FOR COUNCIL AC"'N . . . 75-0264 STAFF REPORT On March 28, 1984, a town hall meeting was held in order to explain the redevelopment process, committee election procedures and the Citizens' Advisory Committee role in the project's development. On July II, 1984, the election for the Citizens' Advisory Committee was held. As a result of that election, ten (10) individuals were elected to represent sub area "A" and five (5) individuals were elected to represent sub area "B". Preparation for a new redevelopment project area began in 1983 when the Mayor and Common Council initiated a study into decline of commercial property along portions of Highland Avenue, "E" Street and Baseline. The Planning Department compiled a detailed inventory of existing land uses and the structural conditions of buildings within the two sub areas. The. scope and objectives of the project is to eliminate blight within the proposed redevelopment project area. The Redevelopment Plan establishes a basic framework in which the general redevelopment and rehabilitation of the Uptown Redevelopment Project will occur. Over the past several months, the Uptown Citizens' Advisory Committee has been working with staff in the preparation of the Redevelopment Plan, Environmental Impact Report and land use alternatives. a) Redevelopment Plan The Citizens' Advisory Committee approved the Redevelopment Plan as submitted. A joint Public Hearing needs to be set for June 2, 1986, at 11:00 a.m. Notices of Public Hearing will be sent to all property owners of record. b) Environmental Impact Report The Environmental Impact Report (EIR) contains an analysis of the environmental effects which are anticipated to occur as a result of the redevelopment of the Uptown Redevelopment Project, in accordance with the Redevelopment Plan. The EIR also identifies appropriate mitigation measures to reduce or avoid any such adverse environmental effects. c) Declaration of Restrictions Section 33338 of the Community Redevelopment Law states that each Redevelopment Plan shall contain covenants, conditions and restrictions to be adopted by the Legislative Body. It is anticipated that during the life of the project (40 years), the Agency will, from time to time, purchase property to resell for development. The Declaration of Restrictions will prescribe certain standards relating to the use of such property upon resale or lease. The Declaration of Restrictions is referenced in Disposition Agreements between the Agency and the Developer. The Citizens' Advisory Committee, on March 7, 1985, reviewed the Declaration and recommended its adoption. 756G/EJ 4/21/86 Cltf OF SAN BERNARDI" - REQUE" FOR COUNCIL AC1I>>N . d) Rules for Owner Participll!UfdUPDR-'Entry Section 33339 and 33339.5 of the Community Redevelopment Law states that each Plan shall "provide for participation in the redevelopment of property in the project area by the owners of such property if the owners agree to participate..." and "shall extend reasonable preference to persons who are engaged in business in the project area to reenter..." The rules for Owner Participation were reviewed by the Citizens' Advisory Committee on March 7, 1985, and recommended for approval. ** Attached, hereto, is the Action Schedule for the Uptown Redevelopment Project. No buildings, structures and/or appurtenances thereto shall be placed on any lots so that any portion thereof shall be closer to the property lines than those set back requirements set forth in the Plan and/or as required by the zoning ordinance of the City of San Bernardino as it now exists or is hereafter amended. 4. Off-street parking requirements shall be those set forth in the Redevelopment Plan and/or the zoning ordinance of the City of San Bernardino as it now exists or may hereafter be amended. 5. No sign shall be permitted to be constructed, attached, inscribed, affixed or painted on or to any building in the Project Area unless and until the design for such sign has been presented to and approved by the Agency as to location, size, design and construction. 6. The area between the City curb and/or sidewalk and any and all buildings in the Project Area shall be paved to City of San Bernardino specifications and/or landscaped and maintained by the owner or owners of the lot as a condition of use. If the owner, or any successor in interest of the owner, shall fail to landscape and/or maintain the landscaping to the Agency's satisfaction, the Agency shall then have the right to do so and the owner thereof at that time shall be liable to the Agency for its costs incurred. 3 . , . . . . . . 7. All decisions and approvals or disapprovals by the Agency herein established shall be final and binding with the right of appeal as provided in the Plan. 8. PROVIDED, FURTHER, that if any covenant or condition or restriction or paragraph, section, sentence, clause or phrase herein contained shall become illegal, null or void for any reason, or shall be held by any court of competent jurisdiction to be illegal or against public policy, the remaining covenants, conditions, and restrictions, paragraphs, sections, clauses, or phrases herein contained shall not be affected thereby and shall remain in full force and effect. RESOLUTION OF COMMISSION OF THE RULES GOVERNING BUSINESS TENANTS PROJECT THE COMMUNITY DEVELOPMENT CITY OF SAN BERNARDINO ADOPTING PARTICIPATION BY OWNERS AND IN THE UPTOWN REDEVELOPMENT WHEREAS. the Community Development Commission of the City of San Bernardino (the "Commission") on behalf of the Redevelopment Agency of the City of San Bernardino (the "Agency") and the Mayor and Common Council of the City of San Bernardino. California (the "Council"). are considering the adoption of the Redevelopment Plan for the Uptown Redevelopment Project (the "Redevelopment Plan"); and WHEREAS. the Agency desires. when consistent with the . Objectives of the Redevelopment Plan. to give preferences to existing owners and business tenants for re-entry in business in the proposed redevelopment project area of the Uptown Redevelopment Project; and WHEREAS. the owners of a certain real property and/or business tenants thereof within the Uptown Redevelopment Project may desire to participate in the redevelopment of certain property subject to and in conformity with the Redevelopment Plan; and WHEREAS. the Agency desires for the benefit