ECONOMIC DEVELOPMENT AGENCY STAFF REPORT RESIDENTIAL AND BUSINESS RELOCATION PLAN - NORTH ARDEN-GUTHRIE IVDAREDEVELOPMENT PROJECT AREA BACKGROUND: On July 24, 2006, the Mayor and Common Council ("Council") and the Community Development Commission of the City of San Bernardino ("Commission") approved a HUD Section 108 Loan Contract with HUD and authorized the City of San Bernardino (the "City") to make the funds available to the Redevelopment Agency of the City of San Bernardino (the "Agency"). The funds are intended for the purchase of the remaining 24, severely blighted, 4-plex structures located on an approximate 17 -acre site between Highland A venue, 20th Street, Guthrie Street and Arden A venue, commonly referred to as the Arden Guthrie site (the "Site") (See attached map), relocating the tenants, demolishing the structures and making the land available for future commercial development in accordance with the Agreement referred to below. The loan was funded in December 2006. The Commission further approved an Agency Housing Fund Loan to the Site on March 3, 2007, in the amount of$7 million to pay for relocation expenses. On November 20, 2006, the Commission approved a Redevelopment Project Study and Exclusive Right to Negotiate Agreement (the "Agreement") with Home Depot, Inc. (the "Developer"), to redevelop the Site, including a 139,000 square foot Home Depot store, together with ancillary stores and restaurants after the Site has been acquired and cleared by the Agency (the "Project"). On the same day, November 20, 2006, the Commission approved a contract with California Property Specialists, Inc. ("CPSI"), for relocation services for the Site and the preparation of a Relocation Plan for residential displacees affected by the Site acquisitions. California Community Redevelopment Law ("CRL"), Sections 33411 and 33413.5, requires redevelopment agencies to prepare a Relocation Plan for families and persons to be temporarily or permanently displaced from housing and business facilities related to the agencies' redevelopment activities. CURRENT ISSUE: Relocation assistance will be provided to all displacees of the Project in accordance with the standards and provisions of the State of California Relocation Law ("State Law"), Government Code Section 7260, et. seq., and Title 25, Chapter 6, Relocation Assistance, as amended January I, 1998. On March 20, 2007, CPSI completed a draft Relocation Plan. The attached Relocation Plan sets forth a relocation needs assessment for 88 occupants and 24 businesses who will be displaced as a result of the Project. The Relocation Plan sets forth the procedures that the Agency must follow in order to meet the needs of displaced occupants and to ensure compliance with all state and federal laws. Below is a summary of the highlights of the Relocation Plan: . 24 Properties to be acquired (less 8 vacant units) . 96 Units to be acquired . 88 Residential displacements · The City requires that landlords be in possession of a City Business License for each rental property which classifies them as a Business. This is not a lump sum reimbursement and cash disbursements are only made to businesses on a reimbursement basis for actual documented costs that were incurred. . Residential tenants are entitled to rental assistance of up to 42 months ($5,250 for tenants or the difference between the existing rent and a comparable unit and the ability to pay) and residential homeowners are entitled to purchase assistance up to $22,500, in addition to actual reasonable moving expenses; or a fixed moving expense payment. . The draft Relocation Plan documents that there is currently a sufficient supply of rental properties for residential displacees and as a result, the Agency will not have to provide last-resort-housing as required under law and no displacee is required to vacate their housing unit without a minimum of a 90-day written notice and until they have located a safe, decent and sanitary replacement home. . All displacees will be provided with relocation advisory assistance, replacement housing referrals, assistance with the preparation of all relocation claim forms, etc. by CPSL Per Section 6038 of Chapter 6, a 30-day public review period prior to approval of the Relocation Plan by the Commission is required; therefore, each tenant at the Site received a hand-delivered notification on March 22, 2007, informing them that a draft Relocation Plan was available for their review at the offices of the Agency and the San Bernardino Central Library. No comments were received. . ENVIRONMENTAL IMPACT: None. FISCAL IMPACT: The anticipated cost of the relocation for residential tenants, owners and businesses is estimated at $2 million. The actual amount will depend upon individual circumstances of tenured occupants and businesses. The relocation expenses associated with this Site will be funded from the Agency Housing Fund and the Section 108 Loan Funds. GENERAL INFORMATION The Redevelopment Agency of the City of San Bernardino ("Agency") proposes to adopt a Relocation Plan for the Arden Guthrie Project ("Project"). The Project area includes parcels located between the boundaries of Highland Outer Highway South and E. 20th Street, and between Guthrie Street and Arden Avenue. The site consists of approximately 17 acres of which the Agency owns more Ihan 50% of the vacant parcels. There are 25 four-plex units and 2 vacant lots that the Agency intends to acquire. The Agency intends to keep the stakeholders, residents, and landlords (businesses) informed during the process of the design and construction for the planned improvements. Figure 1 project area. The Agency in cooperation with Home Depot, Inc., a Delaware Corporation ("Developer") and Mr. Scott Beard and Mr. Mark Sandoval ("Co-Developer") propose to build a new 139,000 square foot Home Depot, which would be in addition to their two existing stores already located in the San Bernardino area. The developer is also reviewing a development plan that may be combined with the Home Depot center that would create a soccer complex, youth-oriented retail businesses and restaurants. Inc. 4 I I I I I I I I I I I I I I II I I I I Impacts related to the redevelopment project include the potential displacement of existing residential uses, landlord (business) opportunities. and potential short-term construction impacts relating to circulation, noise, dust and utility relocation. However, mitigation efforts will be implemented in conformance to the California Environmental Quality Act statutes. The Relocation Plan was completed by California Property Specialists, Inc. and is organized into seven sections as follows: I. General Information II. Project Location and Description III. Attachments and Exhibits PURPOSE OF THE RELOCATION PLAN The purpose of the Relocation Plan is to provide the Agency with information about the impact of the proposed Arden Guthrie Project on the residential and business occupants to be displaced. More specifically, the limits and primary objectives of the Plan are as follows: 1. Conduct a survey of relocation needs of the occupied households and businesses (landlords) displaced by the proposed Project. 