Hardgrave Director of Public Works/City Engineer City of San Bernardino 300 North "D" Street San Bernardino,'CA 92418 Dear Roger: This letter is to review and confinnmy understanding of the City's wishes with respect to the stonn drain recarrnended by Cal-Trans and the undergrounding of the Southern California Edison lines along Kendall Drive. The following is what I understand to be the City's desires. '!Wo assessment districts will be established bY the City of San Bernardino. A. District will be established to provide funding for undergrounding the Southern California Edison transmission and distribution lines that run along the north side of Kendall Drive between University Parkway and Palm Avenue. This District will be established bY the Comron Council within the next six rronths. During the period frOIl1 now until the District is established the Shadow Hills Village project will be required to post improvement or canpletion bonds for the first two thirty-six unit phases (a total of seventy-two units) for the undergrounding, pri~r to issuance by the City of Certificates of occupancy for those 72 units, designated as building numbers 5, 6, 7, 8, 9, 12, as sho.vn on the grading plan dated 2/18/86. After the District is established, improvements bonds for under- grounding will not be required and any bonds for undergrounding already posted will be released as the costs for the L1Ildergrounding improvements will be flmd- ed bY the District. A second District will be established to provide funding for the construction of a stonn drain to carry water runoff. f= Pine Street to the Devil' s Gate Flood Control Channel. This District will also be estab- lished during the next six rronths. Associated Engineers have deSigned earthen retention basins to meter water runoff fran Shadow Hills Village such that water on Kendall Drive will be 90% of the present flows. Therefore, the stonn drain is not required prior to the canpletion of the 72 units designated on the grading plan dated 2/18/86, as building numbers 5, 6, 7, 8, 9, 12. However, before the issuance of Certificates of Occupancy, for apartment units built subsequent to the above listed building mnnbers, the developers of Shadow Hills Village will be required to post improvement bonds for the stonn drain. Undergrounding of the S.C.E. lines at a future date will necessitate a relocation of the existing power poles when the Kendall Drive street improvements are installed.. #-11 - ( ~ \. " ,/ \ j 'therefore, we propose that the poles be relocated to a location inmediately inside of the' sidewalk so that they may be easily rffilOved when the underground- "lng work is done without disturbing the then existing sidewalk. Further, that the Shadow Hills Village project post street improvement bonds for the Kendall Drive irrpJ;'ovements prior to issuance of Certificates of Occupancy on building numbers 5, 6, 7, 8, 9, 12 (72 units) as noted above. Kendall Drive street improvement bonds will not be required to be posted for building num- bers 10, 11, 12, 13, 14, 15, 16, (72 units) but rather the full phase I street irrprovements as shown on page 5 of the street irrprovement plans will be re- quired to be canplete prior to issuance of Certificates of Occupancy for these buildings. The phase II street improvements will be canpleted prior to Certificates of Occupancy for buildings 17 through 27. my understanding of our telephone conversations. JRW/jlw .
