safety unit represented by the San Bernardino City Professional Firefighters, Local 891.

Resolution #1999-154 implementing a Memorandum of Understanding between the City of San
Bernardino and employees in the fire safety employees' bargaining unit of the City of San
Bernardino represented by San Bernardino City Professional Firefighters, Local 891.
RECOMMENDATION:
I. Adopt resolution; and
2. Approve six (6) firefighter P-I, to begin employment on May I, 2008, ($5,002-$6,337); and
e Authorize the Human Resource Department to update Resolution 6429, Section Three, to reflect this action;
and
4. Authorize the Director of Finance to amend the FY 2007-2008 Fire Department Budget and transfer
$180,000 in salary savings (account #001-202-50XX, salaries & benefits) to Fire Department station
maintenance accounts (account #001-202-5507, Facilities Services).

Resolution adopting Amendment Number One to Resolution No. 2004-82, which is a
Side Letter to Resolution No. 1999-54, for full-time, regular, active fire safety
employees.
BACKGROUND
On June 21, 1999, the Mayor and Common Council approved Resolution #1999-254
authorizing the execution of the Memorandum of Understanding (MOU) between the
City and the San Bernardino City Professional Firefighters Local 891 for full-time,
regular, active fire safety employees. On March IS, 2004, the Mayor and Common
Council approved Resolution #2004-82 adopting a side letter to the MOU. In this side
letter, the city agreed to add twenty-one (21) firefighter positions over a four-year period
beginning in FY 2004/2005.
To date, fifteen (IS) additional firefighter positions have been created through this MOU.
The remaining six (6) positions were originally scheduled, per the MOU, to be hired in
July of FY 2007/08 and July of FY 2008/09 (three (3) in each of the FY's). This side
letter, if approved, will allow the Fire Department to hire all six (6) positions at one time,
May I, 2008. Changing this hiring plan will streamline the training process and generate
savings that can be used to fund critically needed station maintenance projects.

Each year when new positions are established, the Fire Department conducts an extensive
testing and background process. In addition, there is a six-week training and orientation
period for the new employees. The Fire Department has determined that training costs
can be reduced and the hiring process streamlined if all six (6) positions are brought on at
one time (delay hiring of the three (3) positions scheduled for July 1,2007 by ten months
and accelerate hiring of the three (3) positions originally scheduled for July I, 2008 by
two months).
Besides streamlining the hiring and training process, approval of this side letter will
generate approximately $180,000 in salary savings that will be used to fund critically
needed station maintenance projects that the City was unable to fund due to budget
constraints. These needs include the addition of housing areas to Fire Station #224 due to
severe overcrowding.
Recognizing this opportunity to streamline hiring and training, and more importantly
fund critically needed station maintenance projects, the San Bernardino City Professional
Firefighters Local 891 and the City have agreed to modify the timeline for creating the
final six (6) positions. The six (6) firefighter positions (P 1 s), are proposed to be effective
May 1, 2008 and will complete the terms of Article II, Part "A" of the side letter
agreement.

FINANCIAL IMPACT
Included in the Preliminary FY 2007-08 Fire Department Budget is funding to hire six (6)
firefighter positions January I, 2008 (six months of funding for 6 positions). Because
there are a number of urgent fire station maintenance needs that the City was unable to

fund, the San Bernardino City Professional Firefighters Local 891 and the Fire
Department have agreed to delay hiring of the six (6) firefighters until May 1, 2008,
thereby generating approximately $180,000 in salary savings that will be used to fund
station maintenance needs.
A budget amendment is needed to transfer $180,000 in salary savings (001-202-50xx) to
Fire Department building maintenance accounts (001-202-5507). There is no net impact
to the General Fund for this budget amendment.
RECOMMENDATION(S)
1. Adopt resolution; and
2. Approve six (6) firefighter P-l, to begin employment on May I, 2008, ($5,002-
$6,337); and
3. Authorize the Human Resource Department to update Resolution 6429, Section
Three, to reflect this action; and

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO APPROVING AN AMENDMENT TO RESOLUTION NO. 2004-82,
WHICH IS A SIDE LETTER TO RESOLUTION NO. 1999-154, FOR FULL-TIME,
REGULAR, ACTIVE FIRE SAFETY EMPLOYEES.
WHEREAS, the Mayor and Common Council previously adopted Resolution 2004-82.
approving a Side Letter amending Resolution 1999-154, for full-time, regular, active fire safety
employees; and
WHEREAS, Resolution 2004-82. calls for the addition of three (3) firefighters on July I,
2007 (Article II, Section A(3)), and three (3) additional firefighter positions on July 1,2008 (Article
II, Section A(4)); and.
WHEREAS, the City and the San Bernardino Professional Firefighters Local 891, desire to
streamline the hiring and training process for these six new positions;
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 1. The City Manager is hereby authorized and directed to execute on behalf of
said City an Amendment to the Side Letter. previously approved by Resolution 2004-82, modif)'ing
the time line set forth in Article II, Employer-Employee Relations, Sections 18 (A)(3) and 18
(A)(4). A copy of the Amendment is attached hereto and incorporated herein marked Exhibit "A".
