STAFF REPORT
RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO IN SUPPORT OF PROHIBITING THE HOUSING
OF SEX OFFENDERS NEXT TO DAY CARE CENTERS IN RESIDENTIAL
NEIGHBORHOODS.
The Wildwood Neighborhood Association discovered that, in January 2006, State
Parole placed six parolees, who were also registered sex offenders, in a rental
home next door to a day care center. The Association has sought the assistance
of the San Bernardino Police Department and the City Code Compliance
Department to address the Wildwood Neighborhood Association's public safety
concerns. At present, the City's options available to prohibit the placement of
parolees in residential areas are limited.
To urge stronger action from the State on this matter, the Wildwood
Neighborhood Association will be sending a letter to the State Attorney General.
The Association is also requesting that the City provide it with an addendum to
be included with the letter to the State Attorney General.
RECOMMENDED ACTION:
That the resolution be adopted.

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO IN SUPPORT OF PROHIBITING THE HOUSING OF SEX
OFFENDERS NEXT TO DAY CARE CENTERS IN RESIDENTIAL
NEIGHBORHOODS.
Whereas, under current State law, the Parole and Community Services Division is
allowed to place parolees, who are registered sex offenders, in housing facilities in close
proximity to day care centers within residential areas as long as the number of parolees is six or
less; and
Whereas, the Wildwood Park Neighborhood Association discovered that in January
2006, Parole and Community Services Division placed six parolees, who were also sex
offenders, in a rental home at 280 E. 48th Street, next to a licensed day care center at 284 East
48th Street.
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Common Council of
the City of San Bernardino urges the State Attorney General to review the State legislation
which allows this potentially dangerous situation to exist, threatening the very lives ofthe
State's children.
