Back2round: On December 6, 2004, the Mayor and Common adopted a resolution approving an Agreement with TY Lin International to provide professional engineering services in the amount of $249,050.00 for the preparation of a Project Study Report/Project Report (PSRlPR) for the University Parkway/Interstate 215 Interchange Southbound Loop entrance ramp project. Growth in the Verdemont and State University area has resulted in traffic impacts to the University Parkway/I-215 interchange. The most impacted movement is southbound University Parkway to eastbound 1-215. To alleviate the problem, the original Agreement envisioned a loop ramp from southbound University Parkway to eastbound 1-215. This loop ramp would have required acquisition of an existing Jack-in-the-Box Restaurant and a portion of Wal-Mart's parking lot. Due to the high cost of property acquisition associated with the loop ramp concept, the City Engineer requested that TY Lin International investigate an alternative design using a direct connector ramp (flyover). Flyover ramps have been successfully used in the past where right-of- way is restricted and Caltrans has been favorable to the use of such ramps. TY Lin International conducted a feasibility study at no additional cost to the City. The study revealed that the construction cost of the flyover ramp would be significantly higher than the loop ramp, but the right-of-way acquisition cost would be much less and would offset the higher construction cost. Additional benefits of the flyover ramp will be that it will operate more efficiently than the loop ramp and it will not impair or displace any operating businesses. Based on this study and with concurrence of Caltrans, the decision was made to proceed with design of the flyover ramp alternative. TY Lin International proceeded with design of the flyover ramp based on criteria provided by the Caltrans local ollice. Monthly project development team (PDT) meeting were held with Caltrans, TY Lin International and City staff participating. Most of the required environmental and preliminary design studies needed for the PSRlPR were completed based on the criteria provided by Caltrans at the start of the project. Caltrans Geometricians in Sacramento reviewed the concept and required the new ramp to merge into mainline 1-215 south of the existing ramp's connection to the mainline. This required a significant realignment of the connector ramp in order to meet Caltrans' requirements. This also increased the environmental footprint of the project and additional biological, noise and cultural studies had to be performed to complete the environmental process. 2 e CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT Caltrans Traffic Operations division also required more extensive traffic analysis of the new connector ramp and the impacts on the existing street intersections as well as impacts on mainline 1-215. The result is additional work that TY Lin International has estimated will cost $180,329 to complete. Since this is a substantial change to the work and was not envisioned by TY Lin International or the City in the original Agreement, TY Lin International is asking for additional compensation for the re-design of the flyover ramp, modification of the environmental assessment and expansion of the biological, noise, cultural and traffic studies. Staff recommends that Amendment No. I to the Agreement for Professional Services with TY Lin International be approved in order to complete the PSR/PR and environmental studies and allow the design phase of the project to begin as soon as possible. Financial Impact: Adequate funding to cover the cost of this amendment is available in Account No 242-362-5504- 7240 and Account No. 120-367-5504-7240 "SS04-19 University Parkway/l-215 Freeway Combined Project Study Report/Project Report and Freeway Loop". Morris, Mayor City of San Bernardino 27 28 By: t. 3 EXHIBIT "A" AMENDMENT NO.1 TO AGREEMENT FOR PROFESSIONAL SERVICES This AGREEMENT is made and entered into this day of 2007, by and between the CITY OF SAN BERNARDINO, California, a municipal corporation, hereinafter referred to as the "City" and TY Lin International, hereinafter referred to as "Consultant." WITNESSETH: A. WHEREAS, on December 6, 2004, the Mayor and Common Council adopted Resolution No. 2004-383 approving Agreement for Professional Services in the amount of $249,050.00 with Consultant to provide a Project Study ReportJProject Report and the supporting studies and documents for the University Parkway/Interstate 215 Interchange Southbound Loop entrance ramp project, and B. WHEREAS, changes to the scope of services have occurred that were beyond the control of Consultant and the City and will require Consultant to perform additional work and incur additional costs not anticipated at the time of execution of the original Agreement for Professional Services, and C. WHEREAS, staff concurs that the additional work was not included in the original Agreement for Professional Services. NOW THEREFORE, the parties hereto agree as follows: 1. Section 1 of said Agreement for Professional Services is amended to add that the Consultant shall redesign the connector ramp to meet Caltrans' requirements for geometries and perform additional biological, noise and cultural studies, as well as modification of environmental documents, needed to complete the environmental process due to the increased footprint of the project per proposal by Consultant dated April 3, 2007 (attached and incorporated herein as Attachment "I "). 2. Section 2 of said Agreement for Professional Services is amended to add the following: 'The term of this Agreement for Professional Services is extended for one additional year to and including July 16, 2008, unless terminated earlier as provided in the original Agreement for Professional Services." -1- Amendment No. I to Agreement for Professional Services with TY Lin International. 