2. Perform an analysis of the relocation needs to determine location factors and characteristics required in identifying comparable replacement housing sites. The replacement housing sites should exhibit: a. Equivalency to the displacement unit. b. Compliance with applicable local housing codes. c. Provision of decent, safe and sanitary housing. d. Affordability to the displaced person. e. Availability in an area, which is compatible with the housing needs and location factors established in the survey. f. Available on the market. Available to displacees without regard to age, race, color, religion, sex, marital status or national origin. 3. Conduct a survey and analysis of available relocation resources. This survey will aid in determining whether comparable replacement resources are available to the affected residences and businesses (landlords). 4. Outline the Agency's relocation procedures, funding sources and time frame for relocation activities. This is to ensure that uniform, fair and equitable treatment is provided to all displacees of the proposed Project. 5. Determine the needs of displacee as well as the potential costs to effectively relocate the displacee within the Project. 6. Determine any need for a Last Resort Housing plan for relocation of any household that will require financial assistance beyond the limits set by the state and federal statutes. NEIGHBORHOOD OUTREACH The Agency intends to notify all property owners and occupants within the project area the plan. It will be made available for review and comments in accordance with state guidelines. The Agency will determine the necessity of neighborhood outreach meetings during the relocation process. If appropriate, at that time, the Agency and/or their representatives will coordinate and conduct community outreach meetings. CITIZEN PARTICIPATION The Plan has been prepared in accordance with California Relocation Assistance Law ("CRAL") (Government Code 7260) and the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended ("URA") the Agency will ensure the following: 1. Timely and full access to all documents relevant to the relocation program. The Agency will only restrict access where confidentiality is protected by law or its disclosure is prohibited by law. 2. Provide technical assistance necessary to interpret elements of the relocation plan and its pertinent materials. 4. A general notice of the Relocation Plan shall be provided to all displacees in the proposed Project area. The draft Relocation Plan will also be available for public review for 30 days and distributed to interested citizen groups, local public agencies for review and comment. 5. Copies of the Relocation Plan shall be available for review within 30 days prior to final approval and adoption by the Agency of San Bernardino. The 2005 U.S. Census reported an unemployment rate 6.3%. The Census also identified 19,662 housing units in the study area, and a 2.1 % vacancy rate. The City of San Bernardino is part of the County of San Bernardino and has an ethnically diverse population of 1,916,665 Figure 4 below represents the average household size, number of families, total households and total population in comparison between the City and County of San Bernardino. ASSESSMENT OF RELOCATION NEEDS SURVEY METHOD To gather the necessary information for the Relocation Plan, door-to-door surveys were conducted with tenants and owner-occupants within the project area during the month of December of 2006. There are a total of twenty-five (25) four-plexes consisting of one hundred (100) units in the project area, however at the time the surveys were completed, eighteen (18) units were vacant. Surveys were completed on seventy one (71) of eighty-two (82) residential households equating to an eighty-five (86.5%) rate. There are twenty-five (25) property owners that will be treated as landlord (businesses), one of which is an owner-occupant who may receive a replacement housing payment in addition to any business benefits they may qualify to receive. The surveys were conducted in English and Spanish to facilitate the understanding of the questions and the respondent's self expression. (Refer to Section VIII, Exhibit A for sample Relocation Interview Forms.) The residential occupants were asked about the number of occupants, size of unit, length of occupancy, disabilities or special needs, household income, desired area for a replacement dwelling, etc. The information provided by the occupants has not been verified by supporting data and is solely based on verbal information, which is sufficient for the purpose of completing the Relocation Plan. RESIDENTIAL DATA AND NEEDS ASSESSMENT FIELD SURVEY DATA The households are composed of eighty-one (81) tenant-occupied dwellings, and one (1) owner-occupied dwelling. From the seventy (70) respondent households thirty-five (35) are of Hispanic or Latino origin (50%), twenty-six (26) are African American (37.14%), seven (7) are White (10%), one (1) is Chinese (0.1%) and one (1) is Middle Eastern (0.1 %). The Project area population, based on information gathered in our survey, is composed of one hundred sixty-seven (167) adults and one hundred sixty- two (162) minors. Table 1 below shows the number of bedrooms per housing unit. PROJECT AREA RENTS The average monthly rent paid for a two-bedroom unit in the project area is approximately $725.00. Table 2 below itemizes the ranges paid for monthly rent (including government assistance), based on bedroom count. Refer to Exhibit D for additional details. REPLACEMENT HOUSING NEEDS Replacement housing needs for tenant occupants are based on the ratio of total household's occupants to number of bedrooms. The HUD standard for the maximum number of occupants for a one-bedroom dwelling is three (3) persons; for a two- bedroom up to five (5) persons, and for a three-bedroom (3) up to seven (7) persons. Referrals provided to any potential displacee will reflect the appropriate bedroom count as required by government regulations and Agency standards. Table 3 below illustrates the number, type and dwelling size required to accommodate the Project area households, based on current number of occupants. Thirteen (13) households reported having at least one person with disabilities including: mentally disabled, in a wheelchair, and other physical disabilities. NON-RESIDENTIAL DATA AND NEEDS ASSESSMENT There are twenty-five (25) property owners that are considered landlord businesses and may be eligible for certain business relocation benefits. They may qualify for a moving payment if they are required to move personal property from the subject properties, a site-search payment (not to exceed $2,500) for reimbursement of their time in searching for a replacement property, and up to $10,000 as reimbursement for a re-establishment payment. RELOCATION RESOURCES The Agency's relocation consultants conducted on-site interviews and evaluated each potentially impacted residential dwelling and business (landlords) in the Project area, to assess the need and requirements for a replacement site. The information was the basis of an extensive resource survey conducted over a period of four weeks during January 2007. To determine the availability of replacement housing and commercial replacement sites, the following sources were utilized: . Windshield/drive-by surveys conducted in San Bernardino and surrounding communities . Classified rental listings from local newspapers and For Rent publications . Multiple-Listing Services . Internet resources . Property Management Offices The subject dwellings are very similar four-plex properties. They are grouped t0gether as a community. Therefore the replacement housing survey looked at all types of potential replacement dwellings, apartments, condominiums, townhouses, four-plexes, duplexes and single family homes. The research encompassed dwellings for rent only. Search efforts were generally contained within a 10-mile radius of the Project area. RESIDENTIAL PROPERTY FOR RENT Replacement housing research data indicates an adequate supply of rental properties available to residential displacees. The survey identified a total of one hundred fifty-five (155) available two, three, four plus bedroom rental units located within San Bernardino or other similar localities nearby. Specific replacement housing data in and around the City of San Bernardino is summarized in Table 5 below. The information available on rental housing in the area is included as a general representation of available sites. As with any resource survey, results reflect conditions at a given point in time, and mayor may not be available at the time of displacement. While adequate replacement sites are available, based on survey results, current rents paid by displaced occupants will likely increase. Rent increases will be met through the Agency's obligation under the relocation program, including Last Resort Housing requirements. (See Exhibit G.) The Agency will assist each household in relocating into comparable replacement housing. In accordance with State and Federal Guidelines, any replacement housing approved by the Agency must meet decent, safe and sanitary housing requirements. In order to meet these standards, a replacement site must contain the following criteria: . Be structurally sound; weather tight and in good repair. . Contain a safe electrical wiring system adequate for lighting and other devices. . Contain a safe heating system capable of sustaining a reasonable temperature. . Be adequate in size with respect to the number of rooms and area of living space needed to accommodate the displaced household. . Contain unobstructed egress to safe, open safe at ground level. If the dwelling unit is on the second story or above, with access directly from or through a common corridor, the common corridor must have at least two means of egress. . For a person who is not mobile or impaired, be free of barriers which would restrict reasonable ingress, egress, or use of the dwelling. COMPETING PROJECTS The City of San Bernardino was contacted regarding any other projects within the City that would impact the available inventory for replacement sites including the Development Services Department. Although there are several small projects within Prepared by California Property Specialists, Inc. 17 I I I I I I I I I I I I I II I I I I I the community it has been determined that they will not impact the replacement needs of the potential project displacements because they are mostly commercial displacements.. Thus, no adverse impact is anticipated with the proposed Arden Guthrie Project. SUMMARY Comparing the available replacement resources to the project displacement needs, it appears that there are adequate replacement sites available for all residential occupants. Therefore, the relocation assistance. needs for the Arden Guthrie Project will not require any special consideration, other than Last Resort Housing for residential occupants. ALTERNATE HOUSING PROGRAMS Section 8 housing vouchers are granted by the County of San Bernardino Housing Authority when available to qualified low and moderate income families, seniors and disabled persons to secure suitable and affordable housing. The Agency does not have its own housing authority among its various departments, but its residents fall under the jurisdiction of the housing authority. Currently the county housing authority has exhausted its vouchers, and the program's waiting list has been on hold since June 1, 2004, and until further notice. Nonetheless, one of the functions of the relocation program is to provide qualified displaced households rental assistance for the incurred increase rent for a period of forty-two (42) or sixty (60) months depending on the household's financial means, number of occupants and available replacement properties. Therefore, the scope of assistance provided by the relocation program through the Agency should meet the displacement needs. TEMPORARY HOUSING NEEDS The Agency does not foresee a need for temporary housing as a result of Project acquisitions or relocation requirements. However, should such a need arise, the Agency will respond appropriately and in conformance with applicable laws, regulations, and guidelines. RELOCATION ASSISTANCE PROGRAM The Agency will be providing