BACKGROUND: In December, 1990, Tract No. 13822, located at the northeast comer of California Street and 16th Street, was approved. The property was recently acquired by Century Vintage Homes, the developer of this tract. One of the conditions of approval was the formation of an Assessment District for the maintenance of landscaping along portions of California Street and along portions of 16th Street, within the boundaries of the tract. This is being done to assign the costs of maintaining the landscaping to the owners of the properties most benefiting from the landscape area and to prevent blight since property owners'usually do not maintain the areas beyond the perimeter block walls of a tract. A letter requesting the formation of the district was received from the developer, Century Vintage Homes, along with the processing fee of $4,000. Tract No. 13822 consists of 38 single family lots. The annual cost of maintenance and incidentals will be spread across these 38 lots. Part of the formation proceedings includes the preparation of an Engineer's Report, which will detail the costs necessary to carry out the ongoing maintenance of landscaping and will be presented with the Resolution of Intention at a future meeting. Approval of this district will be subject to an assessment ballot process, which requires a majority approval by the property owners within the proposed district boundary. Since all of the properties are currently under one ownership, no protests are anticipated. Future homeowners will purchase the homes subject to the assessment district. All potential home buyers will be given a disclosure notice by the developer, advising them of the existence of an assessment district and the proposed annual cost. FINANCIAL IMPACT: None. Applicant has paid the $4,000 processing fee and all subsequent work carried out in the district will be assessed back to property owners. RECOMMENDATION: Staff recommends that authorization be given to proceed with the formation of a Landscape Maintenance Assessment District in the California Street and 16th Street area.