3. Section 5(A) of said Agreement for Professional Services is amended to add the following paragraphs: The City shall also reimburse the Consultant for actual costs (including labor costs, employee benefits, overhead, profit, other direct and indirect costs) incurred by the Consultant in the performance of work involved in redesign of the connector ramp to meet Caltrans' requirements for geometries and perform additional biological, noise and cultural studies, as well as modification of environmental documents, needed to complete the environmental process due to the increased footprint of the project as identified in Attachment I, in an amount not to exceed $180,329.00 The following is a summary of the costs authorized to date for this project: Description Amount Original Agreement $249,050.00 Amendment No. I $180,329.00 Totals $429,379.00 4. Un International April 3, 2007 Background Since the preparation of the original scope and fee included in the prime contract dated 12/6/2004, new requirements are now necessary to obtain Project Approval (PA&ED) from Caltrans and FHW A. Also, during the preparation of the initial studies and preliminary engineering, the City requested changes to the concept (wider cross section and horizontal alignment of the connector) that required additional work. Scope of Work Based on the above information T.Y. Lin International (TYLI) prepared the following scope of services; Task 1- Project Approval (PSR/PR): Task 1.1 Project Management: TYLI will provide overall execution and financial management of the project, including City of San Bernardino and Caltrans coordination; coordination with other agencies, tracking progress of the work, preparing monthly invoices and project status reports, and conducting project meetings. TYLI's Project Manager will provide overall project management, coordination, and supervision of project staff to facilitate the performance of the work in accordance with the scope and requirements of City of San Bernardino and Caltrans. TYLI will work with the Project Development Team (PDT) and will maintain close coordination amongst all of its members. TYLI will also chair and conduct official monthly PDT meetings. TYLI will prepare monthly status reports to update the City and the cooperative agencies on the progress to date; work to be accomplished in the next period; and potential problems of a technical nature or forecasted budget/ schedule requirement. TYLI will coordinate all subconsultants such that they function as team members indistinguishable from direct employees of T. Y. Lin International. TYLI will attend up to 10 meetings. Quality Control Project Management will include an established Quality Assurance/Quality Control (QA/QC) program already utilized on all TYLI projects. Budgets, schedules and progress will be closely monitored and controlled through TYLI's internal system. TYLI will ensure that the project is being developed in accordance with its QA/QC procedures as well as Caltrans' QA/QC Guidelines. Task 1.2 Complete and obtain Caltrans approval on Traffic Study Report: TYLI and its subconsultant, Transtech, will prepare and obtain Caltrans approval on a Traffic Study Report. This report will be prepared based on the latest Caltrans requirements. Deliverables: · Traffic Study Report Task 1.3 Prepare and process Co-op Agreement Report (CAR). TYLI will prepare and process a Cooperative Agreement Report (CAR) based on information provided by the City and Caltrans. Deliverables: . CAR Task 1.4 Revise Geometric Approval Drawings (GAD). The cross section was revised from 36 feet (4' inside shoulder, 2 12' lanes and an 8' outside shoulder) to 39 feet (5' inside shoulder, 2 12' lanes and a 10' outside shoulder). The APS will be incorporated as an attachment in the PSR/PR. Deliverables: . APS Task 1.6 Revise Modified Access Report (MAR) TILl will revise and secure approval on the existing MAR based on the comments on the Traffic Study Report, input from the City on required cross section and incorporating the work required to coordinate with SANBAG's SR-210 project currently in PS&E. Task 2.2 Technical Studies Task 2.2.1 Visual Impact Assessment Report Lilbum Corporation will prepare a Visual Resource Assessment (VIA) based upon the VIA guide prepared by Caltrans. Based upon our initial review and evaluation of the project, we anticipate the brief VIA format will be acceptable to Caltrans. This report format will entail evaluating the project based upon ten criteria contained within the Caltrans guide and reporting the results in memo form. Short-term noise measurements, with concurrent traffic counts, will be made at up to 4 sites. The site selection will focus on the residential uses and commercial uses with outdoor areas of frequent human use along the project's limits. The FHWA's Traffic Noise Model (TNM) will be used for calculations of the Leq noise levels. The future noise exposure for the project will be developed and compared to the existing noise levels. Task 8: Project Management/Coordination Management of the project includes on-going coordination with T.y. Lin International, preparation of memos, and meeting preparation and attendance. In order to maximize our efforts LILBURN CORPORATION Mr. Rodrigo Gonzalez March 13,2007 Page 6 ATTACHMENT "I" to conduct the environmental evaluation and keep the project on track, we propose to attend up to eight meetings with T.y. Lin International and City staff at milestone intervals. Project management also includes interaction with our subconsultants, monitoring of their schedule, and review of their work products. Lilburn Corporation will coordinate with T.y. Lin on the completion of the above tasks. Additional coordination may be required with the USFWS, CDFG, Army Corps of Engineers, and the City. Many of the studies proposed to be performed under this scope of work will require assess to Caltrans property. This access is typically permitted through a Caltrans issucd Encroachment Permit. Lilburn Corporation and their subconsultants will attempt to obtain the necessary encroachment permit in a timely manner. Permit application costs and/or bonding requirement by Caltrans cannot be estimated at this time and therefore will be additional costs billed as a pass through. Schedule We anticipate the field survey portions of this Scope of Work can be completed within six weeks trom authorization to proceed and receipt of authorized Encroachment Permit. Air Quality and Noise Assessment schedules are dependent upon receipt of an approved Traffic Analysis but can be completed within six weeks of said receipt. Poor weather conditions or prohibited access may inhibit the completion of the field studies or unduly affect field observations. We estimate that a budget of $91.000.00 will be required to accomplish the scope of work.
