STAFF REPORT
Subject:
Resolution approving Amendment No. I to Professional Services Agreements with Hall and
Foreman, Inc. and AEI-CASC Consulting for On-Call Plan Review Services and Resolution
Amending Resolution 2006- I 49 for Outside Plan Checking Services.
Background:
The Development Services Department is responsible for development plan review and plan
checking for various land development and capital improvement projects. These responsibilities
include the review and plan checking of roads, bridges, buildings, grading, drainage,
landscaping, traffic signals, on-site improvements, handicap ramps, etc.
On October 16, 2006, the Mayor and Common Council adopted Resolution No. 2006-363,
approving Professional Services Agreements with Hall & Foreman, Inc. and AEI-CASC
Consulting for On-Call Plan Review Services. The total amount of funding allocation approved
for both consultants was $450,000 in aggregate.
On July 2, 2007, the Mayor and Common Council adopted Resolution No. 2007-212, increasing
the expenditure authorization by $650,000 in aggregate, giving a total expenditure authorization
of$I,OOO,OOO in aggregate.
Checking of documents required by San Bernardino County National Pollutant Discharge
Elimination System (NPDES) permit for development projects was retained in-house. These
documents, in general, consist of Water Quality Management Plans (WQMP) and Storm Water
Pollution Prevention Plans (SWPPP). The SWPPP's are mostly for construction and can be
adequately addressed separately of the plan review operation. However, the WQMP is closely
intertwined with the project design and close coordination with review of the development plans
IS necessary.
The WQMP's vary in complexity depending on the type of project. Many projects can meet
their NPDES requirements by providing a "non-categorical" WQMP, which is a very simple
document. Certain types of projects have a greater potential to pollute rivers and streams and
have the potential to adversely affect the drainage regime of natural channels due to the amount
of runoff leaving the project site. These projects are required to prepare a "categorical" WQMP,
which can be very complex and cost thousands of dollars to prepare. The categorical WQMP's
must be coordinated with the development plans and require many hours to check.
Approximately 15 to 20 projects requiring categorical WQMP's are processed each month.
In order to provide better coordination and efficiency for proccssing of complex projects, staff is
proposing to send the categorical WQMP's together with the development plans to the outside
consultant for checking.
In order to implement this new procedure, a Request for Proposal (RFP) was sent on March 30,
2007 to 35 firms. Five firms responded. These firms were: (I) AEI-CASC Consulting; (2) Hall
& Foreman, Inc.; (3) Bonadiman Consulting Engineering; (4) Engineering Resources; and (5)
Baqai and Associates. All five respondents were interviewed.

Based on a review of proposals and interviews, staff determined that Hall & Foreman, Inc. and
AEI-CASC Consulting submitted the proposals best meeting the requirements of the RFP. Hall
& Foreman, Inc. and AEI-CASC Consulting had the most experience and expertise reviewing
and evaluating San Bernardino County Water Quality Management Plans within the surrounding
cities, consistent with the San Bernardino County WQMP Guidance Template.
Both Hall & Foreman Inc. and AEI-CASC Consulting are presently retained by the City to
provide on-call plan review services. Therefore, staff recommends that the attached Amendment
No. I to the Agreements providing for consultant review of WQMP's be approved and that the
attached resolution establishing cost accounting methods for consultant checking of Water
Quality Management Plans (WQMP) be adopted.
Financial Impact:
Under the current method of accounting for plan check fees as provided by Resolution 2006-149
for outside plan checking services, AEI-CASC Consulting and Hall & Foreman, Inc. have agreed
to accept 65% of the City's standard plan checking fees collected from applicants as full
compensation for their services and the balance of 35% is retained by the City to cover in-house
administrative costs.
Both consultants have indicated that the above formula will not provide adequate compensation
for checking WQMP's. Therefore, staff is proposing the attached resolution that will set a
deposit amount to be collected at the time of submittal ofthe WQMP's. An additional 20% will
be collected from the applicant to compensate for staff costs. After completion of the checking
work, the City will refund any amount of the deposit in excess of the actual cost of the consultant
for the work.
Recommendation:

WHEREAS, Resolution No. 2006-149 was adopted on June 5, 2006, providing for

Public Works outside plan checking by City employed consultants. establishing fees charged to

9 applicants for the services, and establishing a method of compensating the City employed
10 consultant: and
11 WHEREAS, the City wishes to amend Resolution No. 2006-149 for establishing
12 deposits and creating accounting methods for checking by City employed consultants of Water
13
Quality Management Plans (WQMP).

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
15 OF SAN BERNARDINO AS FOLLOWS:

SECTION I. Resolution No. 2006-149 is hereby amended to read as follows:

I. Outside contract consultant services may be provided through the Director of
Development Services to perform plan/map check and categorical Water Quality Management
19
20 Plan (WQMP) checking services. Said services shall be made available subject to availability of
21 consultants under contract to the City. Plan and WQMP checks shall be performed in a prompt
22 and timely manner, but the City shall not be responsible for any actual time periods for checking
23 or approval.

When requested in writing by the applicant and upon payment of a surcharge of
25% of the standard plan check fee, or posting a deposit for expedited checking as indicated in
Section 7 in the case of WQMP checking, as established by other resolutions or ordinances of the

requested. then the City will offer a turn around time of no more than two weeks from the date
received by the City. Such requests for expeditious review shall be evaluated on a case by case
basis to determine suitability for expeditious review. If the plans, supporting documents and/or
the WQMP document are determined, by the Deputy Director of Development Services/City
Engineer to be not suitable for expedited review, then the plans or document shall be promptly
returned to applicant with a written explanation as to why the submittal is unacceptable. In such
cases, the full amount of the checking fee plus any surcharge paid by the applicant shall be

refunded to the applicant.

Consultants shall have the authority to request supporting data, calculations,
16 modifications and revisions related to the plans and/or documents sent to them for checking.
17 Upon review of the plans, supporting documents and/or the WQMP document and determination
18 that the plans or WQMP document are adequate, the consultant shall return the plans and/or
19 WQMP document to the City accompanied by a letter recommending approval by the Deputy
20 Director of Development Services/City Engineer or designee. The consultant shall not have
21
authority to waive or modify conditions of approval established by the Mayor and Common
22
Council, Planning Commission. or the EnvironmentallDevelopment Review Committee and
23
24 shall employ the Standard Policies & Procedures and Standard Drawings of the City as review
25 criteria in the checking process.

and ordinances which would be charged if the plans were checked by in-house City staff. A

deposit of one hundred percent of the total City estimate of fees shall be paid prior to services
being provided. An amount of I 00% of the standard deposit as indicated in paragraph 7 below

Fees for Expeditious Review - Expeditious checking fees using outside
12 consultants shall be equal to 125% of the standard plan check fees as established by other City
13
resolutions and ordinances which would be charged as if the plans were checked by in-house
14
City staff. A deposit of one hundred and twenty five percent of the total City estimate of fees for
15
16
plan checking shall be paid prior to plans being accepted for expeditions plan review. A deposit
17 as indicated in paragraph 7 below shall be collected in the case of requests for expedited WQMP
18 checks. If one component of a submittal is requested to be expedited, then all components must
1 9 be expedited.

Additional Fees - If the calculation of City fees is based on information provided

23 information submitted by the applicant is found to be incomplete or erroneous. Prior to City
by the applicant, then the City reserves the right to collect additional fees in the event
24 approval of the final plans or WQMP, all outstanding charges as described herein shall be paid in
25 full.

Deposit for WOMP checking - If a categorical Water Quality Management Plan
(WQMP) is determined to be required, the applicant shall place a deposit in accordance with the
following table plus 20% of the deposit amount to cover City processing costs:

Consultant Compensation for Plan Checking - Outside plan check Consultants
20 shall be compensated on the basis of 65% of the plan checking fee collected as per Sections 4
21 and 5 above, including any additional fees collected as indicated in Section 6 above. Such
22 compensation shall constitute payment in full for Consultant's services, including the cost of all
23
labor, overhead, and direct expenses, such as scanning, printing, delivery, etc. Said Consultants
24

shall be provided, at time oftransminal of each plan check. a detailed calculation of the amount
of fee collected for the plan check. The Consultants may challenge the calculation of the fee
26
27 within 15 days of receipt of the plan check request. If the Deputy Director of
28 Development Services/ City Engineer concurs with the Consultant's calculation, then the fee for

19 associated with checking the WQMP. The Consultant shall notifY the Deputy Director/City

Engineer or his designee if the deposit is expended and work remains to be done. The
21
Consultant shall stop processing immediately, advise the Deputy Director/City Engineer or his
22
23 designee of the additional deposit needed to complete the work and await further instructions
24 from the City. lfthe Consultant exceeds the amount of the original deposit and fails to notifY the
25 City as required above, then the amount of the original deposit will be deemed full compensation
26 for the work and no additional compensation will be allowed.