a comprehensive Relocation Assistance Program to all families and businesses (landlords) displaced by Arden-Guthrie Project within the IVDA Redevelopment Area. The Agency's Relocation Program is designed to minimize hardship and be responsive to unique project circumstances. Services will be provided in such a manner to ensure that consistent and equal treatment of displacees, without regard to race, nationality, color, religion, national origin. sex, marital status, family status or disability. California Property Specialists, Inc, ("CPSI"), has been retained by the Agency to implement the Relocation Program. Bi-lingual (English/Spanish) relocation representatives will be available to assist all displaced households. ADVISORY SERVICES Individuals moving from existing homes or business (landlords) sites, as a result of the Agency's Project will receive advisory assistance, including the following: . Information about the relocation program. . Help with the process of locating replacement housing. . Assistance with the necessary claims process. To follow through on a comprehensive advisory assistance program and assure that the Agency meets its obligations under the law, relocation staff/consultant will perform the following functions: 1. A General Information Notice ("GIN") will be sent to all occupants who will be displaced. (See Exhibit E & F) 2. Provide a written informational brochure explaining the Agency's relocation program. (See Exhibit G and H) 3. Determine of needs of each residential. and business (landlords) displacee, eligible for relocation assistance. 4. Provide displacees with referrals to comparable replacement properties with a reasonable time prior to displacement. 5. If necessary, provide transportation for displacees to inspect replacement sites. 6. Provide reasonable services necessary to successfully relocate residential and businesses (landlords) being displaced by the Project. 7. Assure that no occupant is required to move without a formal written "90-day Notice to Vacate" the premises letter. 8. Establish and maintain a formal grievance or appeals procedure for use by displacees regarding any Agency decision regarding relocation assistance. Prepared by California Property Spedalists. Inc. 20 I I I I I ~ I I I I I I I I II .1 I I I I RELOCATION BENEFITS TO RESIDENTIAL OCCUPANTS The Relocation Benefit Program will help eligible occupants by paying reasonable costs and expenses to relocate to a replacement site in accordance with applicable relocation guidelines. These costs are limited to those necessary for the rental or purchase of a comparable replacement property and the moving costs of personal property. In the course of personal interviews and follow-up visits, each displacee will be counseled as to available options and the consequences of any choice with respect to financial assistance. Moving costs and relocation benefits will be paid to eligible displacees upon submission of required claim forms and documentation in accordance with the CRAL, URA, CFR and the Agency's administrative procedures ("Regulations"). These may include: MOVING EXPENSE PAYMENTS Any eligible displaced person who lawfully occupies the property being acquired, regardless of the length of occupancy, will be eligible for reimbursement of moving costs associated with property located at the displacement site. Displacees will receive either a fixed moving payment based on a room count schedule or actual cost associated with a professional move. A. Fixed Moving Payment (Room Count Schedule) The displacee, while taking the responsibility for the move, may elect to receive a fixed moving payment for a self-move based on a room count of furnished rooms in the displacement dwelling. The fixed moving payment is a one-time, allowance for a self- move that does not require back-up documentation. The current schedule for fixed moving payments is set forth in Table 6. Actual Cost (Professional Move) The displacee may elect to retain the services of a licensed professional mover, in which case the Agency will pay for the actual cost of the move within a 50-mile Project radius, based on the lower of two acceptable moving bids. After the move is complete, the displacee may pay the mover directly and seek reimbursement from the Agency or request a direct payment to the mover. RELOCATION BENEFITS TO OWNER-OCCUPANTS Sometimes, an owner-occupant displaced from their dwelling may have to pay more to purchase a comparable replacement dwelling than they received for the purchase price of their existing dwelling. The increased cost may be due to a limited number of available replacement housing in the area or the need to improve the quality of housing to meet minimal acceptable housing standards. Under this scenario, the owner- occupant will be eligible for a Replacement Housing Payment provided they have owned and occupied their property for at least 180 days prior to the first written offer by the Agency to purchase the property. The Replacement Housing Payment of up to $22,500 will be determined on the basis of three separate components: . Purchase Price Differential . Incidental Expenses (Closing Costs) . Increased Mortgage Rate Payment Differential PURCHASE PRICE DIFFERENTIAL Once the fair market value of the dwelling being acquired by the Agency is determined, an analysis of the existing housing market is made to determine the costs of a comparable replacement dwelling. The difference between the price received for the existing dwelling and the purchase price of a comparable replacement dwelling is determined to be the Purchase Price Differential. For example, if the existing owner- occupant's dwelling is valued at $400,000 and it is determined that a "comparable" replacement dwelling is available for $410,000; the maximum Purchase Price Differential payment would be $10,000. In order to receive the $10,000 Purchase Price Differential payment, the owner-occupant must purchase and occupy a decent, safe and sanitary dwelling costing at least $410,000. If the replacement dwelling costs less than $410,000, the Purchase Price Differential payment would be reduced to reflect the Prepared by California Property Speciali.