STAFF REPORT
A request was received by this office, from Tom Tissot, one of the adjoining
property owners, to vacate the "L" shaped alley located North of 29th street
between Pershing Avenue and Arrowhead Avenue. This request represents all but
one of the property owners who live in homes adjoining the area proposed for
vacation. There is one property adjoining the alley which serves as a rental
it is not represented in this request.
On 11-21-94, authorization was given to proceed with the proposed vacation, Plan
No. 9209 was approved, and the East(West section (City-owned portion) of the
alley lying West of Pershing Avenue and North of 29th. Street was declared excess
property. The portion deemed "excess property" will be sold to the adjoining
property owner upon completion of the alley vacation procedure.
All of the affected City Departments and public utility companies were notified
of the proposed vacation on 12-12-94, with a reply due by 01-17-95. The respons-
es are attached for your information. Planning and Building Services indicated
concern regarding access to a carport in the rental house at the North end of the
alley, but they will check to make sure that access is available from Arrowhead
Avenue. This particular property is the rental property described in the first
paragraph. The property owner lives in Highland. The reservation of an easement
for telephone and appurtenant facilities was requested. This easement will be
reserved, as set forth in the attached Resolution of Intention.
All adjacent property owners will be notified of the public hearing by mail, t.he
alley will be posted and the Resolution of Intention will be published 2 times in
the Sun, the first time at I east 15 days prior t.o the public hearing.
On 01-11-95, a Notice of Exemption was filed with the County ROllrd of Super-
visors, and a finding of consistency with the General Plan was made.
The second half of the $1000 fee has been paid.
We recommend that the Resolution of Intention be adopt.ed to set the. public
hearing for the regularly scheduled Council Meeting of 03-20-95.