I O. Submittal Requirements - All plans, documents, supporting studies, calculations, fees
and deposits shall be submitted concurrently for a project. Piecemeal submittals will not be
accepted. If plans for a project are sent to City employed consultant for checking, the WQMP
8
9 shall also be checked and certified by the same City employed consultant.

II.
Relationship between City. Consultant and Aoolicant - All submittals requesting
11 plan and WQMP reviews shall be made to the Deputy Director/City Engineer. Unless expedited
12 plan review is specifically requested in writing, the Deputy Director/City Engineer shall
13
determine whether the submittal will be checked in-house or sent to a City employed consultant
14
for checking. If the submittal is sent to a City employed consultant for checking, the applicant
15
16 will be so advised and provided contact information. During the early stages of checking, the
17 consultant will work directly with the applicant to resolve differences. Prior to approval of the
18 final plans and/or WQMP document, a proposed final set shall be submitted to the Deputy
19 Director/City Engineer or his designee who shall review the proposed final set and respond
20
within one week with comments or notification to the consultant to certify and submit the final
21
plans/documents for approval. The Deputy Director/City Engineer shall be the tinal arbitrator in
22
the case of disputes between the consultant and the applicant.

AMENDMENT NO. I TO AGREEMENT FOR ON-CALL PLAN REVIEW
SERVICES
THIS AMENDMENT NO. I TO AGREEMENT is made and entered into
this day of , 2007 ("Effective Date"), by and between the CITY
OF SAN BERNARDINO, a charter city ("City"), Hall & Foreman, Inc. ("Consultant")
WITNESSETH:
A. WHEREAS, on October 16, 2006, the Mayor and Common Council
adopted Resolution No. 2006-363 approving Professional Services Agreements with Hall
& Foreman, Inc. and AEI-CASC Consulting for On-Call Plan Review Services, and
B. WHEREAS, on July 2, 2007, the Mayor and Common Council adopted
Resolution No. 2007-212 increasing the expenditure authorization by $650,000 in
aggregate. giving a total expenditure authorization of $1 ,000,000 in aggregate, and
C. WHEREAS, the City wishes to amend said Agreement with Consultant to
add the checking of Water Quality Management Plans (WQMP) to the Scope of Services
for said Agreement, and

D. WHEREAS, Consultant is a knowledgeable and competent water quality
consultant and has submitted a proposal for checking WQMP's.
NOW THEREFORE, the parties hereto agree as follows:
Section 1.1 Scope of Services is amended to add the following: Consultant shall
furnish additional on-call review services to City for checking WQMP's in accordance
with Attachment A, attached hereto and incorporated herein. It is agreed that Consultant
shall accomplish all plan reviews and WQMP reviews in accordance with standards of
the City and shall turnaround plan reviews and WQMP reviews in three weeks after
receipt of all checking material for standard reviews and two weeks for expeditious
revIews.
Section 2.3.1 Deposit - The City shall collect a deposit from the applicant at time
of submittal of a WQMP for checking based on the following table plus 20% of the

Section 2.3.2 Comoensation for WOMP Checking - When assigned to check
WQMP's, Consultant shall be compensated for the actual cost of the work based on
approved hourly rates shown in Attachment B, except that Consultant shall be
compensated cost plus 25% for expedited WQMP checks based on the approved standard
hourly rates. When determining actual cost of the work, overtime rates shall not be used
unless specifically authorized by the Deputy Director/City Engineer or designee. Such
compensation shall constitute payment in full for Consultant's services, including the cost

of all labor, overhead, and direct expenses, such as scanning, printing, delivery, etc. Said
Consultant shall be provided, at time of transmittal of each WQMP check, the amount of
the deposit collected for the WQMP check. Consultant may challenge the calculation of
the deposit within 15 days of receipt of the plan check request. Consultant shall be
responsible for tracking costs associated with checking the WQMP. If the cost of
checking exceeds the amount of the deposit, Consultant shall cease checking,
immediately notify the Deputy Director/City Engineer or his designee of the additional
deposit needed to complete the checking and await further instructions from the Deputy
Director/City Engineer or his designee. Within 15 days of completion of checking, the
Consultant shall provide a final accounting of cost for checking the WQMP to the Deputy
Director/City Engineer or his designee. The Deputy Director/City Engineer or his
e designee shall cease payments to Consultant if the final accounting of costs become
delinquent.

Section 2.3.1 Method of Billing: for WOMP Check - Invoices for checking of
WQMP's shall be submitted separately from plan check billings and shall be addressed to
the attention of Jennifer Shepardson, NPDES Coordinator. Ifrequested by the Deputy
DirectorlCity Engineer or his designee, Consultant shall provide copies of time sheets
clearly showing the name, position and pay rate of the employee together with hours
worked each day on the WQMP. broken down into regular time and overtime, when
authorized in accordance with other sections of this Amendment. The time sheets shall be
signed by the individual employees who performed the WQMP checking. The Deputy
DirectorlCity Engineer or his designee may also require documents to support claims for
direct expenses, such as scanning, printing, delivery, mileage, etc.

Description: HA is conducting plan checks for the City of San Bernardino. This includes
review of engineers' submittais inciuding studies, reports, maps, survey ciosures, title
reports, legal documentations, geotechnical reports, traffic studies, EIR's, EIS's, rough
grading and precise grading, utility, water and sewer plans, storm drain plans, hydrology
and hydraulics reports, retaining wall designs, calculations, and public improvement plans.
Each project is reviewed initially for compliance with applicable jurisdictional standards
and requirements such as ADA, Fire Authority, sewer and water purveyor, State or County

Description: HA is responSible for on-call plan review checking services for various
projects throughout the City for the past six years. Plan reviews include single and multi
family home and tract improvements as well as commercial development, which indude
sewer, water, storm drain, street, grading, erosion control, sweeP, SUSMe and map
checking. HFI works closely with City engineers and Developer to incorporate all of the
sensitive community environmental and geotechnical issues, to ensure conformance with
the tentative map and conditions of approval requirements to assist In keeping the projects
on track. Other support has been with developing City policy for plan check and approval
processes in accordance with the NPDES program. Effort has entailed development of
SWPPP and SUSMP submitted guidelines and template for applicants.

On-Call Engineering and Plan Review Services
City ofTustin
Description: HFI has provided on-call engineering and plan review services for the
Public Works/Engineering Division since June of 1996. Services provided to date have
Included project reviews, development of the conditions of approval, and plan checking
services including coordination with the City's various engineering departments on an on-
eall basIs. HFI's plan checking services for the City of Tustin include Right-of-Ways Maps
and Legal Descriptions prepared by others and the preparation of Right-of-Way Maps,
Legal Descriptions, Deeds, and Plats as directed by the City Engineer, Tentative Tract
Maps, Tract Map/Parcel Map reviews, and plan checking services for public and private
development projects. HFI is also responsible for ensuring all proposed public and private
property development designs meet Federal, State, and Local Agency requirements
Including ADA, ~, and City policies. Typical project assignments have included:
residential improvements including grading, erosion control, street, sewer, water, and
storm drains; commercial developments; utility encroachment permit applications, special
bike/horse trail improvements; and public park improvements.
HFI provided plan check review for Tract 1S420 in the "Tustin Ranch" area. Plan check
services include review of tract maps, grading, street, sewer, storm drain, and retaining
wall plans. HFI was also involved in the technical support and review of the transfer of
federal property of the Tustin Marine Corps Air Station (TMCAS) to the City for private
development.
On-Call Map Plan Checking Services
City of Brea
Description: Since 1980, HFI has provided in-house olan checkino for develooment
oroiects within the City's sphere of influence. This includes preparing staffing
recommendations during the plan review/tentative map approval period, review with the
Developer to provide information, research documents, plan and associated City
development issues, intercity department coordination (maintenance, parks, flre,police,
water, sewer, traffic~ planning, etc.), determine fees for plan checking, penmits, drainage,
distribution plans, compile intercity plan check reviews, meeting with Developer and their
Engineer to review plan check requirements, negotiate design issues for confonmance to
City codes and standards, and make recommendations to the City Engineer. The plan
check responsibilities include periodic reviews and conferences with the City Engineer to
ensure that the checking process was in concurrence with the Staff Manager's directives.
HFI provided plan and map check services for a large multi-phase residential subdivision
located in the hills at the west end of Carbon Canyon. Plans that were reviewed included:
rough grading, street, sewer, water, storm drain, and erosion control.
HFI has provided on-call services for many development projects throughout the City. One
notable project has been the site plan checking for the 280 acre, 660 home Olinda Ranch
Master Planned Community. The site was predominately a hillside development with
sioniflcant drainage and flooding concerns. The mass grading included remediation of
contaminated soils due to oil production facilities. Open space park sites and contour
grading were re-conformed to match existing land forms. This project earned recognition
from the American Society of Civil Engineers (ASCE) Orange County 8ranch as "Project of
the Year" for Land Oevelopment.

