Descriotion) Finance: Council Notes: 75-0262 Agenda Item No. 3l./ I' 'I' ~ ~IT~ OF SAN BER.RDINO - REQUEST .R COUNCIL ACTION STAFF REPORT REQUEST FOR WAIVER OF FEES IN THE AMOUNT OF $350 FOR USE OF HERNANDEZ COMMUNITY CENTER FOR ANTI- DRUG AND GANG RALLY. James Elder has applied for the use of Hernandez Community Center on April 9, 1992, to conduct an Anti- Drug and Gang rally. The event is sponsored by a local civic organization known as James Elder's All-American Youth Foundation and will consist of celebrity basketball game and lunch. Mr. Elder also indicates there will be presentations and appearances by various City officials including the Mayor and Common Council, the Chief of Police, McGruff, K-9 unit and the Police Department Gang Suppression Unit. The facility usage is scheduled from 10:00 a.m. to 2:00 p.m. on a Saturday when it is normally closed. Rental costs cover the use of the gymnasium, the assembly rooms A and B and the kitchen and two support staff. Staffing to conduct the activities and programs will be provided by Mr. Elder's foundation. In addition to the rental charges, there is also a $100 refundable clean up deposit that will also be waived if the Council waives the fees. Mr. Elder's request for a waiver conforms to the requirements outlined in Resolution 91-35. This department supports Mr. Elder's efforts to combat drugs and gangs, however, it recommends denying the waiver of fees. This is based on the fact that the center would normally be closed and that the cost to accomodate this use would have to be borne by the department budget. The waiver of the fees for this event and other Park and Recreation facility uses will eventually impede the department in conducting its normal services.
