STAFF REPORT
Subiect:
Authorization to proceed with Study evaluating the request to close 44th Street west of Waterman
Avenue and waiving the $ 1,000 administrative fee required to initiate study.
Backl!round:
The Public Works Division received a request from the Wildwood Park Neighborhood Cluster
Association to close 44th Street at Waterman Avenue. Closure of this street is being requested in
order to resolve several concerns within their area as follows:
. Speeding
. General Safety of Traffic /Pedestrians in the neighborhood
. Abandoned vehicles often left behind by motorists on their way to the mountains
Residents feel that non-residents cutting through their neighborhood cause much of these
concerns. They feel that if the road were closed, these issues would be resolved.
Traffic Engineering Staff evaluated the complaint. Approximately 1,000 vehicles were
counted at this location on an average weekday. It is expected that if the closure of 44th
Street is approved, traffic will be diverted to Leroy Avenue north of 40th Street. This is not
expected to cause a major impact to Leroy Avenue but will be further evaluated in the study.
The requested closure will be evaluated in accordance with the City's Policy on Closure of
City Streets. The policy requires that the proponents of the closure in two equal payments
pay a $ 1,000 administrative fee. One payment before the formal study is initiated and the
other after the formal study is completed but before the report is submitted to the Mayor And
Common Council for consideration.
The residents who initiated the request are asking that the administrative fee be waived.
They claim that lower income families live within this area and carmot afford this fee (see
attached request for waiver).
With this action, staff will proceed to the next step in the process, which will include
preparing and circulating a petition to residents in the area affected by this closure.
The Traffic Safety Committee evaluated this issue and endorsed the request to study the
closure of 44th Street west of W aterman Avenue.
Financial ImDact:
If the Mayor and Common Council agree to waive the fee, the City will not realize the $1,000
administrative fee revenue.
Recommendation:
That in accordance with the City's Policy on Closure of City Streets, the Public Works
Division be authorized to proceed with study relative to the request to close 44th Street west
of Waterman Avenue and that the $ 1,000 Administrative fee required to initiate this study be
waived.

traffic study be conducted.
The non-resident traffic is a public nnisance, is a danger to human life and property, and interferes with the
enjoyment of life for the residents, their family members and their property.
The residents are hard working individuals, but are low-income families; therefore, we request the waiver

BE IT RESOLVED BY THE ~tAYOR AND COMMON COUNCIL OF THE
4 CITY OF SAN BERNARDINO AS FOLLOWS:
5 SECTION 1. The "Policy on Closure of City Streets _ City
6 of San Bernardino," dated 6-8-95, is hereby adopted. A copy of
7 said policy is attached hereto, Marked Exhibit "A" and
8 incorporated herein by reference as fully as though set forth at
9 length.

POLXCY ON CLOSURE OF crn STREETS
CX'l'Y OF SAN BERNARDINO
I. INTRODUCTION: On occasion, requests are received for a
street to be closed to vehicular traffic. These closures
are normally accomplished by construction of a cul-de-sac
or other permanent imprQvements, without vacating the
easement for street and highway purposes.
These requests for street closures are generally due to the
following concerns:
1. Volume and speed of vehicular traffic
2. Crime and vandalism
3. Retain character and integrity of neighborhood
A need has been identified for a policy to assist the Mayor
and Council, and City Staff, in reviewing and evaluating
these requests. The following issues are generally raised
by a proposal to close a City street:
1. ImpaGt on other streets due to diverted traffic
2. Potential conflicts between residents, cO~ercial
establishments and through traffic
3. Will response time for emergency vehicles be affected?
4. Access for public service vehicles
5. Potential impact upon property values and leasability.
All requests for closure of a street(s) will be subject to
payment of a $1,000.00 administrative fee, paid in two
equal payments.

II . PROCEDURE
1. Authority to Proceed - Requests for closure of a street
may be generated by a member(s) of the public. All
requests shall be routed to the Department of Public
Works, for preparation of a staff report for presenta-
tion to the Mayor and Council. The report will present
the basic characteristics of the street, describe
obvious impacts and give a recommendation if authoriza-
tion should be granted to proceed. The Mayor and
Council will either grant authorization to proceed, or
deny the request. A non-refundable administrative fee
of $500 shall be submitted by the proponent (s) along
with all requests.
2. Petition by Affected Citizens - A Petition will be pre-
pared by the Traffic Engineer for any requests 'for
which authorization to proceed is granted. The follow-
ing points will be incorporated into all petitions:
a. A drawing showing the location of the proposed
street closure(s), and the area that would be
affected by the closure(s).
b. Statement describing the reasons for the requested
street closure(s).
c. Statement acknowledging that affected citizens will
be required to pay all of the cost for constructing
permanent improvements to close the street, for all
requests submitted by a mernber(s) of the public.
d. Preliminary estimate of cost for closing street(s).

3. Siqnatures by Affected Citizens - Proponent(s) of the
closure will gather signatures from affected citizens.
The petition will be submitted to the Traffic Engineer
for verifica.tion that the signatures are by affected
citizens. At least 85% of the affected citizens must
sign the petition in order for it to be considered as
an indication of a sufficient level of support to con-
tinue the process.
4. Report to Mayor & Council - Upon verification that a
petition has been signed by 85% of the affected
citizens, and receipt of a non-refundable fee of $500,
the Department of Public Works will prepare a report to
the Mayor and Council, with a recommendation on the
proposed closure. Comments will be solicited from the
Fire Chief, Police Chief and Director of Public
Services, on the anticipated affect that the closure
would have on their operations. Any comments received
will be referenced in the report to the Mayor and
Council.
5. Approval by Mayor & Council - The Mayor. ang. Council
will consider the report from the Department of Public
Works, and may set a public hearing.
Financing to
cover the total estimated cost for constructing per-
manent improvements to close the street(s), shall be
identified in conjunction with approval of any request.
III. CONSTRUCTION OF IMPROVEMENTS:
1. Submittal of Funds - An estimate of the.total project

cost will be provided to the proponent(s) by the De-
partment of Public Works, for any request submitted by
a member(s) of the public. Upon receipt of funds, in
the total amount of the estimate of cost, processing of
the project will be commenced. The proponent (s) may
petition the Mayor and Council to establish an assess-
ment district, in order to ensure that all affected
citizens pay their proportionate share.
2. Environmental Review - Upon receipt of the necessary
funds, or establishment of an assessment district, the
Department of Public Works will prepare an initial
study and submit it to the City's Environmental Review
Committee for review.
3. Preparation of Plans - The Departr.\ent of Public Works
will proceed to prepare the plans, specifications and
estimate, as required to advertise the project for
bids. Closure of streets will be done by construction
of permanent street improvements in accordance with
City' Standard Specifications and Drawings, and plans
approved by the Director of Public Works/City Engineer.
4. Advertisement for Bids - The improvement plans will be
submi tted to the Mayor and Council for approval and
authorization to advertise for bids.
