Staff Report
SUBJECT:
Resolution ofIntention: vacation of portions of Gannett Parkway, northeasterly of Hallmark
Parkway and portions of Mc Arthur Boulevard, northwesterly of Gannett Parkway.
BACKGROUND:
A request was received by this office, to vacate a portion of Gannett Parkway (formerly
Campeau Drive), northerly of Hallmark Parkway, and a portion ofMc Arthur Boulevard,
westerly of Gannett Parkway. The request came from a representative of a proposed Wal-Mart
store to be constructed at this site. Presently, Wal-Mart is in escrow on the two parcels westerly
and easterly of Gannett Parkway. The general location of this proposed vacation is shown on the
Vicinity Map attached as Exhibit "1", and details are shown on Plan No. 10225, attached as
Exhibit "2". The applicant has paid the required $1,000 processing fee.
On February 20, 2001, staffwas authorized to proceed with the proposed vacation. City
departments and utilities were notified of the proposal for comments, conflicts or reservation of
easements. Initially, Wal-Mart had proposed to dedicate a realignment ofMc Arthur Boulevard
to connect with Hallmark Parkway. They have now indicated to us that the realignment would
conflict with the proposed location of the building. The City Traffic Divisio,n and the City Fire
Department have both indicated concern over terminating Mc Arthur Boulevard if the vacation is
approved. In response, Wal-Mart representatives have indicated to us that they would dedicate an
easement for emergency vehicle access which they will also use as a truck alley for access to
the truck dock. The proposed easement is shown on Exhibit "3". The recording of the Resolution
Ordering Vacation can be deferred until the necessary easement is dedicated. All affected
property owners were also sent a notice relative to the proposed vacation and no conflicts were
noted.
Additionally, we have received requests for the reservation of easements from City Water
Department, Southern California Edison, and Southern California Gas Company. All requested
easements will be reserved as required by law.
The attached resolution sets a public hearing for May.7, 2001. If approved, the resolution will be
published in the San Bernardino County Sun, notices will be posted along the streets to be
vacated and mailed notices will be given to the affected property owners.
FINANCIAL IMPACT:
None. The applicant has paid the $1,000 processing fee.

RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS
3 INTENTION TO ORDER THE VACATION OF A PORTION OF GANNETT
PARKWAY, NORTHEASTERLY OF HALLMARK PARKWAY AND A PORTION OF
4 MC ARTHUR BOULEVARD, NORTHWESTERLY OF GANNETT PARKWAY AND
5 RESERVING CERTAIN EASEMENTS THEREIN.
6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:

SECTION I. That the Mayor and Common Council of the City of San
9 Bernardino hereby declares its intention to order the vacation of a portion of Gannett
10 Parkway, northeasterly of Hallmark Parkway and a portion of Mc Arthur Boulevard,
11 northwesterly of Gannett Parkway, described as follows:

That portion of Gannett Parkway (formerly Campeau Drive), 60 feet wide, lying
between the northeasterly line of Hallmark Parkway, and its northeasterly
terminus with Mc Arthur Boulevard, and a portion of said Mc Arthur
Boulevard, 60 feet wide, lying northwesterly of said Gannett Parkway and
southeasterly of the northeasterly prolongation of the northwesterly line of Parcel
II, Parcel Map No. 5902, as per plat thereof recorded in Book 64 of Parcel Maps,
pages 30 through 32, records of the County Recorder of San Bernardino County,
State of California, and as amended by a Certificate of Correction recorded on
January 7,1982 as Instrument No. 82-004190, Official Records of said County, as
said streets are delineated on said Parcel Map No. 5902 and said Certificate of
Correction.
SECTION 2. That the Mayor and Common Council of the City of San Bernardino, in
21 vacating the above described portion of said street, elects to proceed under and in accordance
22 with the provisions of the "Public Streets, Highways, and Service Easements Vacation Law",
23 being Division 9, Part 3, of the Streets and Highways Code of the State of California.

SECTION 3. That the hour of 10:00 a.m., on May 7, 2001, in the Council Chambers of
City Hall, 300 North "D" Street, San Bernardino, California, is fixed as the time and place when
26
27 d where all persons interested in or objecting to the proposed vacation may appear before the
28 aid Mayor and Common Council and offer evidence in relation thereto. For further particulars

3 as to the proposed vacation, reference is made to that map marked "Plan No. 10225", approved
4 by the Mayor and Common Council on 2/20/2001, a copy of which is on file in the office of the

City Clerk of said City.

SECTION 4. Nothing in this Resolution shall in any way affect or disturb any existing
8 easements for public utility purposes belonging either to the City of San Bernardino or to any
9

public utility and there is hereby specifically reserved for the City of San Bernardino, an
easement for sanitary sewer and appurtenant facilities over the entire area proposed to be vacated
including the right to construct, maintain, operate, replace and renew said sewer or
13
appurtenances; and there is hereby specifically reserved for the City of San Bernardino
Municipal Water Department, an easement for water utility purposes over the entire area
14
15 proposed to be vacated, including the right at any time, or from time to time, to construct,
16 maintain, operate, replace and renew one or more pipelines or appurtenances thereto for the
17 transportation of water and for the construction and maintenance of water wells and related
18
19
20 specifically reserved for Southern California Edison, its successors, heirs and assigns, an
incidental purposes, including the right of ingress and egress thereto; and there is hereby
21 easement to construct, place, operate, inspect, maintain, repair, replace and remove any overhead

3 and necessary fixtures and appurtenances and said easement shall include rights of ingress and

SECTION 5. That the City Engineer of the City of San Bernardino is hereby directed to

cause Notices of Street Vacation to be posted as required by said "Public Streets, Highways and
Service Easements Vacation Law."

SECTION 6. That the City Clerk shall certify to the adoption of this Resolution of
9
10 Intention and shall cause the same to be published once a week for two successive weeks in The
11

Sun, a newspaper published and circulated in the City of San Bernardino, prior to the above date
set forth for the public hearing.