~ts, Inc. 22 I I I I I I I I I I I I I I I II I I I actual difference between the cost of the dwelling being acquired by the displacee and the price paid for the dwelling by the Agency. Since all of the properties being acquired by the Agency consist of 4-unit buildings, a replacement housing payment will be based on the occupancy unit square footage. INCIDENTAL EXPENSES (CLOSING COSTS) As a part of the costs associated with the purchase of a replacement dwelling, certain expenses are generally incurred. These include, but are not limited to: inspection fee, appraisal fee, title and escrow fee, recording fee, loan processing fee, and cost for credit report. These one-time fees associated with purchasing a replacement dwelling are reimbursable to the owner by the Agency. These expenses must be typical and reasonable, based on the market and as determined by the Agency. They must also be actually incurred and documented on a Final Closing Statement supplied by the escrow or title company. Recurring costs such as real estate taxes, insurance and association dues are not eligible as reimbursable costs. INCREASED MORTGAGE RATE DIFFERENTIAL PAYMENT In some cases, an owner-occupant being displaced will find current market interest rates or program costs exceed their existing program. The Regulations provides for a payment to enable the displacee to reduce their replacement mortgage balance to the level of the existing mortgage payment and remaining term, computed using the replacement mortgage interest rate. This payment is meant to compensate homeowners for the loss of favorable financing. RELOCATION BENEFITS TO TENANT-OCCUPANTS Residential tenants who have established their residency in the displacement dwelling at least 90 days prior to the first written offer by the Agency, for the property acquisition, may be eligible to receive a Rental Assistance Payment ("RAP"), in addition to a payment for moving expenses. Payment to residential tenants are determined on the basis of their current rent, their ability to pay, household occupants, market rent of a comparable replacement dwelling and actual rent of the replacement unit plus any estimated cost increase for utilities. Except in the case of "Last Resort Housing" situations and, pursuant to the Regulations, any Rental Assistance Payment is limited to a maximum of $5,250. Prepared by Cal!fornia Property Specialists, Inc. 23 I I I I I I I I I I II I I I I I I I I RELOCATION ASSISTANCE UNDER SECTION 104(d) Under section 104(d) each "displaced person' is entitled to choose either assistance at URA levels or the following assistance: . Advisory services, . Payment for moving and related expenses. The displaced person may choose either: 1, A payment for actual reasonable moving and related expenses. 2. A moving expense and dislocation allowance based on a schedule. (see table 6) The reasonable and necessary cost of any security deposit required rent the replacement dwelling unit, and any credit checks required to rent or purchase the replacement dwelling unit. Interim living costs. The person shall be reimbursed for actual reasonable out-of- pocket costs incurred in connection with temporary relocation, including moving expenses and increased housing costs, if: . The person must relocated temporarily because continued occupancy of the dwelling unit constitutes a substantial danger to the health or safety of the person or the public, or . The person is displaced from a "Iow/moderate-income dwelling unit," none of the comparable replacement dwelling units to which the person has been referred qualifies as a low/moderate-income dwelling unit and a suitable low/moderate- income dwelling unit is scheduled to become available in accordance with 24 CFR 570.496( c )(1) or 570.606( c )(1). Note: A comparable replacement dwelling unit may have a market rent that exceeds the Fair Market Rent under the Section 8 Existing Housing Program (i.e., it is made affordable to the person through rental assistance payments). If so; the unit does not meet the definition of a "Iow/moderate-income dwelling unit." Replacement housing assistance under section 104(d), the displaced person is eligible to receive one of the following: . Rental Assistance: Each person must be offered rental assistance equal to 60 times the amount obtained by subtracting the Total Tenant Payment from the lesser of: Prepared by California Property Specialists, Inc. 24 I I I I I I I I I I I I I I I I I I I I. The monthly Rent and estimated average monthly cost of utilities for a comparable replacement dwelling; or II. The monthly rent and estimated average monthly costs of utilities for the decent, safe and sanitary replacement dwelling to which the person relocates. . All or a portion of this rental assistance may be offered (if it is available in accordance with the Public Housing Authority HUD-approved tenant selection preferences) through a certificate or housing voucher for rental assistance provided through the Public Housing Agency (PHA) under Section 8 of the United States Housing Act of 1937, as amended. Generally, a Section 8 housing voucher may be issued only to a very low-income person. . Purchase Assistance I. If the displaced person purchases and interest in a housing cooperative or mutual housing association and occupies a decent, safe and sanitary dwelling in the cooperative or association, the person may elect to receive a lump sum payment. This lump sum payment shall be equal to the capitalized value of 60 monthly installments of the amount that is obtained by subtracting the "Total Tenant Payment," from the monthly rent and estimated average monthly cost of utilities for a comparable replacement dwelling unit. II. To compute the capitalized value, the installments shall be discounted at the rate of interest paid on passbook savings deposits by a federally insured bank or savings and loan institution conducting business in the jurisdiction. III. To the extent necessary to minimized hardship to the person, the Agency shall subject to appropriate safeguards, issue a payment in advance of the purchase of the interest in the housing cooperative or mutual housing association. . Total Tenant Payment. The Total Tenant Payment is the highest of: I. 30 percent % of the persons' monthly adjusted income II. 10 percent % of the person's monthly gross income III. The designated allowance for renUutility costs, if the person is Prepared by California Property Specialists, Inc. 25 I I I I I I I I I I I I I I I I I I I receiving welfare assistance form a public agency and a part of such assistance, adjusted in accordance with the person's actual housing costs, is the specifically designated by the public agency to meet the person's rent and utility costs. Ability to Pay $650 I 30% of Qross household income $650 I Yields Base