On February 6, 1995, the Mayor and Common Council adopted amendments to Resolution 94-46 as relating to time limits on public comments. ECONOMIC DEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO STAFF REPORT Public Comments at Commission MeetinRs On January 10, 1994, the Community Development Commission reviewed and approved the amending of the existing five-minute time limit on public comments and on comments regarding items on the agenda to three~minutes, with possible time extensions of two-minutes. On March 21, 1994, the Community Development Commission referred this matter to the Common Council's Legislative Review Committee for further review, analysis and the development of appropriate recommendations. The Committee made recommendations to the Common Council which amended Resolution 94-46. On May 16, 1994, the Commission adopted as policy the provisions of Resolution 94-46, as amended, relating to time limits for the public to address the Chairman and the Commission. On February 6, 1995, the Mayor and Common Council adopted amendments to Resolution 94-46 regarding a three-minute public comment time limit per agenda item, with a total time limitation for each individual member of the public of fifteen minutes per meeting. However, an appellant or a named party to an agenda item shall not be subject to the time limitations on that item, but shall be subject to reasonable limitations as determined by the Mayor and Common Council. The amendment to Resolution 94-46 further allowed for a consent agenda consisting of items previously heard and considered by a Committee, whereby such items shall not be subject to any discussion by the Mayor and Common Councilor any member of the public. No item shall be removed from the consent agenda for public discussion unless it is removed at the request of the Mayor or a member of the Common Council. The Commission motion, if approved, will adopt as policy for the Commission those amendments of Resolution 94-46 relating to time limits for the public to address the Chairman and the Community Development Commission as adopted by the Mayor and Common Council on February 6, 1995. STAFF REPORT Late last year, the Mayor and Common Council referred the issue of public comments at Council meetings to the Legislative Review Committee. Attached in the proposed amendment to Resolution No. 94-46, which regulates public comments. The City Attorney's office drafted the proposed amendment and feels it meets the new regulations of the Brown Act. The proposed amendment does three things. First, it limits any member of the public to three minutes per agenda item, and that same member of the public is allocated a total time limit per council meeting of fifteen (15) minutes. Second, an appellant or a named party to an agenda item is not subject to the time limitations on that particular item, but can be subject to reasonable limitations determined by the Mayor and Council. Third, the consent agenda will include a section of agenda items that have been previously heard by a council committee, and members of the public cannot remove any of these items from the consent agenda. Since the public had the opportunity to address these issues at the committee level, they no longer have the opportunity to address the issue at the council meeting. The Mayor and councilmembers still have the right to pull any item off the consent agenda. However, once the Mayor or councilmenber has pulled an item off the consent calendar, a member of the public is then able to comment on the item. RECOMMENDATION Adopt resolution. !3