Plan Check and Constructability Review
Low-Water Crossings Improvement Projects
City of Yucaipa
Description: HFI was requested to provide Plan Check and Constructability Review
Services for the City's Avenue "E" and Bryant Avenue to low-water crossing projects.
HFI's review focused on Impacts to City and private Improvements and the overall
constructability of the proposed improvements. During the review, HFI identilied concerns
regarding existing utilities not identified on the two sets of plans and the limited amount
of remedial grading which was insufficient to support the proposed box culvert and
roadway embankment. Other City projects included plan check and inspection services of
the Yucaipa Boulevard/Wilson Creek Crossings in coordinabon with County staff and Plan
Check/Constructability Review of the Oak Glen Road/Wilson Creek Low-Water Crossing.
Plan Check and Constructability Review
Chapman Heights Development
City of Yucaipa
Description: HFI has provided plan check, constructability review, and construcbon
management/inspection services to the City of Yucaipa for public streets, stonm drains.
and rough grading improvements for the l,OOO-acre, 2,000 home Chapman Heights
Planned Community Development. This project includes a major county flood control
channel improvement, a low water crossing of Wilson Creek (Oak Glen Road), two school
sites, 50-acres of commercial property, and an lS-hole public golf course. Areas of
inspection included a one and a half mile extension to 10th Street, a two-mile extension to
5th Street, two-miles of new road construction for Chapman Heights Road, a three-mile
widening and pavement rehabilitation overlay project to Yucaipa Boulevard, a five-mile
reconstruction of Oak Glen Road, master plan stonm drain facilities, and the Inspecbon of
the 3D-acre first phase construction of the Yucaipa Commercial Center, inspecbon of the
Yucaipa Blvd. multiple cell box culvert structure at Wilson Creek, and coordination with
SBCFCD for permit inspecbons and construcbon approvals. In addition to construcbon
support services, HFI has provided the City of Yucaipa with miscellaneous engineering
support for this project.

San Sevaine Creek Channel, San Bernardino County Flood Control District: Mr.
Bierman served as the Project engineer for the $40 million flood control project. The
project included the preparation of hydrology studies for the Etiwanda and San Sevaine
drainage areas and hydraulic studies for the upstream divided channei, PS&E for the
improvement of the San Sevaine Creek flood control channel between the City of Fontana
and the Riverside County Une.
California Speedway, City of Fontana and San Bernardino County Flood Control
District: Mr. Bierman served as the project manager for the drainage portion of th'is
project, which involved the development of an abandoned steel miil into a NASCAR tradk
and adjacent parking areas. The drainage report included hydrology studies, flood routing
through basins, and storm drain design for the SOO-acre site. The storm drain system
involved over 2 miles of pipe, box culverts, and open channels, and 2 detention basins
which ultimateiy out-jetted into the San Sevaine Channel.
9th Street Reconstruction lit Water Main Replacement, Upland: (Project Manager)
HFI was contracted in November 2004 for this east/west directional transportation corridor
that carries approximately 8,500 vehicles per day and serves as a truck route through the
City of Upiand. HFI is providing professionai civil engineering and design services for the
street and water Infrastructure improvements for 9th Street between San Antonio Avenue
and Euclid Avenue (Route 83). The project includes a water line replacement in 9th Street
from Garnet Way to Euclid Avenue, upgrades to curb returns to meet ADA approved
requirements, and permits and review by Ca/trans for right-of-way. SpeCifically HFI's wor!<
will inciude topographic survey; geotechnical investigation; preparation of street
improvement plans and profiles, water main improvement plans and profiles, signing and
striping plans, traffic controi pians, and special provisions to meet City standards;
preliminary and final engineer's cost estimates, and preparation of as-built plans upon
project COmpletion.

Storm Drain Across Southern California Edison Right of Way . Project No. 3734,
Upland: (Project Manager) PrOject area and location IS at the Southwest corner of 16th
Street and Campus Avenue. Project consIsts of the modificatJon or replacement of an
eXisting stomn water inlet and outlet structures, installation of new pipes (approx. 630 feet
in length), and the backfill compaction of an existing open earth channel in the City of
Upland easement on Southern California Edison property. The City of Upland currently has
an 80' wide easement that will be reduced based on the design of new underground pipe.
HFI will be providing the topographic survey, geographical investigabon/soils report, stomn
drain design, special provisions to meet City standards, engineer's cost estimate, meetings
dunng construction, and record drawings upon project completion.
Water Main Replacement Project, Ontario: (Project Manager) Project area is on
Granada Court and Virginia Avenue in the City of Upland. The project entails the
replacement of approximately 7,400 feet of 4" water main and its appurtenanceS on
Granada Court between Boulder Avenue and Campus Avenue. The project also indudes
the replacement of approximately 600 feet of 4" water main and its appurtenances on
Virginia Avenue between Fourth Street and Princeton Street. Additionally, the project
encompasses the replacement of service laterals and various street improvements
including pavement rehabilitation, ramp modifications, fire hydrant installations, etc. HA is
. preparing the construction plans, specifications, and estimates including bid and
construction support services.
Riverside Drive Sidewalk Project Between Clover Lane and Colony High School,
Ontario: (Project Manager) The City needs to provide protection for High School
students by providing sidewalk improvements along the south side of Riverside Drive from
the Colony High Schooi west to Clover Lane. A recent accident in the City of Fontana in
which a car hit a student as she walked along the edge of the roadway made the need for
a sidewalk very clear. Uncontrolled mid-block pedestrian crossings needed to be
discouraged by providing safe access to a signalized intersection. The land use adjacent to
this roadway is dairy pens and sheds. HFI is currently Investigating Sidewalk alternatives.
All alternatives will take into account the existing stomn drain Inlets near the edge of
pavement, existing poles adjacent to the roadway, driveways that serve adjacent
properties, and areas where bushes intrude into the walkway. HA will also be preparing
an Alternatives Report to take into account all of these constraints and the cost of
construction aSSOCiated with the proposed improvements.
Citrus Avenue Widening, Fontana: (Project Manager) Mr. Biemnan was responSible for
providing engineering services for approximately one mile of street widening. Citrus
Avenue is a showcase project due to its location as an off ramp for the new Route 210
freeway. The project includes improvements for widening the roadway from two to four
lanes, stomn drains, landscaping, lighting, traffic signals and sewers. The scope of work
also included the design of driveways and the preparation of right-of-way acquisition
documents for adjacent residential properties that were impacted by the increase in right-
of-way width. The project included providing sewer laterals to homeowners adjacent to
the project who are presently on septic tank systems.
Crescent Basin Study, Orange County Public Facilities and Resources
Department, Anaheim: Mr. Biemnan was the project engineer for this project, which
consisted of analyzing the use of the existing Crescent Basin as a flood control retarding
baSin. The hydraulic analYSis was done using newly developed Basin Analysis Software for
the deSign ot the Side-weir diversion.

Widening and Realignment of Ganesha Boulevard, Pomona: (Project Manager)
Project included alignment studies, together with cost analysis, right-of-way engineering

Fairgrounds, Caitrans, City of La Verne and the County of Los Angeles. This project was
for the primary entrance into the Los Angeles Fairplex.
Rose Drive and Orangethorpe Avenue, Placentia: (QA/QC) Design of the intersec-
tion widening improvements involved the acquisition of right-of-way from the AT&sF
Railroad Company, for the relocation of Edison transmission poles, pavement rehabilita-
tion, and drainage improvements to reduce flooding.
Placentia Avenue and Melrose Avenue, Placentia: (Project Manager) For this ISTEA
proJect, prepared final plans, specifications, estimate, contract pians and bid documents
for the street rehabilitation in under three months. Prepared detour construction plans,
notification of high-risk utilities and acquisition of the required construction encroachment
permits from Caltrans, County of Orange, City of Anaheim and AT&SF Railroad. As heavily
traveled commercial area, the project plans and specifications required phasing the work
to maintain business access to the street at all times.
Brea Boulevard, Brea: (Project Manager) Prepared the widening of a 3-mile street
segment, including right-of-way engineering, significant private property modifications,
major utility relocation, Edison under-grounding of transmission and distribution lines,
railroad crossing improvements and improved track crossmg material, eight new signal-
ized intersections, landscape and hardscape including colored concrete Intersection
improvements. To meet the Caltrans design standards, the street storm drain system was
expanded. Caltrans was involved in the approval process for the intersection improve-
ments at Imperial Highway, State Route 90. (Construction Manager) responSible for the
major task of implementing the construction staging to maintain adequate traffic flow,
maintain access to the local businesses, and maintain utility services during construction.
All projects were successful in meeting design and construction deadlines and costs were

geotechnical reports, traffic studies, EIR's, EIS's, rough grading and precise grading, utility,
water and sewer plans, storm drain plans, hydrology and hydraulics reports, retaining wall

