STAFF REPORT
A box culvert is being constructed at the current dip crossing on "H" Street, North
of Kendall Drive. "H" Street will be widened, and new sidewalk and other street
improvements constructed as a part of this project.
Additional right-of-way will be required on the East side of "H" Street, South of
the Devil's Canyon Diversion Channel to accomodate the planned widening of "H"
Street. Negotiations have been conducted with Robert and Carol Doemner, owners of
this parcel.
The Doemners have signed an easement for the additional right-of-way, subject to
certain terms and conditions. An agreement has been prepared to prescribe the
duties and responsibilities of the Doemners and the City of San Bernardino.
Individual acceptance is necessary for this Easement and Agreement as there are
some conditions and restrictions which will impact the City. Not only will the
Doemner's business (Bob's Auto Electric) be impacted by the street widening portion
of the project, but the business will also be cut off from South bound traffic on
"H" street for as long as 60 days while the box culvert and other drainage improve-
ments are being installed in the Devil Creek Diversion Channel. The only access to
the business will be by driving North from Kendall Drive.
It is proposed that the City of San Bernardino offer the following items of compen-
sation as a condition to the Doemner's execution of the Easement and Agreement.
1. Construction of a four inch (4") sewer lateral from the main sewer line in "H"
Street, to the back edge of the proposed new sidewalk.
2. Installation of a one inch (I") asphalt overlay over approximately 1700 square
feet of the parking lot.
3. A one-time payment of $1500 to compensate for lost business and for additional
advertising costs, during the approximate 60 day blockage of "R" Street, South of
40th Street. Bob's Auto Electric specializes in recreational vehicle service and
repair. The blockage of "R" Street while the box culvert and other improvements
are being constructed or installed will make it difficult for these large vehicles
to access the Doemner's business.
In return, the Doemners have executed and returned an Easement for the additional
dedication needed for "R" Street and as well as a "Right to Enter and Construct"
agreement for the City's access to their property for construction purposes (please
see the attached exhibits). The easement for the street right-of-way is perma-
nent, while the "right to enter" agreement will terminate upon the completion of
the construction work.
Carol Doemner is an employee of the City.
It is Staff's recomendation that the Easement and "Right to Enter" Agreement be
accepted and the documents be executed.
