STAFF REPORT
A request was received to vacate a portion of that certain
unnamed East/West street located at the Southerly terminus of
Varsity Avenue, from the owners who adjoin the portion to be
vacated relative to proposed developments. This request
represents 100% of those owners who adjoin the street.
All the interested City Department Heads and the Utility
Companies were notified of the proposal on March 3, 1986, with
a reply due on March 28, 1986. The utility companies have
responded and no reservation for public utility easements was
requested. However, the Public Works Department has requested
to reservation of an easement for sewer purposes.
There are some concerns relative to the extension of Varsity
Avenue to University Parkway, and although we will proceed
through the protest hearing, we will not adopt the Resol ution
Ordering the Vacation until proper dedication has been
received.
The proponents have been notified by letter on April 8, 1986,
of the requested sewer easement, and have responded with
notification for us to proceed. The required $400.00 fee has
been paid and it is, therefore, recommended that favorable
consideration be given to the requested vacation.
The Resolution of Intention, which sets a protest date of May
19, 1986, has been attached hereto for your action al so.
URGENCY CLAUSE:
This action is necessary to coordinate
with two other developments in the area
for their timely completion.

RESOLUTION NO.
A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING
ITS INTENTION TO ORDER THE VACATION OF A PORTION OF THAT
CERTAIN UNNAMED EAST/WEST STREET LOCATED AT THE SOUTHERLY
TERMINUS OF VARSITY AVENUE, AND RESERVING AN EASEMENT FOR SEWER
FACILITIES THEREIN.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor and Common Council of the
City of San Bernardino hereby declares its intention to order
the vacation of a portion of that certain unnamed east/west
street located at the Southerly terminus of Varsity Avenue, in
said City, which said portion is more particularly described as
follows:
Those portions of that certain unnamed East/West
Street located at the Southerly terminus of Varsity
Avenue, described as follows:
That portion of Section 18, Township 1 North, Range
4 West, San Bernardino Base and Meridian if the
lines of the Government Survey map approved by the
United States Surveyor General dated June 21, 1872,
were extended over the Rancho Muscupiabe, as per
plat thereof recorded in Book 7 of Maps, Page 23,
records of said County, described as follows:
Commencing at the Southeast corner of said Section
1B; thence North 89019'50" West along the South line
of said Section 18, a di stance of 607.42 feet to an
intersection with the Westerly right of way line of
Devil Canyon (State Street) Road as said Road is
described in the Quitclaim Deed from the San
Bernardino County Flood Control District, a body
pol i tic and corpora te recorded June 21, 1957, in
Book 4262, Page 156, Official Records in the office
of the County Recorder of said County, said road
being 60.00 feet wide; thence North 20052'50" East
along the Westerly right-of-way, a distance of
417.52 feet to an intersection with the right-of-way
line of the Barstow Freeway; thence South 40018'02"
West, a di stance of 135.34 feet; thence North 2r1'
52'50" East, a distance of 134.74 feet to the
begi nni ng of a tangen t curve; thence along sa i d
curve concave to the Northwest with a radius of 1125
feet and a central angle of 35038'45" a distance of

Vaca ti on La w", being Division 9, pa r t 3, of the Streets and
Highways Code of the State of California.
SECTION 3. That the hour of 9:00 A.M. on the 19th day
of May, 1986, in the Council Chamber of the City Hall, San
Bernardino, California, be, and the same hereby is fixed as the
time and place when and where all persons interested in or
objecting to the proposed vacation may appear before the said
~'ayor and Common Council and offer evidence in relation
thereto. For further particulars as to the proposed vacation
of the hereinbefore described portion of said street, reference
is made to tha t certa in map marked "Pl an No. 6941" approved
April 21, 1986, on file in the office of the City Clerk of said
City.
SECTION 4. Nothing in this Resolution shall in any
way affect or disturb any existing easements for sanitary sewer
and appur~enant facilities and there is hereby reserved for
this City an easement reasonably necessary to locate such
sanitary sewers in, over, under and across the real property
hereinabove described and to use, maintain, repair, replace or
renew such facilities.
SECTION 5. That the City Engineer of the City of San
Bernardino hereby is directed to cause Notices of Street
Vacation to be posted as required by the "Public Streets,
Highways and Services Vacation Law".
SECTION 6. That the City Clerk shall certify to the
adoption of this Resolution of Intention and shall cause the

same to be published once a week for two successive weeks in
The Sun, a newspaper published and circulated in the City of
San Bernardino, prior to the date of the above public hearing.
