CITY OF SAN BERtaRDINO - REQUEST "R COUNCIL' ACTION STAFF REPORT From: Date: Re: Rachel Krasney, City Clerk January 2, 1991 Request for Council Action - Meeting of January 7, 1991 - Notice of Uncontested Elections On November 26, 1990, the Mayor and Coolman Council adopted Ordinance No. MC-76l adding Sections 2.56.173 and 2.56.175 to the San Bernardino Municipal Code relating to Uncontested Elections. Ordinance No. MC-76l ordains that if, by 5 p.m. on the 63rd day prior to the day fixed for d regularly scheduled nlunicipal election, which is in this case was January 1, 1991, no one or only one person has been nominated for any office which is elected on a citywide basis, the City Clerk shall submit d certificate of these facts to the Mayor and Common Council and inform the Mayor and Common Council that it may, at a regular or special meeting held before the municipal election, adopt one of the following courses of action: (I) Appoint to the office the person who has been nonlinated. (2) Appoint to the office any eligible elector if no one has been nominated. (3) Hold the election if either no one or only one person has been nominated. In accordance with the provisions of said Ordinance, a Notice of Uncontested Elections was published on January 1, 1991. After the fifth day following the date of publication, the Mayor and Common Council may nlake the appointnlent or direct an election to be held. Attached is the Notice of Uncontested Elections which appeared in The Sun. Considering the fact that the City Attorney and City Clerk are unopposed, the Mayor and Common Council may take one of the following courses of action: 1. Appoint City Attorney James Penman and City Clerk Rachel Krasney to four-year terRIS, respectively, beginning June 3, 1991. 2.
