08-07-2000 - Resolution No. 2000-235 was adopted establishing right of way boundaries for Orange
Show Road, between Waterman Avenue and Twin Creek Flood Control Channel and authorization
was given to proceed with the sale of remnant parcels.
02-20-2001 - Resolution No. 2001-35 was adopted establishing fair market value and giving notice
inviting bids for the sale of four City owned parcels located north and south of Orange Show Road, west
of Waterman Avenue.

Recommended Motion:
I. That the hearing accepting oral bids for the sale of City and Water Department property, as per Bid
Specification No. 15.02-223, be closed.

Staff Report
SUBJECT:
Oral Bids: 10:00 am and Awarding of Bid --- Sale of City and Water Department Property located north
and south of Orange Show Road, west of Waterman Avenue.
BACKGROUND:
On August 7, 2000, Resolution No. 2000-235 was adopted, establishing the right of way boundaries for
Orange Show Road, between Waterman Avenue and the Twin Creek Flood Control Channel relative to
the extension of Orange Show Road from Arrowhead Avenue to Tippecanoe Avenue. As a result of the
fee acquisition of various parcels between Waterman Avenue and the Twin Creek Flood Control
Channel (the remainder of Orange Show Road extension was acquired as easements), four remnant
parcels remain.
Staffwas authorized to secure an appraisal on these parcels and on February 2, 2001, Resolution No.
2001-35 was adopted, setting the fair market value for the four parcels was follows

Resolution No. 2001-35 also authorized the advertising of a Notice Inviting Bids, and the various
parcels were also posted with "For Sale" signs. The deadline for submitting bids was March 20,2001.
Only one bid was received, and it was only for Parcel Four, which is owned by the Water Department.
The bid, submitted by Mathis and Eddie Davis, who own the adjoining property, was for $17,200. The
bidder paid the required ten percent deposit, and wishes to carry the balance for $500 a month at 7.75%
interest. A copy of the bid form is attached. Since the property is owned by the Water Department, they
had indicated to us that they would like to prepare and administer the purchase contract, which they will
present to you for your action at a later date.
There was some interest to purchase Parcel Three, by an adjoining property owner, but he stated that he
did not submit a bid because he felt the sales price was too high.
Since no bids were submitted for the remaining three parcels, staff could re-advertise for bids, through
the services of a Real Estate Broker or suspend the sale of these parcels until sometime in the future. If
the decision to use a Broker is made, staff will seek the services of a Broker and an Agreement will be
submitted at a later date. Attached also is a vicinity map and a map showing the location of the four
parcels.
FINANCIAL IMPACT:
The City incurred a cost of $2,800 for appraisal services. The Water Department will reimburse the
City for $430, which is for their proportional share of the appraisal costs. The net cost to the City after
reimbursement from the Water Department is $2,370. The City paid for the appraisal costs out of
account number 001-182-5502 (Real Property-professional/Contractual).
RECOMMENDATION:
Staff recommends that the hearing on oral bids be closed, and in the absence of a higher oral bid, the bid
for Parcel Four be awarded to Mathis and Eddie Davis and that staff be authorized re-advertise for bids
through a Real Estate Broker for the remaining parcels.
