, MET and traffic officer as well as the field sergeants assigned to those units. In FY 2008- 09 the department will earmark $120,500 from the Measure Z and Development Impact Fee budgets for the purchase of the additional Tasers and equipment to complete this purchase. FINANCIAL IMPACT The Police Department will purchase 240 Tasers, accessories and training supplies over two fiscal years. The cost breakdown each fiscal year is as follows. The Fiscal Year 2008/2009 renewal option shall be contingent upon funds being approved in the City annual budget for this purchase. SECTION 2: That the Mayor and Common Council approve an exemption from the bid process for helicopter patrol services per Municipal Code 3.04.010 (b)(3). SECTION 3: The authorization to execute the above referenced purchase order is rescinded ifit is not issued within sixty (60) days of the passage of this resolution.