Authority, sewer and water purveyor, State or County roadways, Corps of Engineers,

Riverside Drive Sidewalk Project Between Clover Lane and Colony High School,
City of Ontario: (Staff Engineer) HFI is currently investigating sidewalk alternatives. All
alternatives will take into account the existing storm drain inlets near the edge of pave-
ment, existing poles adjacent to the roadway, driveways that serve adjacent properties,
and areas where bushes intrude into the walkway. HFI will also be preparing an Alterna-
tives Report to take into account all of these constraints and the cost of construction
associated with the proposed improvements.
9th Street Reconstruction It Water Main Replacement, City of Upland: (Staff
Engineer) HFI is providing professional civil engineering and design services for the street
and water infrastructure improvements for 9th Street between San Antonio Avenue and
Euclid Avenue (Route 83). The project includes a water line replacement in 9th Street
from Garnet Way to Euclid Avenue, upgrades to curb returns to meet ADA approved
requirements, and permits and review by Caltrans for right-of-way.

Street Slope Failure, La Canada! Flintridge: (Staff Engineer) Project areas include a
slope failure on Inverness Drive that took out an important roadside and a crib wall failure
on Foothill Blvd. From the beginning there were challenges to these projects that required
creative and innovative technology. Inverness Drive is a residential street that connects
hillside residents with the City. The intense rain caused two sections of the road to fall
away. The sections included one 90' section and one 40' section, which left the road
impassable by any vehicles. The road is located on a steep slope surrounded by hills and
valley that made it extremely difficult to access the areas of failure for investigation and
surveying. Another challenge to both City projects has been the involvement of the com-
munity. Severai residents have portions of their land that are affected by the storm
damage. This project is ongoing has proven to be both a challenge and a reward to HFI's
team.

It would be beneficial to the WQMP review if the City would provide assistance with
relaYing City policy and preferences for: determining treatment control BMPs (mechanICal
vs, natural); ground water considerations; municipal code; maintenance agreement;
process for establishing HOA/POA, etc.
In addition, HFI understands that it may be necessary to coordinate with the San
Bernardino County Flood Control District (SBCFCD) to review the hydrology and hydraulic
calculations for flows in tributary facilities. Timely review from SBCFCD for these
calculations and an acceptable design may be an item that HFI needs assistance from the
City for, as well as project team members to meet anticipated Project Schedule
deadlines.

AMENDMENT NO. I TO AGREEMENT FOR ON-CALL PLAN REVIEW
SERVICES
THIS AMENDMENT NO. I TO AGREEMENT is made and entered into
this day of , 2007 ("Effective Date"), by and between the CITY
OF SAN BERNARDINO, a charter city ("City"), and AEI-CASC Engineering, Inc. d.b.a.
AEI-CASC Consulting ("Consultant")
WITNESSETH:
A. WHEREAS, on October 16, 2006, the Mayor and Common Council
adopted Resolution No. 2006-363 approving Professional Services Agreements with Hall
& Foreman, Inc. and AEI-CASC Consulting for On-Call Plan Review Services, and
B. WHEREAS, on July 2, 2007, the Mayor and Common Council adopted
Resolution No. 2007-212 increasing the expenditure authorization by $650,000 in
aggregate, giving a total expenditure authorization of $ I ,000,000 in aggregate, and
C. WHEREAS, the City wishes to amend said Agreement with Consultant to
add the checking of Water Quality Management Plans (WQMP) to the Scope of Services
for said Agreement, and

D. WHEREAS, Consultant is a knowledgeable and competent water quality
consultant and has submitted a proposal for checking WQMP's.
NOW THEREFORE, the parties hereto agree as follows:
Section 1.1 Scooe of Services is amended to read as follows: Consultant shall
furnish additional on-call review services to City for checking WQMP's in accordance
with Attachment A, attached to this Amendment and incorporated herein. It is agreed
that Consultant shall accomplish all plan reviews and WQMP reviews in accordance with
standards of the City and shall turnaround plan reviews and WQMP reviews in three
weeks after receipt of all checking material for standard reviews and two weeks for
expeditious reviews.
Section 2.1. Comoensation is hereby amended to read as follows: Over the term

of this Agreement, Consultant shall be paid for the actual cost of checking WQMP

Section 2.3.1 Deoosit - The City shall collect a deposit from the applicant at time
of submittal of a WQMP for checking based on the following table plus 20% of the
deposit amount to cover City processing costs:

Section 2.3.2 Comoensation for WOMP Checking - When assigned to check
WQMP's, Consultant shall be compensated for the actual cost of the work based on
approved hourly rates shown in said Attachment B, except that Consultant shall be

compensated cost plus 25% for expedited plan checks based on the approved standard
e hourly rates. When determining actual cost of the work, overtime rates shall not be used
unless specifically authorized by the Deputy Director/City Engineer or designee. Such
compensation shall constitute payment in full for Consultant's services, including the cost
of all labor, overhead, and direct expenses, such as scanning, printing, delivery, etc. Said
Consultant shall be provided, at time of transmittal of each WQMP check, the amount of
the deposit collected for the WQMP check. Consultant may challenge the calculation of
the deposit within 15 days of receipt of the plan check request. Consultant shall be
responsible for tracking costs associated with checking the WQMP. If the cost of
checking exceeds the amount of the deposit, Consultant shall cease checking,
immediately notify the Deputy Director/City Engineer or his designee of the additional
deposit needed to complete the checking and await further instructions from the Deputy

Consultant shall provide a final accounting of cost for checking the WQMP to the Deputy

designee shall cease payments to the Consultant if the final accounting of costs become

Section 2.3.3 Method of Billing for WOMP Check - Invoices for checking of
WQMP's shall be submitted separately from plan check billings and shall be addressed to
the attention of Jennifer Shepardson, NPDES Coordinator. Ifrequested by the Deputy
Director/City Engineer or his designee, Consultant shall provide copies of time sheets
clearly showing the name, position and pay rate of the employee together with hours
worked each day on the WQMP, broken down into regular time and overtime. The time
sheets shall be signed by the individual employees who performed the WQMP checking.

The Deputy DirectorlCity Engineer or his designee may also require documents to
support claims for direct expenses, such as scanning, printing, delivery, mileage, etc.
All other terms and conditions of said Agreement for Professional Services
approved by Resolution No. 2006-363 shall remain unchanged.

To facilitate the review process, AECASC has developed three categories of review: bas,ic reviews,.
standard reviews, and complex reviews. These categories assist the City in setting deposit amounts
to be collected from project Appiicants.
Basic reviews are reserved for simple projects such as rMlllltegory projects (less than 10 homes,
small restaurants, and small commercial/Industrial facilities). Basic reviews consist of a preliminary
review of the WQMPs with comments to the applicant, and a final review and approval of the revised
WQMP.

Standard reviews apply to smaller category projects (subdivisions of under 50 homes, hillside
subdivisions, large parking lots, and many commercial/Industrial facilities). Standard reviews consist
of a preliminary review of the WQMP with comments to the applicant, a review of the hydrology
report, a review of landscape plans, and a final review and approval of the revised WQMP. Because
these projects are more complex than basic neoategory projects, standard reviews Include time to
meet and confer with the Applicant and the Applicant's Engineer to discuss options and requirements
for meeting WQMP requirements.
Complex reviews apply to large category projects (subdivisions of 51 or more homes, large
commercial/industrial facilities, and facilities near sensitive receiving waters). Complex reviews
consist of a preliminary and interim review of the WQMP with comments to the applicant, a
preliminary and final review of the hydrOlogy report, a preliminary and final review of landscape

The plan check process consists of identifying if the project is accurately categorized based on the
size and proposed use of the site and subsequent reviews of the WQMP and associated data, reports,
and supporting information, The pian check is conducted to identify that the WQMP meets City's
standards and complies with requirements of the WQMP Guidance Document. Comments are
provide to the Preparer in the form of "redlines," Plan check reviews are conducted on a time and
expense basis, The time invested in a particular plan check is typically based on the Appllcant/
Preparer's ability to thoroughly and adequately address the WQMP requirements in the plan(s)
submitted for review,
Plan checking typically includes time to meet with the Applicant, Preparer, ___..