Rent Subtract Base Rent From The Lesser Of: 4. Comparable Rent $800 I Replacement site plus utilities OR 5. Actual Rent Paid $750 Actual new rent plus utilities $750 Yields New Rent Factor Rental Assistance Payment 6. Monthly Need $100 Rent Factor minus Base Rent Payment $4,200 Monthly Need multiplied by 42 months Alternate Payment $6,000 If Displacee qualifies under 104(d) x 60 months Tenants may choose and are encouraged by the Agency to use this payment towards a down payment allowance when electing to purchase a replacement home. This applicable rental differential payment may be applied towards the purchase of a replacement dwelling and nonrecurring closing costs. Tenants who qualify for 60 months of assistance and who decide to purchase rather than rent will be reduced to the URA standard of 42 months of assistance, which can be applied towards the purchase of a replacement dwelling. LAST RESORT HOUSING The Regulations contain policies and procedures for implementing a Last Resort Housing Program. This program is authorized by statute if affordable replacement housing cannot be found within the basic statutory relocation amount of $5,250 for tenants and $22,500 for owner occupants. Based on the results of our survey, a majority of the households in the Project area will qualify for Last Resort Housing. The following is the recommended course of action for the Project displacees and a summary of their entitlements for replacement housing: Prepared by California Property Specialists. Provide additional rent supplements above the statutory amount of $5,250, with payments being made toward the rent differential or down payment to purchase a replacement site. . If required, provide 180-day owner-occupants with additional funds above the maximum $22,500 to purchase a comparable dwelling. . Assistance beyond the 42 months to 60 months if household qualifies under the 1 04(d) program. RELOCATION BENEFITS TO NON-OCCUPANT/OFF-SITE OWNERS (BUSINESS) There are twenty-five (25) non-occupant owners of investment property potentially affected by the Project's proposed acquisitions. These owners lease their space within the Project boundaries to residents occupying the area. The Agency considers these owners business displacements, and thus may be eligible to receive a payment for moving personal property, site searching costs as follows: . ADMINISTRATIVE PROVISIONS PROJECTED DATES OF DISPLACEMENT No displacee will be required to vacate without a minimum of a 90-day written notice. However, an occupant in the Project area may choose to vacate prior to the issuance of a "90-Day Notice to Vacate" once they receive their Notice of Eligibility and are assured that they will receive relocation assistance. The Agency anticipates that Notices to Vacate will be issued in March 2007. ESTIMATED RELOCATION COSTS The estimated relocation budget is based on the data obtained through occupant interviews, current Project scope, available replacement sites, estimated relocation costs, including last resort housing, and the experience and judgment of CPSI staff. The estimated relocation budget does not include any payment for property acquisitions, or professional fees necessary to implement the Relocation Assistance Program. THE ESTIMATED RELOCATION COSTS FOR THE PROJECT IS: ESTIMATED TOTAL $2,000,000.00 The Agency pledges to appropriate, on a timely basis, the funds necessary to ensure the successful completion of the Project, including funds necessary for Last Resort Housing, as indicated in Section V., Part B of the Relocation Plan. NOTICES Any official notice that the Agency is required to provide a Project occupant shall be personally delivered or sent by certified or registered first-class mail, return receipt requested. Notices will be written in understandable language, and persons unable to read or understand any notice will be provided translation and counseling. Notice of Relocation Eligibility 4. 90-Day Notice To Vacate The General Information Notice and Relocation Brochure is intended to provide potential displacees with a description of the Agency's relocation program, eligibility criteria, information regarding potential financial assistance, and appeal rights. The Notice of Relocation Eligibility will contain a determination of eligibility for relocation assistance and a description or itemization of potential entitlement benefits. No lawful occupant, affected by this Project, will be required to move without having received at least 90 days advance written notice of the earliest date by which the move will be necessary. The 90-Day Notice will either state a specific date or state that the occupant will receive a further notice indicating at least 60 days in advance, the specific date required to move. A 90-Day Notice will not be issued to any residential displacee without first being given information regarding an available replacement dwelling. LANGUAGE ASSISTANCE (ASISTENCIA DE LENGUAJE) Language assistance will be available for occupants who do not understand or speak English. RELOCATION APPEAL PROCESS A person, who disagrees with a determination as to the eligibility of benefits, a payment amount, failure to provide comparable replacement site referrals, or the Agency's property management practices, may file a request for a review and/or appeal in accordance with The Redevelopment Agency of The City of San Bernardino Grievance Procedures. Eviction will only take place in cases of illegal occupancy, nonpayment of rent, serious violation of the rental agreement, a dangerous or illegal act in the unit, or if the occupants refuse all reasonable offers to alternate accommodations. In all cases, relocation records must be documented to reflect the specific circumstances surrounding the eviction. This includes any family or individual that must move as a direct result of rehabilitation, demolition or acquisition for a project in which Federal funds are used. If you are notified that you will be displaced, it is important that you do not move before you learn what you must do to receive the relocation payments and other assistance to which you may be entitled. This booklet may not answer all of your questions. How Will The Agency Know How Much Help I Need? You will be contacted at an early date and personally interviewed by a representative of the Agency to determine your relocation needs and preferences for replacement housing and advisory services. The representative will ask certain questions about you and other members