ECONOMIC DEVELOPMENT AGENCY STAFF REPORT Sale Of Certain Real Property To The San Bernardino City Unified School District BACKGROUND The Agency owns the following properties located within the Central City North Redevelopment Project Area: 736 North Berkelev Avenue - Agency purchased the property from HUD in 2000 for $1.00 under the Good Neighbor Program. The house was demolished for an approximate cost to the Agency of $9000 and the property is currently vacant. 630 North "F" Street and 669 North "G" Street - Agency purchased both these properties in the early 1990's through foreclosure. The cost to the Agency at that time was approximately $140,000 for both parcels. Both parcels are presently vacant. 734 North Berkelev Avenue - This residential property will be acquired by the Agency from HUD and concurrently sold to the District at the price and costs established by HUD. These costs are estimated at $46,700. There are no costs to the Agency on this transaction. It simply serves as a pass through. Collectively, these parties are referred to the "Properties". CURRENT ISSUE The Redevelopment Committee and Community Development Commission have previously authorized Agency staff to take the appropriate action to sell the Properties to the San Bernardino Unified School District (the "District"). The District is assembling and purchasing all of the land located within the blocks bounded by 6th Street on the south, 8th Street on the north, "G" Street on the west, and "F" Street on the east. The District proposes to use the acquired and assembled land for the construction of an elementary school, commonly referred to as the Jones Elementary School. The District has offered to purchase the Properties from the Agency at the current appraised fair market value as follows: 736 North Berkeley Avenue - $15,000 734 North Berkeley Avenue - $46,700* 630 North "F" Street - $15,000 669 North "G" Street - $27,000 GVO:MP:lag:05-07-01 School District COMMISSION MEETING AGENDA Meeting Date: 05/07/2001 Agenda Item Number: All;).. " Economic Development Agency Staff Report SB City Unified School District April 24, 2001 Page Number -2- The total revenue anticipated to be received by the Agency from the District for the three (3) Properties is $57,000. As stated above, the 734 Berkeley Property will be a 100% pass through to the District and at no cost to the Agency, By state law, prior to the sale of any Agency-owned property, the Agency shall conduct a public hearing and disclose the costs associated with the acquisition and disposition of the Properties. The Mayor and Common Council must consent to the sale of the Agency Properties. The public hearing notice was published on April 18th and 25"', 2001 in accordance with Health & Safety Code 33433. Accordingly, it is recommended that the Mayor and Common Council consent and Community Development Commission approve the sale of the Properties to the District. ENVIRONMENTAL: The sale of real estate is categorically exempt from CEQA, Any impacts as a result of development of the site will be assessed as part of the environmental review to be conducted by the San Bernardino City Unified School District. FISCAL IMPACT The Agency will realize not less than $57,000 from the sale of the Properties to the District. RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION APPROVING THE SALE OF CERTAIN REAL PROPERTY WITHIN THE CENTRAL CITY NORTH REDEVELOPMENT PROJECT AREA TO THE SAN BERNARDINO UNIFIED SCHOOL DISTRICT AND AUTHORIZING THE AGENCY EXECUTIVE DIRECTOR TO EXECUTE A PURCHASE AND SALE AGREEMENT AND RELATED DOCUMENTS AS APPROVED BY AGENCY SPECIAL COUNSEL WHEREAS, the Redevelopment Agency of the City of San Bernardino (the "Agency") owns certain lands referred to collectively as the "Properties" which are situated within the redevelopment project area of the Central City North Redevelopment Project described as: (i) 736 North Berkeley Avenue (ii) 630 North"F" Street (iii) 669 North "G" Street (iv) 734 North Berkeley Avenue WHEREAS, the San Bernardino Unified School District ("District") is proposing to develop an elementary school on the Properties and wishes to purchase said Properties from the Agency at the current appraised value and pursuant to the terms of a Purchase and Sale 17 Agreement. 18 WHEREAS, it is appropriate for the Commission to take the actions as it pertains to the 19 sale of the Properties as set forth in this Resolution. 