CASC is responsible for reviewing and recommending approval of WQMPs submitted to the City of
Highland in accordance with requirements adopted by the City in response to provisions in the area-
wide municipal NPDES storm water permit.
To facilitate the review. process, AEI-CASC has developed three categories of review: basic, standard,
and complex.
Basic reviews are reserved for simple projects such as non-category projects (less than 10 homes,
small restaurants, and small commercial/industrial facilities). Basic reviews consist of a preliminary
review of the WQMPs with comments to the applicant, and a final review and approval of the revised
WQMP. In most cases, the WQMPs for basic review are approved the two step process without a need
to meet with the owner or to confer with the owner's engineer.
Standard reviews apply to smaller category projects (subdivisions of under 50 homes, hillside
subdivisions, large parking lots, and many commercial/industrial facilities). Standard reviews consist
of a preliminary review of the WQMP with comments to the applicant, a review of the hydrology report,
a review of landscape plans, and a final review and approval of the revised WQMP. Because these
projects are more complex than basic non-category projects, standard reviews include time to meet
and confer with the applicant and the applicant's
engineer to discuss options and requirements for
meeting WQMP requirements.
Complex reviews apply to large category projects
(subdivisions of 51 or more homes, large
commercial/industrial facilities, and facilities near
sensitive receiving waters). Complex reviews
consist of a preliminary and interim review of the
WQMP with comments to the applicant, a
preliminary and final review of the hydrology report,
a preliminary and final review of landscape plans,
and a final review and approval of the revised
WQMP. Complex reviews include time to meet and
confer with the applicant and applicant's engineer to
discuss options for water quality control that fit into
the project, meet City standards, and comply with
WQMP requirements.

F-WQMPs are recommended for approval by the City based on full conformance and compliance with

relevant detail that outlines the water quality treatment plan for the project, to include but not limited
to: final BMP design details, operation and maintenance detail, funding information and conditions of

AEI-CASC conducts plan checks in consideration of the time required and
consultation services necessary to facilitate progress of new development and redevelopment
projects in a manner that will address water quality standards.
Plan checking typically consists of a preliminary, interim, and final review of the WQMP. Comments
are submitted to the Applicant/Preparer in the form of "redlines". The preliminary review comments
are provided as an evaluation the WQMP's ability to comply with and conform to the requirements of
the Guidance Document and the City's standards. The preliminary review is utilized to point out any
inaccurate references and data, as well as the need for additional supportive information that is
specific to the type of development and proposed use of the site. In some cases, only a preliminary
review will be conducted, at the City's request, at which time the City will elect to take over the plan
check process In order to work directly with the Applicant/Preparer to address particular issues.
When requested by the City, AEI-CASC will complete the full plan check process. The interim review
will evaluate if the Applicant/Preparer has address the "red lines' from the previous plan check. The
interim review will involve a review of the plan to identify any discrepancies or inconsistencies, a
review of the hydrology report if it's inclusion is required based on the category the project, a review
of landscape plans, and a review of any supportive information, data, or reports that have been
added to the Applicant's submittal.
The final will evaluate if the Applicant/Preparer has addressed all of the "red lines" from the previous
plan check. This review will be comprehensive, addressing the WQMP's conformance with all
previous plan check comments. When the Applicant/Preparer provides such a plan, AEI-cASC
provides the City with an Approval Recommendation.
AEI-CASC coordinates conference meetings with the City representative and/or the Applicant/
Preparer and/or Applicant's Engineer on an as-needed basis, in order to facilitate the progress of the
WQMP preparation. AEI-CASC corresponds with the City on a regular basis to ensure that the plan

pesticides in water and soil. In 2003, Ms. Guill worked as Environmental Intern/ Public
Service employee for the County of San Bernardino Environmental Learning Center. In
2004 - 2006, Ms. Guill was employed as an Environmental Regulatory Compliance

or eliminate potential pollutant discharges In stormwater run-off. The development of the SWPPP includes an Initial
site evaluation to identify the activities conducted onslte, the significant material inventory stored and handled
onslte, responsible person/s for the storm water management program, and applicable site speCific BMPs. This
information is used to correlate and assess the effectiveness of the BMPs and associated measures to be
implemented at the site which are to be described in the SWPPP. These plans have been prepared for various types
of projects, including stockpiling operations, residential, commercial, and industrial developments In San
Bernardino County and Riverside County, as well as industrial/commercial sites located In San Bernardino, San
Diego, Santa Clara, Orange, and Los Angeles Counties.
STORM WATER QUALITY REPORT PREPARATION
During employment as an Environmental Regulatory Compliance Consultant, Ms. Guill was responsible for the
preparation of annual Storm Water Quality Reports (SWQRs) as a requirement of the General Industrial Permit.

Ms. Sotelo has more than 17 years of professional experience and has participated
in both transportation and public works projects as a civil designer. She has
performed design engineering on a wide variety of infrastructure projects including
water and sewer, street improvements, grading, right-of-way engineering and
pumping stations. Her experience includes; design, computer-aided design, survey file transfer for base map
preparation, drafting, preparation of regulatory reports, WQMP and SWPPP preparation experience and utilization
of MUTCD standards. Ms. Sotelo's efforts have focused on providing comprehensive plan development, plan
checking, consultation services, document preparation and training related to water quality and NPDES

RELEVANT EXPERIENCE
Water Quality Management Plan Reviews for the City of Redlands and the City of Highland: AEI-CASC is
currently under contract with the City of Redlands and the City of Highland to provide Plan Check Review services
for the Land Development Division of the Public Work Department. These services include Plan Checking of land
development plans, including Precise Grading plans, Erosion Control plans, Street Improvements, Storm Drain
Plans, Hydrology and Hydraulic Reports. The reviews are conducted by Ms. Sotelo and assure that plans are

the 31-mile interceptor system of the Victor Valley Wastewater Reclamation Authority in the Victor Valley area of
San Bernardino County.
Water System Network Modeling: Ms. Sotelo includes water system network modeling to the Cybernet, H20
Net and Kentucky software programs and model preparation and computer program execution for operational
simulations of various systems to her repertoire. She has performed extended period simulations for offpeak
pumping analyses. Water systems for which Ms. Sotelo assisted include those for the City of Loma Linda, Alpine
Water Users Association, Devore Water Company, Hi-Desert Water District, and Western Heights Water Company.

Grading Plan Preparation and Design: Ms. Sotelo has completed grading plan preparation and design for
access roads, parking lots and structure foundations for residential, commercial, institutional and pUblic service
projects. Examples include the ESRI campus expansion in Redlands, SBVMWD and Wal-Mart expansion in San
Bernardino, and water storage reservoir projects for Colton and San Bernardino County. Riverside-Highland Water
Company; storm drain projects In addition Ms. Sotelo has served as the designer for a 24-inch, 12,OOO-foot
pipeline replacement project for the Riverside-Highland Water Company; storm drain projects for the Cities of
Highland and San Bernardino; a traffic signal plan for the Greenspot /Church intersection in Highland; and design

Mr. Richard Sidor is one of the four Principals at AEI-CASC. Mr. Sidor is a registered
Civil Engineer and a Certified Professional in Erosion and Sediment Control (CPESC)
with extensive experience in Storm Water Pollution Control systems and regulatory
compliance. Over the past fifteen years, Mr. Sidor has played a key role in both field
and office applications for water pollution control p.rograms throughout the State of
California. Mr. Sidor oversees the company's Water Quality division consisting of
four offices and over 20 engineers, scientists and technical support staff members.
Mr. Sidor is a hands-on principal who has been noted for analyzing regulatory re-
quirements and preparing practical solutions that can be readily implemented while
achieving the permit goals.
RELEVANT EXPERIENCE
Storm Water Field Experience: Mr. Sidor has conducted numerous storm water
field inspections of Public Work's and private developments throughout California.
Currently, his inspection duties take place in critical situations involving legal issues,
regulatory enforcement or critical designs involving environmental challenges. Mr.
Sidor's practical, hands-on experience in storm water initiated from his work
preparing Storm Water Pollution Prevention Plans (SWPPPs) for private development
and highway construction projects since 1992. The preparation of these documents
necessitates a thorough understanding of the requirements of the State Water
Resources Control Board as well as a practical understanding of field related Issues.
Mr. Sidor and his staff have prepared Water Pollution Control Plans (WPCPs) for
nearly 600 projects; more than any other company in California.

