Finance: Council Notes: Agenda Item No. ~' qly o7 CITY OF SAN BERNARDINO -REQUEST FOR COUNCIL ACTION Staff Report Subject: A Resolution of the Mayor and Common Council of the City of San Bemardino authorizing an increase to Annual Purchase Order Number 208234 in the amount of $2,362,800.00 to the County of San Bernardino Solid Waste Management Division pursuant to 3.04.010 B-3 of the Municipal Code for dump waste fees utilized by the Public Services Department, Integrated Waste Management Division. Background: The City of San Bernardino Public Services Department, Integrated Waste Management (IWM) Division provides collection services to residential and commercial customers for trash disposal. The Public Services Department, IWM Division is required to use the County of San Bernardino's landfills under the Waste Delivery Agreement (VVDA) between the City of San Bernardino and County that is in effect from January 1, 1998 to December 31, 2012. The County of San Bemardino Solid Waste Management Division charges the City of San Bernardino $35.56 per ton in dump waste fees. The Public Services Department, IWM Division collects an average of 13,270 tons per month for both residential and commercial customers. Therefore, the IWM Division is charged an average of $471,900.00 per month (approximately $5,662,800.00 per year) in dump waste fees for both residential and commercial trash. The Public Services Department, IWM Division currently has a purchase order with the County of San Bemardino Solid Waste in the amount of $3,300,00.00. Staff recommends that the current purchase order be increased from $3,300,000.00 to $5,662,800.00 for all future years and allowing for rate increases. The additional $2,362,800.00 will allow us to cover the dump waste fees for the entire FY 07-08. Financial Impact: Funding for this increase is contained in the IWM Division FY 07-08 budget, Account Number 527-412-5179 (DumpNVaste Fees) in the amount of $709,600.00 and Account Number 527-413-5179 (DumpNVaste Fees) in the amount of $1,653,200.00 for a total of $2,362,800.00. Recommendation: Adopt resolution. 1 RESOLUTION NO. 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AUTHORIZING AN INCREASE TO ANNUAL PURCHASE 3 ORDER NUMBER 208234 TO COUNTY OF SAN BERNARDINO SOLID WASTE MANAGEMENT DIVISION PURSUANT TO 3.04.010 B-3 OF THE MUNICIPAL 4 CODE FOR DUMP WASTE FEES UTILIZED BY THE PUBLIC SERVICES 5 DEPARTMENT, INTEGRATED WASTE MANAGEMENT DIVISION. g BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 7 8 WHEREAS, the City entered into a Waste Delivery Agreement with the County 9 of San Bernardino dated December 15, 1997, which requires the City to utilize the 10 County landfill; and 11 WHEREAS, the current purchase order of $3,300,000.00 needs to be increased 12 to $5,662,800.00 in order to cover the entire FY 07-08 13 SECTION 1. The Mayor and Common Council hereby authorize the Director of 14 Finance or his/her designee to increase Purchase Order No. 208234 by an additional 15 16 $2,362,800.00. 17 SECTION 2. This purchase is exempt from the formal contract procedures of 18 Section 3.04.010 of the Municipal Code, pursuant to Section 3.04.010. B-3 of said 19 Code. 20 SECTION 3.