20 NOW, THEREFORE, THE COMMUNITY DEVELOPMENT COMMISSION 21 ACTING ON BEHALF OF THE REDEVELOPMENT AGENCY OF THE CITY OF SAN 22 BERNARDINO DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: 23 Section 1. On May 7, 2001, the Commission conducted a full and fair joint public 24 hearing with the Mayor and Common Council of the City of San Bernardino relating to the sale by the Agency and redevelopment of the Properties by the District. The minutes of the Agency -1- School District CDC 05107/01 e2 613 _14 e25 Secretary for the May 7, 2001, meeting of the Commission shall include a record of all communication and testimony submitted to the Commission and to the Mayor and Common 3 Council by interested persons relating to the joint public hearing, the 33433 Report and the 4 approval of the sale of the Properties. 5 Section 2. The sale of the Properties by the Agency shall be sold by the Agency to 6 the District for a price noted in the staff report, Exhibit" A" to this Resolution. 7 Section 3. The Commission hereby finds and determines that no further 8 9 environmental review by the Agency of the disposition and redevelopment of the Properties is 10 necessary at this time under the California Environmental Quality Act (CEQA), as amended, in 11 light of the fact that the District will conduct the appropriate CEQA action prior to the 12 development of the Properties. Section 4. The Commission hereby approves, receives and files the 33433 Report and in the form as submitted at this joint public hearing. 15 Section 5. The Commission hereby approves the disposition of the Properties to the 16 District on the terms set forth in this Resolution. The Chair of Commission and the Executive 17 Director are hereby authorized and directed to execute a standard purchase and sale agreement 18 19 as approved and prepared by Agency Special Counsel, on behalf of the Agency together with 20 such technical and conforming changes as may be recommended by the Executive Director and 21 approved by the Chair of the Commission. The signatures of the Chair of the Commission and 22 the Executive Director on the Agreement shall provide conclusive evidence that the transaction 23 has taken effect. In the event that the Agreement may not be ~lIly executed by the parties for any reason within sixty (60) days following the date of adoption, of this Resolution, the 24 -2- School District CDC 05107/01 _2 authorization granted to the Chair of the Commission and the Executive Director to execute the Agreement on behalf of the Agency shall be of no further force or effect. 3 Section 6. Provided that the Agreement has been fully executed by the parties 4 within the period oftime set forth in Section 5 of this Resolution, the Executive Director of the 5 Agency is hereby 'authorized and directed to take all actions set forth in the Agreement on 6 behalf of the Agency and to close the escrow transaction described therein. This Resolution is adopted in order to satisfy the provisions of Health and 9 Safety Code Section 33433 as related to the sale of the Properties by the Agency to the District 10 on the terms and conditions set forth in the Agreement. The Mayor and Common Council 11 hereby find and determine as follows: 12 (i) the disposition and redevelopment of the Properties by the District are consistent with the Redevelopment Plan for the Central City Redevelopment Project. (ii) the purchase price for the Properties payable by the District to the Agency, subjec 15 to the satisfaction of the terms and conditions of the Agreement, is an amount which the Community Development Commission has determined to be fair, just and reasonable, and that the disposition of the Properties on the terms set forth in the Agreement shall materially benefit 16 17 18 and sustain the implementation of the Redevelopment Plan. 19 Section 3. The Mayor and Common Council hereby find and determine that no 20 further environmental review of the disposition and redevelopment of the Properties by the 21 District is necessary at this time under the California Environmental Quality Act (CEQA), as 22 amended, in light of the fact that the District will conduct the appropriate CEQA review and 23 action prior to the development of the Properties. 24 Section 4. The Mayor and Common Council hereby approve, receive and file the 33433 Report and the Agreement in the form as submitted at this joint public hearing. -2- School District MCC 05107/01 _2 Section 5.
