CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT SUBJECT Resolution of the City of San Bernardino accepting the FY 02/03 High Technology Grant and authorizing the expenditure of the awarded grant funds in accordance to the grant expenditure plan. BACKGROUND The State of California's General Fund budget for FY 02/03 includes an allocation for a High Technology Grant for police agencies to purchase needed equipment and technology. The State Controller has allocated a minimum grant of $15,000 to each city police chief, county sheriff and several special districts. The remaining balance was allocated to county sheriffs and city police chiefs based on their city/county's proportionate share of the state's population estimate as determined by the most recent January population estimates by the Department of Finance. The City of San Bernardino's allocation for FY 02/03 is $46,440.73. The amount allocated in FY 01/02 was $88,618.00. The goal of the Chief of Police is to provide the men and women of the police department with the tools and equipment necessary to accomplish the mission and objectives of the department in an efficient and cost effective manner. Towards this end, High Technology Grant funds will be used to purchase: . A Tiburon CAD Supervisory Review software module. . Miscellaneous police equipment. On September 23, 2002, the Mayor and Common Council ratified Resolution #2002-306, authorizing an upgrade to the Tiburon Computer Aide Dispatch (CAD) system used by the police and fire departments and the Records Management System (RMS) used by the police department. Additionally the resolution authorized the purchase of a new Automatic Vehicle Locator (A VL) system for the police department. Implementation and cutover to the new CAD system is scheduled for June 2003, with RMS scheduled for October 2003 and A VL for December 2003. A VL will depict the actual location of each patrol unit on city maps located in the watch commander's office and Dispatch, and allow Dispatch to easily identify the closest available police unit to send to emergency and high priority calls for service. The recent arrest of a police officer for serious police misconduct revealed that he used the police department's Mobile Data Computers (MDC's) to identify his potential victims. The internal investigation into this matter uncovered that field supervisors currently do not have the ability to track or monitor activities that field personnel conduct on MDC's or gauge officer productivity. They are not aware of non-emergency calls for service assigned to officers via MDC's or when officers use MDC's to run warrant checks, drivers licenses, or vehicles licenses. These activities were voice transmitted prior to the acquisition of MDC technology, which discouraged the " misuse of law enforcement automated systems or easily allowed the detection of misuse and intervention by supervisors. The CAD Supervisory Review module will restore a supervisor's ability to monitor MDC activities of individual officers and improve officer accountability. Supervisors will receive a mirror copy of all MDC transmissions and activities of the officer, allowing. them to easily monitor all activities, provide closer supervision, or intervene as necessary . Tiburon, Inc. has provided the police department with a written quotation to develop a CAD Supervisory Review software module for $44,282,00. Tiburon Inc. guarantees the price of the CAD Supervisory Review module is fixed and valid unless modified by Tiburon in writing prior to the City's acceptance. The quotation specifies that 50% of the total cost is due and payable at the time the City accepts the proposal and the remaining 50% is due on delivery. The police department, however, recommends that the entire cost of the program be pre-paid to Tiburon Inc. due to the State of California's continuing budgetary problems and the possibility that unspent High Technology Grant funds could be recalled to help balance the state's budget deficit. The design of the CAD Supervisory Review module will be completed and ready for implementation with the June 2003 cutover of the CAD upgrade. Tiburon, Inc. provides Computer Aided Dispatch (CAD) software for the police and fire department and Records Management System (RMS) software for the police department. The software is proprietary and our licensing agreement with Tiburon, Inc. does not allow other vendors to alter the software. The CAD Supervisory Review Software module is therefore a sole source purchase. The police department requests that this purchase be exempted from the formal city bid process pursuant to Section 3.04.010B4 of the San Bernardino Municipal Code. FINANCIAL IMP ACT There will be no impact on the City's General Fund. The Police Department will be using a total of $46,440.73 in awarded High Technology Grant funds to purchase equipment and technology related items listed in the grant expenditure plan. Scope Description: Tiburon will create a command for the purpose of tracking all messages that are sent from, or received by, a specific mobile unit. A user, given specific security, will be capable of initiating the command to monitor all MDS communications of a specific mobile unit. Price Description: Total cost for the new tracking command is $44,282. Tiburon Responsibilities: Tiburon will create a tracking command in the CAD/Ti application. The command will perform the following functions: . From a CAD screen the user will enter the command and the unit ID of the person to track. . The person being tracked must be logged onto a mobile unit. . The initiating user will receive a copy of all messages sent from and received by tracked unit. . The use of the tracking command is controlled through the Tiburon security file. . A user can track one person at a time. . When the user initiating the tracking logs off the system the tracking is turned off. . Only one person can track an individual at a time. . Tiburon will provide documentation. Terms and Conditions: . Tiburon will develop the command in our office. . Tiburon install and test the command via dial-up. . This command will be developed and installed during the CAD/Ti project. . By the Client's acceptance of the Enhancement Proposal in the signature blocks provided below, the Client is authorizing Tiburon to proceed with the work described herein and confirms additional funding will be obligated. Any requisite contractual documents required by the Client's purchasing procedures are the responsibility of the Client. . Except as described herein above, all terms and conditions of the referenced agreement remain unchanged and in full force and effect. . This fixed price Enhancement Proposal is valid unless modified by Tiburon in writing prior to Client acceptance of the Enhancement Proposal; otherwise, this Enhancement Proposal will expire on December 25, 2002. The module will be completed and ready for implementation with the June 2003 cutover of the CADIRMS/A VL upgrade. Miscellaneous Police EauiDment The remaining High Technology funds will be used to purchase needed police equipment that is not included in the General Fund budget. This includes equipment such as additional desk top and belt tape recorders, tasers, less lethal weaponry and ammunition, etc. . . . . . .
