Staff Report
SUBJECT:
Resolution consenting to a Reorganization consisting of detachment from the City of San
Bernardino Sphere of Influence and City Boundary, and annexation to the City of Highland for a
3.62-acre parcel located at the northerly terminus of Applewood Street in the City of San
Bernardino.
BACKGROUND:
The City of Highland had previously requested that the City of San Bernardino consider de-
annexing a 3.62-acre parcel that is generally located at the northeast corner of the City of San
Bernardino at the northerly terminus of Applewood Street, known as Assessor's Parcel No.
1199-341-15, for the purpose of annexing into the City of Highland, on behalf of the property
owner. The proposed development for this property consists of five (5) residential parcels all
approximately liz-acre each. Currently, the only way to access this property is through the City
of Highland. Various City of San Bernardino Departments have reviewed this request and
determined that because of access, the City of Highland may be better suited for providing
service to this area (i.e. refuse, street and sidewalk maintenance, safety, etc.).
On August 2, 2005, this proposal from the City of Highland was submitted to the Legislative
Review Committee (LRC). Based on staff input and review, the LRC recommended that the
annexation request of the City of Highland be brought before the Mayor and Common Council
for authorization to proceed with the de-annexation of this 3.62-acre parcel from the City of San
Bernardino, and on September 6, 2005, authorization was given to proceed with the de-
annexation of the 3.62-acre parcel from the City of San Bernardino and annexation into the City
of Highland.
On June 20, 2007, the City of Highland had advised us that they were ready to process this
Reorganization consisting of detachment from the City of San Bernardino's Sphere of Influence
and City Boundary, and annexation to the City of Highland through LAFCO. The attached
resolution gives the City's consent to the proposal through LAFCO. As part of the proceedings,
the City of San Bernardino and City of Highland will need to agree to the annual property tax
revenue that is to be transferred to the City of Highland, which will be submitted for your review
at a later time. This is estimated to be $722.00. No other revenues will need to be transferred.
FINANCIAL IMPACT:
Loss of annual property tax revenue. ($722.00 - current amount)
RECOMMENDATION:
Adopt Resolution.

REORGANIZATION CONSISTING OF THE DETACHMENT OF A CERTAIN
PARCEL OF LAND FROM THE CITY OF SAN BERNARDINO SPHERE OF
INFLUENCE AND CITY BOUNDARY AND ATTACHMENT TO THE SPHERE OF
INFLUENCE AND ANNEXATION TO THE CITY OF HIGHLAND GENERALLY
LOCATED AT THE NORTHERLY TERMINUS OF APPLEWOOD STREET IN THE
CITY OF SAN BERNARDINO.
WHEREAS, the City of San Bernardino and the City of HigWand desire to initiate
..
proceedings pursuant to the Cortese-Knox-Hertzberg Local Government Reorganizaton Act of
2000 for:
I. A Sphere of Influence amendments for the City of San Bernardino (reduction) and the
City of Highland (expansion); and
2. A detachment from the City of San Bernardino and annexation into the City of
HigWand.
WHEREAS, the adjustment to the boundary between the two Cities includes 3.62-acres
generally located at the northern terminus of Applewood Street and Church Street, in the City
of San Bernardino; and
WHEREAS, the proposed boundary adjustment and annexation, to be included in this
application to the Local Agency Formation Commission of the County of San Bernardino
("LAFCO") is legally uninhabited, and a map of the boundaries of the territory is set forth in
Exhibit "A" and legally described in Exhibit "B" attached hereto and by this reference
incorporated herein; and
WHEREAS, it is desired that the proposed reorganization be subject to the following
terms and conditions:

THE SPHERE OF INFLUENCE AND ANNEXATION TO THE CITY OF HIGHLAND GENERALLY
LOCATED AT THE NORTHERLY TERMINUS OF APPLE WOOD STREET IN THE CITY OF SAN
BERNARDINO.
SECTION 1. Consent is hereby given to the City of Highland to file the appropriate
applications with the Local Agency Formation Commission of the County of San Bernardino
for a sphere of influence amendment and the reorganization of territory between the City of
San Bernardino and the City of Highland, located generally in the Highland Hills Specific Plan
area at the north terminus of Applewood Street, and further identified on Exhibits "A" and "B"
attached hereto, pursuant to Government Code Section 56000 et seq., the Cortese-Knox-
Hertzberg Local Reorganization Act of 2000, and the procedures of said Local Agency
Formation Commission.
SECTION 2. The City Clerk of the City of San Bernardino is hereby authorized and
directed to file, or cause to be filed, a certified copy of this Resolution with the Executive
Officer of the Local Agency Formation Commission of the County of San Bernardino.
