STAFF REPORT
Bids for this project were opened on November 20, 1990,
at 2:00 p.m.
A total of six (6) bids were received and ranged from a
low of $250,420.00 to a high of $406,500.00. The Engineer's
estimate for the work was $284,200.00. The low bid is 11% below
the Engineer's estimate for the work.
Below is a breakdown of the estimated project cost using
the low bid contract price and separated by project area:

downtown locations. Total funds available are $359,000.00.
Staff recommends adoption of the resolution awarding the
contract.

RESOLUTION NO.
2 RESOLUTION
CONTRACT TO PAXIN
3 SAFETY LIGHTING ON
STREET, AND VARIOUS
OF THE CITY OF SAN BERNARDINO AWARDING A
ELECTRIC, INC. FOR INSTALLATION OF HIGHWAY
WATERMAN AVENUE, FROM SECOND STREET TO NINTH
DOWNTOWN LOCATIONS.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS:
6 SECTION 1. Paxin Electric, Inc. is the lowest responsible
7 bidder for: Installation of Highway Safety Lighting on Waterman
8 Avenue, from Second Street to Ninth Street, and Various Downtown
9 Locations, in accordance with Plan No. 8201; and a contract is
10 awarded to said bidder accordingly for the total amount of
11 $250,420.00, but such a\iard shall be effective only upon the
12 contract being fully executed by the parties; all other bids
13 therefore are hereby rejected; and the Mayor is hereby authorized
14 and directed to execute said contract on behalf of the City; a
15 copy of the contract is attached hereto, marked Exhibit "A" and
16 incorporated herein by reference as fully as though set forth at
17 length.
18 SECTION 2. This contract and any amendment or modifica-
19 tions thereto shall "not take effect or become operative until
20 fully signed and executed by the parties and no party shall be
21 bligated hereunder until the time of such full execution. No
22 ral agreements, amendments, modifications or waivers are
23 intended or authorized and shall not be implied from any act or

ourse of conduct of any party.
SECTION 3. This resolution is rescinded if the parties
o the contract fail to execute it within sixty (60) days of the
assage of this resolution.
