STAFF REPORT
Bids for this project were opened at 2:00 p.m. on Tuesday, 6-10-86.
A total of 3 bids were received, ranging from $553,304 to $616,104.
The low bid of $553,304 is 3.3% under the Engineer's Estimate of $572,045.
The special provisions established goals of 11% for Disadvantaged
Business Enterprises (DBE) and 2% for Women Business Enterprises (WBE). After
the bid opening, the two lower bidders were requested to provide information
on how these goals would be achieved. The information submitted by the apparent
low bidder for WBE's included one firm that was cctually a DBE, and one who was
not on Caltrans' certified listing of bonafied DBE and WBE. Therefore, we made
a determination that the low bid did not meet the prescribed goals, and the
low bidder had failed to make a good faith effort to comply.
Caltrans has agreed with our determination, by letter dated 6-24-86,
and concurred with our request to award a contract to the second low bidder.
A copy of this letter is attached for reference. The information submitted by
the second low bid shows that the prescribed goals will be achieved.
The second low bid of $579,992 is 1.4% over the Engineer's Estimate of
$572 ,045.
Listed below is an estimate of the total project cost, based upon the
actual second low bid price:

Execution of Program Supplement No. 40 served to obligate $441,431 in Federal-
Aid Urban Funds, apportioned on a population basis. An additional apportion-
ment of $142,932 has been approved by SAN BAG from regional Federal-Aid Urban
Funds. Local matching funds in the amount of $96,150 have been allocated in
the Street Construction Fund Budget, under Account No. 242-362-57342, for a
total available amount of $683,513.
We recommend that the low bid be rejected and a contract awarded to
the second low bidder.

Dear Mr. Hardgrave:
We have reviewed the contract bid data for your Del Rosa
Federal-Aid Urban project as submitted by letters dated
June 17, 1986 and June 18, 1986. We note that the apparent
low bidder, Powell Construction Company, failed to meet
your established DB/WBE goals for this project. We support
your determination that they also failed to make a good
faith effort to meet the goals.
You state that Powell Construction Company, after being
notified of their deficiencies, submitted amended data.
We agree with your determination that this second submittal
of DB/WBE information is improper and constitutes an alter-
ation to the bid.
The contract bid data and DD/WBE information of the second 10\1
bidder, Bonadiman-HcCain, Inc., appears proper and we concur
with your request to award this contract to them.

SECTION 1. The bid from Powell Construction Company, the apparent
low bidder, is 'rejected because of failure to meet established goals for
participation by Disadvantaged Business and Women Owned Business Enterprises,
or to demonstrate that a qood faith effort was made to comply with these
goals, and that authorization is granted to release the security submitted
to guarantee execution of a contract.
SECTION 2. Bonadiman-McCain, Inc. is the lowest responsible bidder
for construction of Del Rosa Drive, from Ninth Street to Baseline Street, in
accordance with Plan No. 4993, for the total amount of $579,992.00, a
contract is awarded to said bidder accordingly, but such award shall be
effective on1y upon the contract being fully executed by the parties; all
other bids therefor are hereby rejected; and the l~llyor is hereby authorized
anrl directed to execute said contract on behalf of the City; a copy of the

contract is attached hereto, marked Exhibit "A" and incorporated herein by
reference as fully as though set forth at length.
SECTION 3. Execution and Amendments. This contract and any
amendments or modifications thereto shall not take effect or become operative
until fully signed and executed by the parties and no party shall be
obl igated hereunder until the time of such full execution. No oral
agreements, amendments, modifications or waivers are intended or authorized
and shall not be implied from any act or course of conduct of any party.
