STAFF REPORT
A request has been received from Charles T. Schultz, of Reid & Hellyer,
on behalf of El Dorado Bank, for 17th Street, east of Conejo Drive to be vacated.
This request was brought about by the encroachment of the new apartment building
into the setback from the street right-of-way. Vacation of the public right-of-
way would negate this problem.
Seventeenth Street is 15 feet in width, and extends from Conejo Drive
to the Flood Control Channel Right-of-Way. An older one-lane bridge is in
place to convey traffic across the channel. To date we have been unable to
locate any public easement for this bridge. The bridge is in need of mainten-
ance.
Access easements will be reserved in the resolution ordering vacation
for the abutting property to the south and east, Flood Control District, and
City emergency and serving utility vehicles. We understand that the Bank of
El Dorado has agreed to provide perpetual maintenance. This provision will be
included in the resolution ordering vacation, with a stipulation that if the
property owner does not maintain this area, the City will do the necessary work
and place a lien on the property to recover their costs. The resolution
ordering vacation will be recorded, which means that this provision will
become a covenant running with the land.
Vacation of 17th Street will leave one public means of access (Cross
Street) to Fairfax Drive. It is suggested that a bridge on Fairfax Drive, at
Del Rosa Channel, be included in our Capital Improvement Program in order to
provide a second means of public access to the area east of the channel.
We recommend that authorization be granted to proceed.