Municipal permit review and cost analysis: Mr. Sidor was the Principal in
Charge of the preparation for the In-depth review of the Riverside County MS4
Permit for the City of Moreno Valley (Permit No.CAS 6180333, under No. R8-2002-
0011). This project included a detailed review of the permit, development of a
comprehensive task list covering over 140 items, development of Job descriptions
and personnel requirements, preparation of an Implementation
schedule and an estimate of program implementation costs.
NPDES Training: Mr. Sidor has conducted storm water training classes throughout the State to contractors, build-
ers, local agencies, and professional organizations. Mr. Sidor has developed and presented PowerPolnt training
sessions covering construction requirements, Industrial Permit requirements and Municipal permit requirements.
Recently he completed training for the Counties of Riverside and San Bernardino Co-permittees covering the
WQMP requirements for new development and
redevelopment.
Additional Storm Water Reports and Documents: Mr. Sidor was one of the principal authors in the preparation
for two of Caltrans' Storm Water Quality Handbooks, "The Construction Contractors Guide & Specifications" and the
"Construction Staff Guide". He has prOVided oversight on many of Caltrans' Guidance Manuals and other stonn
water publications. Mr. Sidor wrote and/or edited many of Caltrans' revised Standard Special Provisions, fact
sheets and other material relating to storm water pollution controls. This work included an In-depth analysis of
permit requirements and the assemblage of regulatory requirements Into user-friendly gUidance documents. Mr.
Sidor has provided consultation services and prepared the SWPPPs for private development and hlqhway
construction projects since 1992. The preparation of these documents necessitates a thorough understanding of
the requirements of the State Water Resources Control Board requirements as well as a practical understanding of
field related issues
Through his active involvement in the California Storm Water Quality Association, Mr. Sidor has developed strong
working relationships with regulatory agencies including various Regional Water Quality Control Boards, the EPA
and the State Water Resource Control Board.

Mr. Endicott has over 25 yea~ of engineering experience, 17 yea~ as a consultant
focusing on water resources and the development of stormwater quality man-
agement programs for the private and public secto~. Prior to his consulting profes-
sion, he worked with the USDA Soil Conservation Service and the City of Redlands.
Drawing upon his government and consulting experiences, he has succeeded to pro-
duce practicable solutions to complex environmental problems.
Mr. Endicott is currently serving as a Director and the Secretary for the California
Storm water Quality Association. He is a Board Certified Environmental Engineer by
the American Academy of Environmental Enginee~ and is a Registered Professional
Civil Engineer in California and Nevada. He is a member of the American Public
Works Association, the Coalition for Adequate School Housing, and the California
stormwater Quality Association.
Mr. Endicott has long served in key roles on NPDEs-related stormwater management
projects: from Phase I, Part I applications in the early 1990's to Phase II, storm-
water management programs today. His continuous involvement in the NPDEs
stormwater program since its beginnings in California has provided him with a com-
prehensive knowledge, unde~tanding, and pe~pectlve that he applies when develop-
ing practical solutions for public and private entities.
Mr. Endicott served as the project manager for development of the California
Stormwater Quality Association's, 'California stormwater Quality Best Management
Practice Handbooks.' In addition to managing the development of the four-volume
set of handbooks, he was a key author of the New Development - Redevelopment
Handbook and the key technical advisor on the Construction Handbook. He served as
a technical advisor for the Bay Area stormwater Management Agencies Asso-
ciation's book, 'Start at the Source,' and was the technical director for the compan-
ion document, 'Using Start at the Source to Comply with New Development Require-
ments. for stormwater Quality Protection.'
Mr. Endicott is widely recognized as an expert on water quality management plan-
ning for new development and redevelopment, and has taught cou~es on the subject
attended by over 600 municipal staff, consultants, and other interested parties. He
has been an invited guest speaker for seminars sponsored by the Association of
Environmental Planne~, American Society of Civil Enginee~, Building Industry Asso-
ciation, Regional Water Quality Control Boards, and Lorman . Educational Ser-
vices.
Mr. Endicott has assisted a number of confidential clients by serving in an expert witness capacity on issues related
to stormwater quality control. His role has included a range of services from site reviews, to document reviews, to
ACL response, to hearing preparations.
REPRESENTATIVE PROJECTS
City of Redlands - Redlands, CA - WQMP Training and Review Services: Mr. Endicott Is assisting the City of
Redlands with review and approval of Water Quality Management Plans for new development and redevelopment
projects. WQMP reviews have been divided into three categories, with each category reflecting the complexity of
the projects and the time required to conduct appropriate levels of review. For complex projects, Mr. Endicott
works directly with the applicant and/or applicant's engineer to discuss and work through a project's WQMP. Each
WQMP review includes typewritten comments and plan red lines which gUide applicants towards future submittals
that will be acceptable to the City. Services being coordinated by Mr. Endicott include WQMP pickup, WQMP
reviews (including the WQMP, hydrology studies, and plans), comments to applicants, discussions with applicants,
and recommendations for approval of acceptable WQMPs. Mr. Endicott also proVided a four-hour training session
for City staff. The training session provided an overview of the WQMP and the integration of site design, source
control, and treatment control BMPs into projects.
City of Montclair - Montclair, CA - WQMP Reviews: Mr. Endicott is leading a team of professionals providing
WQMP Plan Check Services for the City of Montclair. Each WQMP submitted for review Is thoroughly reviewed and
red lined for compliance with local requirements. When needed, Mr. Endicott meets with applicants to explain the
WQMP requirements and approaches to acceptable water quality control.

City of Highland - Highland, CA - WQMP Training and Reviews: Mr. Endicott assisted the City of Highland
to launch the City's WQMP submittal and review program. Mr. Endicott met with City staff and reviewed the new
requirements for WQMP preparation, submittal, and review. During this roundtable training session, Mr. Endicott
explained each requirement and gave examples of BMPs that can be incorporated into projects to address
potential pollutants. Mr. Endicott emphasized the benefits of BMP integration throughout the development site,
but also addressed techniques for incorporating BMPs into traditionally planned projects. Three projects requiring
a WQMP were then examined. Each project was examined in two ways: first, opportunities to Incorporate BMPs
into the project given the existing planned project layout were explored; and second, opportunities and benefits
of integrating BMPs and low impact development techniques throughout the site were explored. Mr. Endicott is
now conducting review of WQMPs for the City. Each WQMP review includes written comments and markups, and
coordination with the applicants. Mr. Endicott recommends City approval of acceptable WQMPs.
City of Moreno Valley, Moreno Valley, CA - WQMP Reviews: Mr. Endicott is leading a team of profeSSionals
providing WQMP Plan Check Services for the City of Moreno Valley. Each WQMP submitted for review is
thoroughly checked and redlined for compliance with local requirements. The review process includes submittal
and review of both Preliminary WQMPs during the early planning stage of a project and submittal of a detailed
Final WQMP prior to issuance of grading permits. When needed, Mr. Endicott meets with applicants to explain the
WQMP requirements and approaches to acceptable water quality control. Mr. Endicott also serves as a WQMP
process and BMP technology advisor to the City.
City of Temecula, Temecula, CA - WQMP Reviews: Mr. Endicott is leading a team of professionals providing
WQMP Plan Check Services for the City of Temecula. Each WQMP submitted for review is thoroughly checked and

Kenya Streeter, Environmental Analyst
PROFESSIONAL HISTORY
Ms. Streeter has been actively involved in issues relevant to water quality for the past
two (2) years. Ms. Streeter's efforts have focused on providing comprehensive plan
checking, consultation services, document preparation and training related to water
quality and NPDES compliance.
Ms. Streeter has over 10 years experience in project management and organizational
training. While actively serving in the United States Air Force, Ms. Streeter was the
Base liaison and training coordinator for Norton Air Force Base's Total Quality
Management (TQM) training program. This program was planned, developed and
implemented under Ms. Streeter's leadership. The intent of the program was to train all
military and civilian personnel on quality initiatives adopted by the government. Ms.
Streeter and her team trained over 12,000 soldiers and civilian support staff over the
course of 2 years.
EDUCATION
Ms. Streeter obtained a Bachelor's of Science degree in Organizational leadership and
Management and a Master's degree in Business Administration specializing in
Management from the University of Phoenix. As a part of both educational programs,
she was required to develop and maintain mentoring relationships with various
organizations that specialized in organizational or global management. During this time
Ms. Streeter was an active member of Toastmasters International, and the Project
Management Institute (PMI).
Water Quality Management Plan Reviews: As a member of AEI -CASC's Water Quality Management Team, Ms.
Streeter has reviewed site specific WQMPs proposed for new development and redevelopment of category and
non-category projects for the cities governed by the Riverside County and San Bernardino County Guidance
Documents. She is responSible for consulting with clients, plan check services, the assessment of project and
programs, WQMP review, redlining plans, developing written comments, preparing conditions of approval, assisting
the City in developing templates for the preparation of acceptable WQMP, and providing general services as
deemed necessary by the authorizing City.
City of Moreno Valley - Ms. Streeter has plan checked hundreds of project-specific WQMPs submitted to the City
of Moreno Valiey in the past year. These projects comprise various types of residential, commercial, and industrial
type developments. Ms. Streeter has worked closely with the City to con.stnuct comprehensive tools for WQMP
preparers, such as receiving water tables, requirement checklists, and HCOC Condition suggestive substantiation
guidelines.
City of Temecula It Perrls - Ms. Streeter has conducted numerous WQMP plan check services for the City's
Public Works department. Ms. Streeter has worked closely with the City's NPDES Coordinator to ensure
appropriate compliance with water quality regulation on new and redevelopment proposed in the City. Projects
include large multi -phased residential and commercial developments.
San Bernardino County - Ms. Streeter has reviewed site speCific WQMPs proposed for new development and
redevelopment projects for the City of Redlands and the City of Highland. She is responsible for consulting with

