STAFF REPORT
This Department received a request to vacate the alleys North
of 13th Street, between "E" and Acacia Streets, in order to
develop the area as a total parcel.
It is the opinion of this Division that there is no further
necessity for the alleys either for present or prospective
all ey purposes. Therefore, we recommend the vaca ti on on the
basis of the following "Finding of Fact":
1. We have 100% consent of the abutting property owners.
2. We have contacted all Departments within the City with
no one objecting.
3. By virtue of the posting and publication of this
proposal, neither this office, nor the City Clerk's
Office, have received any written protest against the
vacation of these alleys.
4. All utility companies have been notified of the
proposed vaca ti on, and a reserva ti on of a uti 1 i ty
easement has been provided for requested facilities.
We recommend the adoption of the attached resolution.

RE SOL UTI ON NO.
A RESOLUTION OF THE CITY OF SAN BERNARDINO VACATING
THOSE ALLEYS LOCATED NORTH OF 13TH STREET BETWEEN "E" STREET
AND ACAC IA: STREET, IN THE CITY OF SAN BERNARDINO AND RESERV ING
A PUBLIC UTILITY EASEMENT THEREIN; .
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1: The Mayor and Common Council of the City of
San Bernardino. having heard the evidence offered in relation
to the proposed vacation of those alleys located North of 13th
Street between "E" Street and Acacia Street. more particularly
described in City Resolution of Intention No. 86-205, hereby
find from all of the evidence submitted that such alleys
proposed to be vacated by said Resolution are unnecessary for
present or prospective street purposes.
SECTION 2. The Mayor and Common Council of said City do
hereby vacate those alleys located North of 13th Street between
"E" Street and Ac~cia Street. more particularly described as
follows:
Those certain alleys located between the West
line of "E" Street and the East line of Acacia
Street, and from the North line of 13th Street,
and a point approximately 200 feet North thereof
as delineated on the map of Sunset Heights
Subdivision as per plat recorded in Book 17 of
Maps, page 32 of records of Slln Bernardino
County, State of California.
And is also described in said Resolution No. 86-205.
SECTION 3. This Resolution shall reserve, and nothing
herein shall in any way affect or disturb each and every
existing easement for sanitary sewer and appurtenant facilities
and for pUblic utility purposes belonging either to the City of
San Bernardino or to any public utility and there is further

reserved for present and future general public utility purposes
and for this City an easement reasonably necessary to locate
sanitary sewer, public utility and appurtenant facilities over,
in, under or across said alleys along with the right to use,
install, maintain, repair, replace or renew such facilities and
those reserved by Resol uti on of Intenti on No. 86-205.
SECTION 4. The City Clerk of the City of San Bernardino
shall cause a certified copy of ,this Resolution to be recorded
in the office of the County Recorder of the County of San
Bernardino.
