installed by A.D. No. 956

STAFF REPORT
Bids for this project were opened at 2:00 p.m. on Tuesday, 5-20-86.
A total of 6 bids were received, ranging from $59,652.00 to $75,588.00.
The low bid of $59,652.00 is 18.7% under the Engineer's Estimate of $73,382.00.
Listed below is an estimate of the total project cost, based upon the
actual low bid price:

TOTAL ESTIMATED PROJECT COST $ 100,152
The Notice to Proceed will be effective on July 1, 1986. The
contract will be in effect until June 30, 1987. Bids will be solicited for
a new contract commencing on July 1, 1987.
Funding for the costs incurred on this project will be provided pur-
suant to Resolution No. 85-284, adopted July 22, 1985, which orders the
maintenance of the landscaping. The landscaping was installed under a
previous contract under Assessment District No. 961. Costs for maintenance
will be pre-funded by the City, as set forth in Resolution of Intention No.
85-198, and the amount reimbursed through assessments levied on all parcels
within the district for the following fiscal year.
Supervision of the maintenance effort will be provided by the Depart-
ment of Parks, Recreation and Community Services, who has reviewed the bids
and agrees to awarding the contract.
We recommend that a contract be awarded to the low bidder.

I RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO
J & R LANDSCAPE MAINTENANCE CO., INC. FOR MAINTENANCE OF LANDSCAPING IN
3 PORTIONS OF VANDERBILT WAY, HOSPITALITY LANE, CARNEGIE DRIVE, BRIER DRIVE,
HARRIMAN PLACE, WATERMAN AVENUE, TIPPECANOE AVENUE, AND ALONG GAGE CANAL
4 AND INTERSTATE HIGHWAY 10.
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:

SECTION 1. J & R Landscape Maintenance Co., Inc. is the lowest
responsible bidder for maintenance of landscaping in portions of Vanderbilt

Way, Hospitality Lane, Carnegie Drive, Brier Drive, Harriman Place,
9
Waterman Avenue, Tippecanoe Avenue, and along Gage Canal and Interstate
Highway 10, in accordance with Plan No. 6244 (1986-87) for the total amount
of $59,652.00, a contract is awarded to said bidder accordingly, but such
award shall be effective only upon the contract being fully executed by the
parties; all other bids therefor are hereby rejected; and the Mayor is hereby
authorized and directed to execute said contract on behalf of the City; a
copy of the contract is attached hereto, marked Exhibit "A" and incorporated
herein by reference as fully as though set forth at length.
SECTION 2. Execution and Amendments. This agreement and any

amendments or modifications thereto shall not take effect or become operative
until fully signed and executed by the parties and no party shall be obligated

20 hereunder until the time of such full execution. No oral agreements,

Ii amendments, modifications or waivers are intended or authorized and shall not

I be implied from any act or course of conduct of any part.