of your household, including questions about your income. It is to your advantage to provide the information so that the Agency can assist you in moving with a minimum of hardship. The information you give will be kept in confidence. How Soon Willi Have To Move? If possible, a mutually agreeable date for the move will be worked out. You will be given enough time to make plans for moving. Unless there is a health or safety emergency, you will not be required to move without at least 90 days advance written notice of (1) at least one "comparable replacement home" that is available to you and (2) the earliest date by which you must move. What Is A Comparable Replacement Home? A comparable replacement home is: . Decent, safe, and sanitary. . Functionally equivalent to your present home. . Actually available for you to rent. . Affordable. . Reasonably accessible to your place of employment. . Generally as well located with respect to public and commercial facilities, such as schools and shopping, as your present home. . Not subject to unreasonable adverse environmental conditions. . Available to all persons regardless of race, color, religion, sex, or national origin. What is Decent, Safe, and Sanitary Housing? Decent, safe, and sanitary housing is housing that: . Meets applicable housing and occupancy requirements, . Is structurally sound, weathertight, and in good repair. . Meets standards protecting occupants from lead-based paint hazards. . If you are person with a physical disability, is free of any barriers which would preclude your reasonable use of the unit. Will The Agency Help Me Find A Replacement Home? Yes. You will be provided with referrals to housing that has been inspected to ensure that it meets established standards. If possible, you will be referred to at least three comparable replacement homes. The maximum financial assistance for which you may qualify will be based on the cost of the most representative comparable replacement home that is available to you. Promptly after you become eligible for relocation assistance, the Agency's representative will inform you of such unit and the maximum payment available. Once the Agency's representative has a clear understanding of your needs and preferences, he or she will work with you to assure that you are given the best possible choice of housing. The Agency's representative will offer you appropriate transportation to inspect these units, if necessary. What If I Find My Own Replacement Housing? You have every right to find your own replacement housing, However, before you rent or buy, ask your representative to inspect the unit to make sure that it is decent, safe, and sanitary. If the housing unit is not decent, safe, and sanitary, you will not receive a replacement housing payment. What If I Encounter A Problem In Obtaining Housing Of My Choice? If you encounter a problem in buying or renting housing of your choice, notify the Agency's representative immediately. The Agency's representative will look into the matter and try to resolve it. You will receive this help whether you were referred to the housing unit or found it yourself. What Other Services Willi Receive? In addition to help in obtaining a comparable replacement home, other assistance, as necessary, will be provided in order to minimize the impact of your move. This assistance may include referral to appropriate public and private agencies that provide services concerning housing financing, employment, health, welfare, or legal assistance. The range of services depends on the needs of the person being displaced. Inc. 47 I I I I I I I I I I I I I I I I I I I What Is a Payment For Actual Reasonable Moving and Related Expenses? You may choose to receive a relocation payment to cover the reasonable cost of your move. If you choose a Payment for Actual Reasonable Moving and Related Expenses, you may include in your claim the reasonable and necessary costs for: . Transportation for you and your family. . Packing, moving and unpacking your household goods. . Disconnecting and reconnecting household appliances and other personal property (e.g., telephone and cable TV). . Storage of household goods, as may be necessary. . Insurance for the replacement value of your property during the move and necessary storage (if necessary). The Agency's representative will explain all eligible moving costs, as well as those which are not eligible. You must be able to account for any costs that you incur, so keep all your receipts. Select your mover with care. The Agency's representative can help you select a reliable and reputable mover. You may elect to pay your moving costs yourself and be repaid by the Agency or, if you prefer, you may have the Agency pay the mover. In either case, let the Agency's representative know before you move. What Is A Fixed Moving Expense And Dislocation Allowance? If you choose a Fixed Moving Expense and Dislocation Allowance, you will receive an allowance which is based on the number of rooms in your home or the number of rooms of furniture you will be moving, as shown on a schedule. The Agency's representative has a copy of the schedule and will help you decide whether choosing this allowance is in your best interest. If you do not have a large amount of personal property to move, this payment should be more advantageous. No special documentation is required to support your claim. You need only move your personal property and complete the appropriate claim form in order to receive your payment. How Much Rental Assistance Willi Receive? You may be eligible to receive Rental Assistance for a 42-month period. The assistance is computed in the following manner: The assistance needed for one month is determined by subtracting the "base monthly rent" for your present home from the cost of rent and utilities for your new home (or a comparable replacement home, if that cost is lower). That monthly need, if any, is multiplied by 42, to determine the total amount that you will receive. This amount will be paid directly to you. The Agency must provide the assistance in monthly installments or other periodic payments. Generally, the base monthly rent for your present home is the Prepared by California Property Specialists. Inc. 48 I I I I I I I I I I I I I I I I I I II lesser of: (1) the monthly rent and average monthly cost for utilities, or (2) thirty (30) percent of your average monthly gross household income, if you are low-income based on HUD income limits. To qualify for rental