Ms. Santiago currently works for AEI-CASC Consulting Water Quality Team where she
performs a variety of duties including WQMP (Water Quality Management Plans) plan
check services, program management and preparation for several cities, NPDES

Santiago currently manages NPDES Industrial/Commercial inspections for the Cities of Temecula, Ontario, and
Colton. Ms. Santiago ensures that Industrial and commercial facilities located in those cities comply with the
Cities MS4 Storm Water Permits. Each inspection includes meeting with the facility's representative, visual
observation of operations and activities of concem, completing a facility Inspection checklist, providing educational
materials, answering questions about storm water program requirements, and scheduling follow-up inspections
when needed. Ms. Santiago's experience also includes managing a team of inspectors that worked directly under
her guidance and training in these cities.
County of Riverside Industrial/Commerdal NPDES Inspections and Related Services: Ms. Santiago
currently manages NPDES Industrial/Commercial inspections and related services, including training, for the
County of Riverside. Ms. Santiago is assisting the County to implement a new program that will reqUire the
inspection of over 8000 industrial and commercial businesses In the County of Riverside. Ms. Santiago is currently
involved in the launch of this new project, as well as staffing and training.
NPDES Training: Ms. Santiago is responsible for providing on going NPDES Industrial/Commercial and NPDES
Construction training classes for Riverside County. In addition to providing on-going training for Riverside County,
Ms. Santiago has assisted the county of San Bernardino in the training of Industrial/Commercial NPDES
requirements and provided various consultant services to the County for NPDES requirements and training.

PROJECT APPROACH
prqject Approach
The Consultant will review WQMPs submitted to the City. The purpose of the review is to determine
each WQMP's general conformance with the document, "San Bernardino County Storm water Program _
Model Water Quality Management Plan Guidance" (SBCFCD, June 9, 2005) (Guidance Document), with
development practices acceptable to the City (City's General Plan and Development Code), and with
the generally accepted standards and practices for urban runoff quality management in California
(Industry Practices).
WQMP plan checking may require review of supporting documentation including but not limited to
environmental documents, conditions of approval, grading plans, project plans, hydrology reports,
drainage reports, soil reports, and other documentation submitted by the Applicant. The Consultant will
use such supporting documentation to conduct comprehensive reviews.
Consultant comments on WQMPs will be conveyed to the WQMP preparer in the form of "redlines" on
documents and plans, and when required, via written narratives. A transmittal outlining general
project detail (project name, City review number, number of reviews, review status, etc.) will be
provided with each WQMP redline plan check. In addition, on each transmittal, the consultant will note
the current and accumulated hours used to complete the related review. Time will be noted to the
nearest half-hour.
Once it is concluded that a WQMP conforms to the Guidance Document, the City's General Plan and
Development Code, and Industry Practices, the Consultant will transmit a written WQMP Approval
Recommendation to the City. The WQMP Approval Recommendations may include conditions related to
the approval, and/or signature of the Approved WQMP cover page.
The Consultant will complete and return WQMP plan check comments directly to the City based on the
following schedule:
. First review of WQMPs will be complete and comprehensive, and will be returned to the City within
2 weeks following receipt of the WQMP and supporting documentation.
. Second and subsequent reviews will not introduce new correction comments or redlines, that could
have otherwise been noted on in a previous review. Second and subsequent reviews will be
returned to the City within 1 week fOllowing receipt of the updated WQMP and supporting
documentation (redlined documents and site plans).
. Upon determining that a WQMP shall be recommended for approval, the Approval
Recommendations and supporting documents will be forwarded to the City within three working
days.
Applicants will be instructed to return redline comments with subsequent resubmittals of the WQMP.
This is a relatively standard practice in plan reviews, and limits the need to make copies of lengthy
documents. Upon completion of the review of each project, the Consultant will meet with the City
NPDES Coordinator to discuss project status. All status meetings are intended to be conducted via
teleconference, and email.
The Consultant will maintain a log showing the status of WQMPs submitted for review. The log will
show the date the WQMP was received, the date redline comments were returned, the City's project
tracking number, and the status of the WQMP (e.g., approved, revise/resubmit). The WQMP log will be
transmitted to the City monthly or when requested.
All WQMP redlines, approval recommendations, and supporting documents will be transmitted via a
two-rlay confirmed delivery service (e.g., Fed Ex, UPS, Express Mail, etc.), or hand delivered to the
City. AEI-CASC implements this process to crate a record of transmittal that can be traced.

The Consultant will meet and confer with the City's NPDES Coordinator, and other City departments
(i.e.: Development/Environmental Review Committee, Planning Commission, and/or Mayor and
Common Council meetings) to discuss WQMPs on an as-needed basis (e.g., when a WQMP proposes
BMPs in the public right-of-way). The Consultant will meet and confer with project Applicant/Preparer
and/or Applicant's Engineer as determined by the City's NPDES Coordinator and when approved by the
City. The purpose of meeting and conferring with the Applicant/Preparer and/or Applicant's Engineer
will be to provide general guidance on WQMP preparation or to clarify WQMP redline comments.
Meetings may be conducted in person or via teleconference: in-person meetings will take place at the
City, at the AEI-CASC office in Colton, or at another mutually agreeable location approved by the City.
The WQMP plan check schedule maybe modified on a project specific bases upon the mutual agreement
of the Consultant and the City.

WQMP is received and logged.
WQMPs received for the first review are forwarded to the team Project Manager for assignment to a
team WQMP reviewer.
WQMPs received for second and subsequent reviews are forwarded to the assigned team WQMP
reviewer. AEI-CASC Consulting strives to maintain the same reviewer for each submittal of 'a
specific WQMP.
WQMP reviewer conducts a review of the WQMP and supporting documents; and prepares
preliminary redlines.
Engineering Review. On projects with engineering elements, the WQMP Reviewer will meet with
one of the licensed civil engineers or engineering technicians on the project team to review the
engineering elements of the WQMP. As needed, redllne comments on the engineering elements will
be prepared. The level of engineering review will depend on the complexity of the WQMP.
6. Quality Control Review. A quality control review is conducted. The quality control review consists
of a meeting between the WQMP Reviewer and the Project Manager or Project Director to go over
redline comments. The purpose of this review is to maintain consistency across all reviews
conducted by the firm for the City.
Service Statement
AEI -CASC has developed a broad based expertise in the NPDES regulatory requirements and provides
consulting services to a multitude of clientele including developers/builders, industrial facility owners/
operators, contractors, and public agencies.
AEI -CASC is committed to providing all of our clients with practical and cost-effective consulting
services to assist them in achieving compliance with water quality regulations. AEI -CASC does not
accept assignments, and will terminate our services, where the client's objective is to evade regulatory
compliance or to obfuscate non-compliance.
At times AEI-CASC may be in the position of providing consulting services to multiple entities within a
jurisdiction (such as document preparation for a contractor or industrial facility owner and inspection
services for the local agency). In such instances, AEI-CASC will:

The Consultant will conduct WQMP and related document reviews on a time and expense basis in
accordance with the firm's standard rate schedule. WQMP reviews typically involve one or more of the
following staff: Environmental Analyst IIII; Environmental Engineer; Clerical; and Engineering Director.
AEI-CASC rates are updated annually in January.
In the event of disputed charges, the Consultant will make available to the City of San Bernardino, a
breakdown of the costs incurred for the particular WQMP plan check processing, including the time
invested by the appropriate employee/s.
The time required for a WQMP review is variable, and depends on factor such as complexity of the
project, willingness of the Applicant to incorporate BMPs into the project, Applicant/Preparer and/or
Applicant's Engineer's knowledge of water quality control practices and local requirements, and
conditions such as Hydrologic Conditions of Concern (HCOCs). The Consultant's experience bas been
that reviews require 5 to 12 hours per review, and that two to four reviews are required to result in a
document ready for the approval recommendation.

