BACKGROUND: On December II, 200 I, a request was received by this office, to vacate a portion of the east side of the Waterman Avenue frontage road, south of Caroline Street, north of the Union Pacific Railroad. The request came from a representative of The Rock Church & World Outreach Center (The Rock). The Rock is proposing to construct a 2,500 seat sanctuary and associated office and classroom space totaling approximately 129,546 square feet. The design also includes landscaped parking areas, project entries and perimeter landscaping surrounding the buildings. Access to the site will be from the Waterman Avenue frontage road, Caroline Street and Gardena Street. All three entries will have gates, which will be closed during the hours that the facility is not in operation. This strip of land to be vacated also includes a slope area. The City currently owns the area to be vacated in fee, which was acquired by annexation in 1970 from the County. One of the conditions of approval for this development is for The Rock to acquire the vacated area either in fee (complete ownership), by easement or by lease. They have indicated that they desire to lease the vacated area for a period of fifty (50) years. Said lease will be submitted to the Mayor and Council at a later date for approval together with the final resolution ordering the vacation. Representatives from The Rock are asking for a lease amount of $1.00 per year. In exchange, they will assume the cost of installation and continuous maintenance of the landscaped and parking areas which will consist of groundcover and irrigation. On April 15,2002, authorization to proceed and plan approval was submitted to the Mayor and Council for approval, and the matter was tabled. At that time, staff was notified by a representative of The Rock that they were in litigation with Mr. Robert Jennings. Mr. Jennings is the owner of Bob's Automotive, located on the east one-half of Lot 46. They are currently negotiating the access issue to the back of his property across the proposed vacated area and The Rock property. Mr. Jennings uses the back of his property, which abuts The Rock's property, to move cars in and out. In order for Mr. Jennings to be able to have access across the proposed vacated area and The Rock's property, The Rock must grant him an access easement. In the event The Rock and Mr. Jennings can not reach an agreement regarding the access issue, the area marked as Parcel A on the attached map will be vacated, and Parcel B will not be included in the final vacation proceedings. The general location of this proposed vacation is shown on the Vicinity Map, and details are shown on Plan No. 10421. The applicant has paid the required $1,000 processing fee. If authorization to proceed is given, all affected City departments and utility companies will be contacted for the existence of any facilities or conflicts. Any requests for reservation of easements will be reserved in the Resolution of Intention and the Resolution Ordering Vacation, which will be submitted at a later date.