assistance, you must rent and occupy a decent, safe, and sanitary home within one year after the date you move. However, the Agency will extend this period for good cause. If I Decide to Buy, Rather Than Rent, How Much Assistance Willi Receive? If you buy a replacement home, you may be eligible for assistance to make a down payment equal to the amount you would receive if you rented a comparable replacement home. A down payment assistance payment will be paid in a lump sum. Must I File A Claim To Obtain A Relocation Payment? Yes. You must file a claim for each relocation payment. The Agency will, however, provide you with the required claim form, help you to complete it, and explain the type of documentation, if any, that you must submit in order to receive the payment. If you must pay any relocation expenses before you move (e.g., a security deposit when you sign a lease for your new home), discuss your financial needs with the Agency's representative. While refundable deposits are not covered, you may be able to obtain an advance payment to meet these costs. An advance payment may be placed in "escrow" or paid directly to a contractor to ensure that the move will be completed on a timely basis. You must file your claim within 18 months after the date you move. However, it is to your advantage to file as soon as possible after you move. The sooner you submit your claim, the sooner it can be processed and paid. If you are unable to file your claim within 18 months, ask the Agency to extend this period. Be careful not to confuse this 18-month period with the 12-month period within which you must rent (or buy) and occupy a replacement dwelling in order to be eligible for a replacement housing payment. You will be paid promptly after you file an acceptable claim. If there is any question regarding your right to a relocation payment or the amount of the payment, you will be notified, in writing, of the problem and the action you may take to resolve the matter. Willi Have To Pay Rent To The Agency Before I Move? If the Agency acquires the property in which you live, you may be required to pay a fair rent to the Agency for the period between the acquisition of the property and the date that you move. Such rent will not exceed the market rent for comparable properties in the area. No. Section 216 of the URA states that you do not need to report relocation payments as part of your gross income for Federal tax purposes. What If I Don't Receive The Required Assistance? Can I Appeal? If you disagree with the Agency's decision as to your right to relocation assistance or the amount of a payment, or the adequacy of the housing to which you have been referred, you may appeal the decision to the Agency. The Agency's representative will inform you of its appeal procedures. At a minimum, you will have 60 days to file your appeal with the Agency after you receive written notification of the Agency's determination on your claim, Your appeal must be in writing. The appeal process is initiated by a person who is being displaced requesting appeallreview in a letter addressed to the Agency Executive Director. The letter shall state reasons the person who is being displaced believes an error or omission has occurred, and the nature of the error or omission. The Agency acquisitionlrelocation consultant will assist the person who is being displaced in preparation and submittal of the Letter of Request of Appeal. The consultant will provide information and assist in composition of the letter so that the request is in a format that identifies the specific area of appeal. 2. Upon receipt of the Letter of Request of Appeal, a Reviewer, designated by the Agency will (1) review the complete relocation file of the person who is being displaced; (2) review all of the benefit calculations and supporting data; (3) review any noted or claimed extenuating circumstances associated with the relocation; and (4) review the written appeal request. The Reviewer will be the Agency Executive Director or authorized designee, other than the person who made the determination in question. The appeal hearing will occur within 30 day calendar days of the receipt of the appeal request. 3. The informal appeal review meeting will be attended by the person who is being displaced, the Reviewer and the Relocation Consultant. At this meeting the person who is being displaced will explain their appeal. The Consultant will then provide explanation and clarification of the procedures that have been followed. The Reviewer will provide explanations and clarifications of procedures that are required to be complied with under the California Relocation Assistance Law (Government Code 7260) and the Califomia Code of Regulations, Title 25, Chapter 6, as amended. The meeting is intended to ensure that the Person who is being displaced fully understands his rights and options, and has the opportunity to demonstrate how the procedures were (1) followed incorrectly; (2) not fairly or reasonably applied; (3) explain any extenuating circumstances and how these circumstances require a different conclusion; and (4) explain the conclusion the person who is being displaced is seeking and the reasons and justifications for this conclusion. A written determination regarding the results of the appeal hearing will be made within 14 days of the appeal hearing. Relocation benefits for the person who is being displaced will be provided according to the determination of the informal appeal hearing. 5. If not satisfied with the written response, the claimant may request review by the Executive Director. Such review must be made within fifteen (15) days, 6. A claimant may then petition review by the Relocation Appeals Board. The composition of the Relocation Appeals Board may be identified by making such requirement to the office of the Executive Director. 7. The Relocation Appeals Board shall consider every aggrieved person's complaint regardless of form, and shall, if necessary, provide assistance in preparing the written required for review. 8. If the person who is being displaced has still not obtained the satisfaction sought, the only remaining recourse is judicial review. As a part of the appeal decision letter, the applicant will (a) be notified in writing that no further administrative appeals are permitted, (b) that any judicial review shall be 'pursuant to California Code of Civil Procedures Section 1094.5" and (c) that the time frame to seek judicial review is governed by SAMC Section 1-19.
