This email was sent to city attorneys last Thursday, as a followup to our Rule 20A activities. If you have any questions please contact Yvonne Hunter: huntery@cacities.org. Background: The CPUC has recently granted PG&E and So. Cal. Edison permission to defer work on Rule 20A undergrounding projects as part of their rate stabilization plans. (CPUC Applications 00-11-056 and 00-11-038). San Francisco learned only very recently that PG&E was seeking to defer Rule 20A projects and was one of only a handful of jurisdictions (including Oakland, Alameda, Yucaipa, and L.A. County) that submitted comments in the proceeding before the Commission. Plan of Action: San Francisco has received calls from jurisdictions interested in submitting joint pleadings. We plan to draft two pleadings, most likely an Application for Rehearing and an Emergency Motion to prevent the utilities from deferring the projects. To Participate: There will be a conference call on Tuesday, April 3rd at 9 a.m. to discuss the substantive legal arguments for the pleadings. The call-in number is: 1 (800)403-2036, code: 239152. If you plan to participate in the conference call, please send me a confirming email. Cities interested in signing on to the pleadings may submit byemail (Christine_Ferrari@ci.sf.ca.us) or fax ((415) 554-4757) an exhibit on official letterhead (approximately 3-5 pages long) describing Rule 20A projects that are underway and the impact of deferral of those projects. The exhibits should not contain legal arguments, as those will be contained in the pleadings. If you would like to sign on to the pleading please send a confirming email. Please send exhibits/declarations by Wednesday, April 111h. We hope to file the pleadings no later than Friday, April 13th.
