CIoN OF SAN BERNARD6;b - REQU.Qr FOR COUNCIL AC-rfON STAFF REPORT Hear protests, if any, and adopt the Resolution Ordering Work in the area of University and Hallmark Parkways. This action is the result of a request for the installation of traffic signals at the above stated intersection due to growing traffic problems in the area. On May 19, 1986, the Resolution of Intention was passed, which set up the protest hearing date of June 16, 1986. As required by Chapter 12.90 of the Municipal Code, the portions of the streets within the proposed district were posted by the Real Property Section on May 29, 1986; a notice of improvement was mailed to each of the property owners in the proposed district; and on May 29, 1986, the Resolution of Intention was published in the Sun Newspaper. To date, we have received no protests. A RESOLUTION OF THE CITY OF SAN BERNARDINO FINDING AND DETERMINING THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE PROPOSED CONSTRUCTION OE TRAFFIC SIGNALS AND APPURTENANT FACILITIES IN THE AREA OF UNIVERSITY PARKWAY AND HALLMARK PARKWAY, CREATING AN ASSESSMENT DISTRICT TO COVER THE COSTS OF SAID CONSTRUCTION, KNOWN AS ASSESSMENT DISTRICT NO. 973, ORDERING THE WORK AND THAT THE ~PECIAL ASSESSMENT, INVESTIGATION AND LIMITATION ACT OF 1931 SHALL NOT APPLY. WHEREAS, the Mayor and Common Council of the City of 9 San Bernardino have preliminarily found that the public 10 interest, convenience and necessity require the construction 11 and installation of traffic signals and appurtenant facilities 12 in a portion of the City, as more fully hereinafter described, 13 and the appurtenances and appurtenant work and incidental 14 15 costs and expenses in connection therewith, that the project is feasible, and that the lands to be assessed will be able 16 to carry the burden of the proposed assessments to pay the 17 18 costs and expenses thereof; and WHEREAS, the Mayor and Common Council of the City of 19 San Bernardino have, on the 19th day of May, 1986, passed and 20 21 22 23 24 adopted Resolution No. 86-182 entitled: 25 RESOLUTION OF THE CITY OF SAN BERNARDINO PRELIMINARILY DETERMINING THAT PUBLIC CONVENIENCE AND NECESSITY REOUIRE THE FORMATION OF A SIGNALIZATION CONSTRUCTION ASSESSMENT DISTRICT: DECLARING ITS INTENTION TO PROCEED TO ORDER WORK WITHIN THE DISTRICT, TO BE KNOWN AS ASSESSMENT DISTRICT NO. 973 AND SETTING AND DIRECTING PUBLICATION OF NOTICE OF A TIME AND DATE OF 'A PUBLIC HEARING. 26 27 28 IIII IIII 1 \. e ,.-.. That a full and fair public hearing 10 having been held, as stated in the recitals herein, and the 11 Mayor and Common Council, having heard and considered any and 12 all comments received thereon and being fully advised in the 13 premises, hereby overrules any and all protests received. 14 SECTION 2. That the public convenience and 15 necessity require, and the Mayor and Common Council of the 16 City of San Bernardino hereby declares by not less than a 17 4/5th vote as defined in Section 12.90.0400 of the San 18 Bernardino Municipal Code, that the public interest, 19 convenience and necessity requires and hereby orders, the 20 formation of Assessment District No. 973; the work described 21 in said Resolution No. 86-182 to be done in portions of 22 University Parkway and Hallmark Parkway, as provided in said 23 Resolution and that the Special Assessment, Investigation and 24 Limitation Act of 1931 shall not apply. 25 SECTION 3. . "D" St. San Bernardino, Gal. 92418 Re: Installation of Signal and Lighting at Intersection of Hallmark Parkway and University Parkway Myself and the other officers of our company would like to register a strong protest against the above installation. At this point in time, when more than 3/4' s of the properties on Hallmark Parkway are still unoccupied, we feel there is no need for such an expense. We all use the above mentioned intersection and have never had any problem whatsoever getting in or out of Hallmark. At our place of business, we never have more than 100 people working (mostly a lot less) and they are divided up into 3 shifts. We also have our shifts starting and ending times set so that they should not interfere with the other canpanies on our street, that is we do not work 8 to 5 but 7 to 3: 30. None of us ever encountered heavy traffic on either Hallmark itself, nor at the intersection. At this time we feel that for us to have to layout approximately $ 7,000.00 for signals and lighting of dubious benefit for our employees or the company, is too much money. We are herewith respectfully requesting that the Mayor of San Bernardino and the City Council reconsider their position on the above ite~. RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING 2 GUIDELINES FOR REPURCHASE BY THE BOARD OF WATER COMMISSIONERS OF SEWER-CAPACITY RIGHTS HELD BY PRIVATE HOLDERS. 3 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 4 OF SAN BERNARDINO AS FOLLOWS: 5 6 SECTION 1. The Mayor and Common Council hereby establish the following guidelines which shall be adhered to in the 7 8 repurchase of sewer capacity rights by the Board of Water Commissioners from private holders. This program is necessary to 9 provide some inducement to present holders to turn in their 10 11 rights. It is also necessary to discourage holders from tying up 12 rights for projects which may not be built for two years. 13 A. The City will offer to buy back unused sewer capacity rights from original holders at a price of $1620.00. 14 15 B. The City will, in turn, resell these sewer capacity 16 rights to new applicants for $2260.00. 17 C. New applicants shall be subject to all terms and conditions, other than price, set forth in Resolution Nos. 84-271 18 19 and 84-530. 20 D. As a condition of resale, the original holders shall 21 have th~ righ~,to buy back sewer capacity rights from the City at 22 a price of $162~.00 no sooner than September 1, 1987, and no 23 later than December 31, 1989. 24 25 applicants must agree to use the sewer capacity rights within 26 E.
