The Mayor of the City of San Bernardino is 7 hereby authorized and directed to execute on behalf of said City 8 an agreement with San Bernardino City Wide Unity Committee 9 relating to co-sponsoring a unity concert on June 7, 1986, a copy ]0 of which is attached hereto, marked Exhibit "A" and incorporated ]1 herein by reference as fully as though set forth at length. 12 I HEREBY CERTIFY that the foregoing resolution was duly 13 adopted by the Mayor and Common Council of the City of San 14 Bernardino at a meeting thereof, 15 held on the day of , 1986, by the following 16 vote, to wit: 17 18 Council Members AYES: 19 NAYS: 20 ABSENT: 21 22 23 24 25 26 City Clerk The foregoing resolution is hereby approved this day of , 1986. '-' " , ) 1 A G R E E MEN 1 2 (Unity Concert) 3 THIS AGREEME~l is made and entered into on this _____ day of 4 , 1986, by and between the CITY GF ~AN 5 BERNARDINO, a municiJ:al corporaticn, heIEoinafter "City", and S"~ 6 BERNARDINO CITY WIDE UNITY COMMITTEE, a nonprofit organization, 7 hereinafter "Organization". 8 City and Organization agree as fellows: 9 1 . Rec ita Is. 10 A. City and Organization desire to co-sponsor a unity 1] concert to promote civic participation and culture within the 12 City of San Bernardino, provide yeuth with an opportunity to 13 display their talents in a wholesome setting, and develop 14 awareness on the part of the citizens of the need to stand 15 together in support of law enforcement officers and city 16 officials. 17 B. It is the desire of City and Organization that a 18 unity concert will provide a stimulus on the part of youth and 19 adults to care for private property, stem the tide of drug 20 traffic, and renew appreciation of the benefits of San 2] Bernardino as a city having a favorable family environment. 22 2. Event and Facility. City and Organization shall co- 23 spenser a unity concert on June 7, 1986, from 2:00 p.m. to 8:00 24 p.m. which shall be held at Roosevelt Bowl in Perris Hill Park. 25 3. Responsibilities of Organization. Organization shall: 26 A. Provide the necessary manpower for the setup and 27 breakdown of its own equipment. 28 B. Frovide continuous cleanu~ during the activities and 3 leave area in a neat and clean co~dition. 4 D. Provide personnel to empty trash receptacles intc 5 trash bins provided by City. 6 4. Responsibilities of City. City shall: 7 A. Permit the use of Roosevelt Bowl in Perris Hill Park 8 at no cost to Organization. 9 B. Provide one part-time employee from 2:00 p.m. to 10 8:00 p.m. on June 7, 1986, at no cost to Organization. ]] C. Furnish sound system e~uipment and piano at no cost ]2 to Organization. 13 5. Hold Harmless. Organization shall indemnify, defend and 14 hold City and its officers, employees and agents harmless from 15 ary claim, loss, cost, damage, demard, expense or liability, ]6 including reasonable attorney's fees, to the extent resulting 17 from any intentional or negligent act or omission of ]8 Organization, relating tc tr.is agreement. This indemnity shall 19 apply to a claim, suit or action against the City of San 20 Bernardino based on alleged infringement of the proprietary 2] rights of a third party. 22 City shall indemnify, defend and hold Organization harmless 23 from any clai~, loss, cost, damage, demand, expense and 24 liability, including reasonable attorney's fees, to the extent 25 resulting from any intentional or negligent act or omission of 26 the City of San Bernardino, its officers, agents or employees 27 relating to this agreement. 28 6. Notices.
