Description: Timber Creek Finance: Council Notes: JI }9)tJ" Agenda Item NO.-'-1- STAFF REPORT CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Subject: Reject all bids for Timber Creek improvements between Lena Road and Twin Creek per Plan No. 10069 and direct staff to rebid the project as described in the staff report. Background: The existing Timber Creek channel is an unimproved dirt channel that drains into the San Bernardino County Flood Control District's Twin Creek channel. The majority of the tributary drainage area is from the San Bernardino International Airport site. In order to accommodate future airport development and to increase drainage capacity, the Timber Creek channel is proposed to be upgraded to a concrete lined trapezoidal channel. This project was initially approved in the FY 98/99 Budget and considered part of a comprehensive infrastructure improvement "plan" in the area of the City surrounding the San Bernardino International Airport. A number of street and drainage improvements were included in the "plan" such as the Orange Show Road, Mill Street, Tippecanoe Avenue and Timber Creek projects. These projects are being completed as funding becomes available. This project, to concrete line Timber Creek from Twin Creek to Lena Road per Plan No. 10069, was advertised locally and bids were received on October 24, 2000. Ventura $445,861.20 Hubbs & Ferrante Bloomington $448,715.92 Unfortunately, staff was unable to recommend award of the project at the time bids were received because of unexpected restrictions placed in a permit from the U.S. Army Corps of Engineers. Federal regulations require that a Section 404 permit be obtained from the Corps of Engineers prior to starting work in a streambed under the jurisdiction of the Corps. Timber Creek is a blue line stream on the United States Geological Survey (USGS) map which clearly identifies it as being under the corps' jurisdiction. In past years, Corps permits have been relatively straightforward to obtain. However, the California Regional Water Quality Control Board, which must approve a water quality impact waiver (referred to as a 401 Certification) prior to the Corps issuing its permit, recently began to closely regulate work in streambeds and require mitigations for potential water quality impacts. CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT (Continued) Initially, the representatives of the Santa Ana Region Water Quality Control Board (SARWQCB) insisted that Timber Creek not be concrete lined but instead be lined with a soil stabilizer and be replanted with natural vegetation. After considerable negotiation with SARWQCB staff, Public Works staffreached an agreement that will allow the concrete lining of Timber Creek between Twin Creek and Lena Road as per Plan No. 10069. As mitigation, the City is required to preserve the portion of Timber Creek Channel between Lena Road and Tippecanoe A venue in a nearly native condition. In order to maintain the channel in its native condition and carry the design flows which are anticipated to be generated from development of San Bernardino International Airport, the channel will be graded in a trapezoidal configuration, an irrigation system will be installed, and the portions of the channel subject to erosion will be reinforced with a composite matting material. which allows vegetation to grow through. Upon completion of construction, the side slopes and bottom will be revegetated with native plant material. In addition to the above mitigation, the City will be obligated to maintain the revegetated area for a period of three years. Additionally, continuous monitoring of the revegetation efforts will be required and annual reports will be required to be submitted to the Corps of Engineers for a period of at least 5 years after completion of construction. Staff is recommending the project be rebid due to substantive changes in the scope of work related to the corps permit and the time elapsed. The Inland Valley Development Agency has recently agreed to fund the additional work upstream of the original project limits as it benefits adjacent development. We are proposing to immediately rebid the reach of Timber Creek between Twin Creek and Lena Road in accordance with the original approved Plan No. 10069. We will also be including the mitigation measures upstream of Lena Road in the same bid. It is anticipated that construction of this portion of Timber Creek could begin in late-February 2003 and be completed by June of 2003. Financial Impact: None. Construction funding for Timber Creek is contained in account no.248-368-5504-7141.
