SUBJECT
Resolution authorizing execution of an Agreement for Services and issuance of a Purchase Order
to LeMay Construction Co. for the Boys & Girls Club Racquetball Court Renovations in the City
of San Bernardino per RFQ F -07 -28.
BACKGROUND
The Boys & Girls Club Racquetball Courts have not been used for many years in there intended
capacity. This project will convert the courts into usable classroom space for homework and
tutoring.
The RFQ for the Boys & Girls Club Racquetball Court Renovations project was advertised in the
San Bernardino County Sun Newspaper on 2/21/07. It was posted on the City web site, given to
the Chamber of Commerce and faxed directly to seven contractors, three of whom are located in
San Bernardino.
The' City received bids from three firms to perform the Boys & Girls Club Racquetball Court
Renovations. City staff has reviewed the bids and has determined LeMay Construction Co. is
the apparent low bidder for the project. Staff has confirmed the contractor's license and
references.

Staff has eliminated the Item I demolition, floor, wall and cove base renovation from the bid,
leaving Item 2 T -Bar ceiling installation, Item 3 HV AC installation, and Item 4 CCTV security
system. The walls, floors and cove base will not be renovated as part of this project basedupon
funding. The Boys and Girls Club will be seeking other funds for this work. The cost for the
remaining items is $50,800.00 and is within the grant amount.
Staff also acknowledges that various unforeseen conditions may arise in this project. A
contingency budget of percent (6%) is requested at this time.

The total cost for this project is estimated at $54,000.00; for construction with contingency. The
Boys & Girls Club has received a County Community Development Block Orant (COSO) for
$54,000. City funds are not used to pay for this project.
Staff recommends issuance of a Purchase Order and execution of an Agreement for Services
with LeMay Construction Co, for the amount of$50,800.00, with a 6% contingency of$3,200 to
cover unforeseen conditions, making the total construction purchase order costs $54,000.00.
FINANCIAL IMPACT
The funding for this project has already been included in the Facilities Management FY 06-07
budget (account number 001-325-5706) and the COSO reimbursement has already been
included in the FY 06-07 revenue budget in account number 001-000-4901.
RECOMMENDATION

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN
AGREEMENT FOR SERVICES WITH AND ISSUANCE OF A PURCHASE
ORDER TO LEMAY CONSTRUCTION CO. FOR THE BOYS & GIRLS
CLUB RACQUETBALL COURT RENOVATIONS IN THE CITY OF SAN
BERNARDINO PER RFQ F-07-28.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF
THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. LeMay Construction Co. is the lowest responsible bidder for the Boys &
Girls Club Racquetball Court Renovations in the City of San Bernardino per RFQ F-
07-28. A contract is awarded accordingly to said Contractor in a total amount of
$50,800.00 with a contingency of $3,200.00. Such award shall be effective only upon
said contract being fully executed by both parties. The Common Council hereby
authorizes the City Manager to execute on behalf of the City an Agreement for
Services; a copy of the contract is on file in the City Clerk's Office and incorporated
herein. The Purchasing Manager is hereby authorized and directed to issue a purchase
order which references this Resolution to said Contractor in the amount of $50,800.00.
SECTION 2. Any amendment or modification thereto shall not take effect or become
operative until fully signed and executed by the parties and no party shall be obligated
hereunder until the time of such full execution. No oral agreements, amendments,
modifications or waivers are intended or authorized and shall not be implied from any
act or course of conduct of any party. This resolution is rescinded if the parties to the
contract fail to execute it within sixty (60) days of the passage of this resolution.
