The Legislative Review Committee requested that staff review the current weed
abatement procedures and discuss possible alternatives. As a result, Code Enforcement has
requested that the City Attorney's Office draft an ordinance that would allow them to record a
Notice of Weed Abatement Requirements on all vacant lots. This ordinance gives the Code
Enforcement Department the statutory authority to record such notices with the County Recorder.
By recording said notice, the requirements will be included with a title report and provide
potential buyers of vacant lots with the maintenance and abatement requirements.
On July 3, 2007 the Legislative Review Committee unanimously approved this item and
recommended that it be put on the July 16, 2007 agenda for first reading.

4 8.27.110 TO THE SAN BERNARDINO MUNICIPAL CODE REGARDING RECORDING
5 NOTICES OF WEED ABATEMENT REQUIREMENTS ON VACANT LOTS
6 THE MA YOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
7 DO ORDAIN AS FOLLOWS:
8 SECTION 1. Section 8.27. I 10 is added to the San Bernardino Municipal Code to read
9 as follows:
10 8.27.110 Recording Notice of Weed Abatement Requirements.
11 The Code Compliance Director shall record a "Notice of Weed Abatement Requirements"
12 with the County Recorder on all vacant lots within the City. Such notice shall set forth that it is
13 necessary to protect the health and safety of the inhabitants of the City and require property owners
e 14 to keep vacant lots free of weeds, dry vegetation of any type, dead or diseased trees, dead or dry
15 palm fronds, fences in disrepair or broken, rubbish, refuse and dirt upon streets, road sides,
16 sidewalks, parkways between sidewalks and curbs, and along fences.