The following expenses will be billed at cost plus 15%:
Reoroductioo Services: Includes blueprinting, copying, printing and plotting. In-house plots will be billed at $6.00
per sheet for each client set and for a final in-house review set. The client is welcome to contract directly with an
outside reprographic firm for those services not provided in -house.

SUGGESTIONS
AEI-CASC Consulting has conducted hundreds of WQMP reviews. Through this work, the firm has
observed opportunities to improve the WQMP preparation and submittal process. The following items
are offered as suggestions for consideration by the City of San Bernardino.
WOMP Checklist
AEI -CASC Consulting suggests that a "checklist" be developed to guide the preparation of WQMPs
for submittal to the City of San Bernardino. This will be especially helpful given that the City has
implemented requirements for "Preliminary WQMP" submittals prior to projects going before the
Planning Commission and Environmental/Design Review Committee. Currently, the WQMP
Guidance Document does not provide details on the "Preliminary WQMP" process. For both a
Preliminary WQMP and a Final WQMP, the checklist will list and describe the contents of the WQMP.

There are numerous BMPs available for incorporation into projects: unfortunately, many of the
BMPs included in WQMPs are not sufficient for treating the expected pollutants at reasonable levels
of effectiveness. AEI-CASC Consulting suggests that the City consider developing a "preferred" list
of BMPs so that applicants know from the start the type of BMPs and technologies that the City will
accept.

The WQMP Guidance document includes requirements for a triad of BMPs including site design,
source control, and treatment control. AEI-CASC Consulting has observed that many applicants are
relying primarily on treatment control BMPs and source control BMPs, with site design missing
altogether or being inadequately addressed. Unfortunately, the WQMP Guidance does not set
specific targets for use of site design BMPs. Because site design BMPs are considered one of the
most effective mechanisms for addressing the impacts of new development, AEI-CASC Consulting
suggests that site design standards be developed to assist applicants in meeting the site design
requirements of the WQMP Guidance.

The WQMP Guidance requires the identification of receiving waters, listing of impairments, listing of
project pollutants, and other items. Unfortunately, these identifications and listings are often
incorrect in early WQMP submittals, and when incorrect, can lead to improper BMP selection and
sizing. AEI -CASC Consulting suggests that these relatively standard items be prepared and made
available for use by applicants during preparation of their WQMP.
. Pre-Submittal Meetinas
For large and complex projects, AEI-CASC Consulting suggests that a meeting be held with the
applicant and WQMP preparer prior to submittal of the WQMP. The purpose of the meeting is to go
over the City's expectations with respect to the WQMP. The firm has found that these meeting can
reduce the overall timeframe for preparation of a WQMP ready for recommendation for acceptance.

Inclusion of Water Quality & Impaired Water Body Data in
OPP's Registration Review Risk Assessment & Management Process
Goal: Esta,blish a process for the voluntary submission of state & tribal surface and ground
water quality data, including but not limited to Clean Water Act (CWA) 303(d) & 305(b)
data, for consideration in exposure characterizations for ecological risk assessments and in
risk management decisions for pesticide registration review.
Back2round: EPA's Office of Pesticide Programs (OPP) published the final rule for
pesticide registration review on August 9,2006 with an effective date of October ]0,2006

continue to meet current health and safety standards. The Congressional goal is to review all
existing pesticides every ] 5 years. .
Process for Identification & Submission of Water Ouality Data for Rt!l!istration
Review:

Problem Formulation -begins well in advance of initiation of risk assessment
Review schedule for opening registration review case dockets - with focus on the first
two years (e.g., FY07 & FY08 in the first schedule). - Regional water & pesticide staff
with inputfrom OPP
Identify Clean Water Act (CW A) 303(d) listed water bodies where the pesticide
scheduled for review is the cause of impairment, and other state/tribal water quality
concerns associated with the scheduled pesticides based on CW A 305(b) biennial reports,
other surface or ground water monitoring, or other sources. Water quality concerns
include fish tissue and sediment concerns. - Regional water and pesticide staff provide a
single 'report' per region indicating pesticides for which data may be provided.
,. For registration review cases associated with 303(d) listings, mine existing data that
support the listing of each water body, and any other related data. Information on any
current mitigation should also be submitted. - Regional water and pesticide .~taff,

quarter of the fiscal year preceding the year in which the pesticide is scheduled to begin

There are several options for providing the data or data locations to EPAlOPP:
I. I f the data are already in the new STORET database, then simply let OPP know where
the dataset is located within the database.
2. If the data are in legacy versions ofSTORET, or in other data systems, then OPP
would like to get the type of metadata and detailed data described in the following
sections.

(n.b., As a point of reference, The National Water Quality Monitoring Council, a
consortium of federal, tribal, state and local agencies, academia, and the private
and public sector water supply industries, developed guidance on water quality
data elements that enhance the evaluation and sharing of water quality data. The
data elements identified below were derived from this guidance

addition, detailed guidance on elements included in data quality standards may be
found in the Environmental Sampling, Analysis and Results (ESAR) Data

Sam ole data should include at a minimum:
. Bibliographic reference
Data included in an EP A risk assessment need to be citable. The reference would
ideally be for a report on the study in which the data were collected. If the
bibliographic citation is a website, it should reference the page containing the data in
question (not the general site for the database), and must identify the date the page
was accessed, A database that is on the web containing data from multiple studies is
acceptable, as long as a lead contact (i.e. study director or collecting organization) 'for
the study that collected the speci fic data in question is provided.
· Sample collection date (and time, if available)
. Sample ID
· Location description (Water body name in National Hydrography Dataset, and
location descriptor such as: latitude/longitude, FIPS code, water body & segment)
· Sample media (e.g. water, filtered water, bed sediment, tissue, etc.)
· Concentration detected and measurement units
. Detection limit and analytical method

Other imoortant information that aid in interoretinl! monitorinl! data are:
· What was the purpose of the study (i.e. study design rationale)? (a reconnaissance
study, targeted to compounds of interest, TMDL plan, statistically designed)

toxicant(s) causing toxicity.)

. For some chemicals, environmental conditions may affect mobility and persistence
(for example: temperature, pH, hardness, turbidity). If this is known to occur,
information on the parameter would be helpful in interpreting the data.
opp recognizes that raw data for all the parameters listed above may not be available in
all monitoring studies, particularly for older studies, and that the types of water quality
data collected might be different between monitoring programs. There is no need for
states to create or reformat any data - opp will attempt to use what is available, either
qualitatively or quantitatively. In that spirit:

If the supporting data were collected in a monitoring program conducted by the
states themselves, opp would like to receive the detailed monitoring data and a
copy of any report describing the purpose and design of the monitoring study, or
internet web address leading to this information.
If the data were collected by an outside party. such as university researchers, then
citations of published reports or copies of the reports themselves would provide
the needed context. (Note, please do not submit NA WQA data if it was used as
the basis of a 303( d) listing or identification ofa water body of concern, instead
please reference the specific NA WQA datasel.)
[f any 303( d) listings or other water quality concerns for pesticides were based on
watershed characteristics or expected pesticide use, and not actual pesticide
detections in surface water, such information could help inform OPP's risk
assessment, as well.
[n summary, OPP is interested in seeing all available data for a specific water body of
concern to a State. If a monitoring study is already contained within the new STORET
all that is required is its location within the database. For monitoring studies not
contained with the new STORET, please submit data, or provide database locations, with
associated documentation or references, as described above.

SUBJECT: SURVEY OF DEVELOPMENT PROJECTS THAT INCORPORATE
ALTERNATIVE STORM WATER MANAGEMENT TECHNIQUES
The Office of Research Planning and Performance (ORPP) at the State Water
Resources Control Board, in conjunction with the Storm Water and Non-Point Source
Programs, is interested in the potential economic benefits of alternative storm water
management techniques. We want to identify properties and projects that have higher
property values than comparable projects with more traditional storm water facilities.
We need your help identifying good examples of properties and projects.

Historically, conventional storm water facilities have been designed to swiftly dispatch
runoff through downspouts, gutters, and storm drains. In contrast, alternative storm
water management measures are designed to slow runoff and increase local infiltration,
reducing the rate and volume of storm water that leaves the property. These techniques
are often recognized as components of hydromodification, Low Impact Development
(LID), Ahwahnee Water Principles, or alternative land use and site design.
Examples of alternative storm water management techniques include the use of natural
channels instead of concrete storm drains. creation of open space where runoff ponds
and infiltrates, development of street-side swales instead of gutters, installation of
pervious paving materials, planting of green roofs, site development that minimizes
grading, and any other measures that increase infiltration, slow and filter runoff, and/or
reduce storm water runoff.
The purpose of this correspondence is to request your assistance identifying properties
and development projects that incorporate alternative storm water management
techniques and have higher property values than comparable projects that rely on
conventional storm drains.
