Synopsis of Previous Council action:
December 17, 1984 -- Resolution No. 84-530 was adopted with the
requirement that any request for sewer capacity rights in excess of
75 be submitted to the Mayor and Common Council for approval.
R~ommended motion:
That the request of Vandenberghe Development to purchase 240 sewer
capacity rights be referred to the Legislative Review Committee.

STAFF REPORT
The applicant, Vandenbergh Development, wanted 500 sewer
capacity rights. The city originally only purchased 1,500.
This would have amounted to 1/3 of the original purchase.
They have since decided to develop in phases and are cur-
rently requesting 240, approximately 1/2 of their original
request.
The developer will have a representative at the June 2nd
Council Meeting to show a conceptual plan of development to
the Council and answer questions. The site is 37 acres,
zoned 14 units per acre for 505 units (need 378.75 sewer
capacity rights). Only 300 units (225 sewer capacity rights)
will be built in the first phase and 200 units in the second
phase.
The developer will take whatever sewer capacity rights that
are available. It is recommended that this request be
referred to Legislative Review Committee for final disposi-
tion.
