Description) Finance: Council Notes: Agenda Item No. • c a" Background Information: When the Multi-Family Fire Inspection Fee ordinanance was originally put in place, the City needed to get a handle on the many apartment complexes in the City that were historically non- compliant related to health and safety issues. It is important to note that these initial inspections were done without charge in the past. Only upon the realization that the City was conducting multiple inspections for the same complexes over and over again was it apparent that a more intensive fee- based inspection program was warranted. I do not believe that we ever intended to burden those compliant non-profit low-income senior citizen complexes that have now found these fees to be a true hardship. It is becoming more and more difficult for them to hold the line on rents with all the other cost increases they have to overcome due to local, state and federal mandates. Unfortunately, the Senior Citizen's fixed income has not increased at the same rate as the increased costs to the non-profit Senior Citizen apartment complexes. After speaking with the Fire Chief, the Deputy Fire Chief and the City Manager, I am respectfully asking the Council to consider asking the Fire Chief to research an amendment to the current ordinance. The amendment, as a suggestion, would waive the burden of the first inspection fee only, levied upon non-profit Senior Citizen apartment complexes that house 80% or more senior age-qualifying population. If the complex is still non-compliant upon the follow-up inspection, if one is needed, the complex should then be held responsible for the current fees, allowing the manager/owner adequate time to correct any deficiencies, as is provided by the ordinance now. If, during the follow-up inspection, the Fire Marshal determines the complex does not correct the deficiencies noticed in the first inspection, then all fees should be levied in accordance with the current ordinance. Please see below the financial data provided by the Finance Department. It should be noted that the costs for these inspections used to be absorbed by the general fund without additional fees. To that issue, in 04-05 we underspent the budgeted amount by $ 280,245.00 mostly because that was the first year of the program. The second year, 05-06, we overspent by $ 40,655.00. The third year, 06-07, we underspent by $ 98,031.00. Total as of June 1, 2007, we have underspent to the original budgeted amount by $ 337,621.00. In 05-06 we actually collected $ 18,362.00 more than it cost to implement the program. So it seems financially prudent, not to mention the right thing to do, to ask the Fire Chief to come back to the full Council with a possible amendment to the current ordinance and fee structure by waiving what may amount to approximately $23,542.00 in potential fee revenue. Please see that attached two letters from a former Councilman who manages Eden Residential Center, a Lutheran non-profit Senior Citizen apartment complex as an example of one complex's struggles. Also I have a couple of Questions; Are all the units that are billed up to date in their payments? Has any legal action against people that have not paid? Has section 15.25.090 & 15.25.080 (Chapter 15.25) been enforced diligently. I really don't want to be a nuisance, but this very irritating to me.