of the Uptown Redevelopment Project to prescribe certain standards relating to the use and occupation of such real property. . - 1 - 3D - . . . . . . ~ NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED BY THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF SAN BERNARDINO AS FOLLOWS: Section 1. AND TENANTS IN THE UPTOWN REDEVELOP!IENT PROJECT Section I. GENERAL These rules are promulgated to implement the provisions of the Redevelopment Plan for the Uptown Redevelopment Project regarding participation and the exercise of preference by owners, operators of businesses, and tenants in the Project. These rules set forth the procedures governing such participation. Participation is desired in the restoration and redevelopment of the Project Area by as many owners and tenants as possible. The Agency shall extend preferences to persons who are owners and tenants in the Project Area. to continue in or, if the Agency acquires the land of an owner or the land on which a tenant is located, by negotiations. to re-enter the Project Area if any such owner or tenant otherwise meets the requirements prescribed in the Redevelopment Plan and in these Rules. The Agency is also authorized to permit persons who are owners of real property in the Project Area to be given the opportunity to participate in the restoration and redevelopment of the Project Area by retaining, and if necessary rehabilitating. all or a portion of their properties, by acquiring adjacent or other properties in the Project Area, by selling their properties to the Agency and purchasing other properties in the Project Area, or by selling improvements to the Agency and redeveloping their property. Participation opportunities shall necessarily be subject to and limited by such factors as the following: 1. Removal, relocation and/or installation of public utilities and public facilities. 2. The elimination and changing of some land uses. 3. The realignment. abandonment, widening or opening of public rights-of-way. 4. The ability of owners to finance acquisition and development in accordance with the Plan. . ~ e . . . . . 5. Any reduction in the total number of individual parcels in the Project Area. 6. The assembly and development of areas for public and/or private development in accordance with the Plan. If conflicts develop between the desires of participants for particular sites or land uses, the Agency is authorized to establish reasonable priorities and preferences among the owners and tenants and to determine a solution by consideration of such factors as length of time in the area; accommodation of as many participants as possible; ability to perform; similar land use to similar land use; conformity with the intent and purpose of the Redevelopment Plan. Participation to the extent feasible shall be available for two or more persons, firms or institutions, to join together in partnerships, corporations, or other joint entities. Section II. TYPES OF PARTICIPATION Participation includes remaining in substantially the same location either by retaining all or portions of the property, or by retaining all or portions of the property and purchasing adjacent property from the Agency. An owner who participates in the same location may be required to rehabilitate or demolish all or part of his existing buildings or the Agency may acquire the buildings only and then remove or demolish the buildings. Any work of grading, clearing, demolition or construction undertaken by the Agency shall be done by contract after competitive bids, if the cost of said work exceeds the amount specified in Part III, Chapter 1, Article 4, of the Public Contracts Code, as said Code presently exists or may hereafter be amended. Participation also includes the Agency buying land and improvements at fair market value from existing owners, and offering other parcels for purchase by such participants. Participation also includes business and residential tenants obtaining preferences to re-enter the Project Area. Section III. PARTICIPATION PROCEDURE A. Certificates of Conformance The Project Area contains many parcels of real property. As a result, there is a need to simplify the availability of participation opportunities. Therefore, as an alternative to requiring a participation agreement for each property not to be purchased, the Agency is authorized to make determinations of those properties which conform to the Redevelopment Plan. The Agency shall in good faith review the property contained in the Project Area and issue Certificates of Conformance to qualifying properties as soon as possible consistent with the restoration and redevelopment permitted by the Plan and specific designs for development adopted by the Agency pursuant to the Plan. -2- . Participation Agreements The Agency is authorized to enter into participation agreements regarding properties not purchased or not to be purchased by the Agency and not included in an Agency Certificate of Conformance. Each agreement will contain provisions necessary to insure that the participation proposal will be carried out, and that the subject property will be developed or used in accordance with the conditions, restrictions, rules and regulations of the Redevelopment Plan and the agreement. Each agreement will require the participant to join in the recordation of such documents as the Agency may require to insure such development and use. Participation agreements will be effective only if approved by the Members of the Agency. C. Statements of Interest Before making offers to purchase property in the Project Area, the Agency shall notify the owners of any such properties that the Agency is considering the acquisition of such property. The Agency shall include a form entitled "Statement of Interest in Participating" with the notification. Within 30 days of receipt of such notification, any owner interested in participating in the Project Area shall file a "Statement of Interest in Participating." The Agency may disregard any Statements received after such 30-day period. Any owner or tenant may also submit such a statement at any time before such notification. The Agency shall consider such Statements as are submitted on time and seek to develop reasonable participation for those submitting such statements whether to stay in place, to move to another location, or to obtain preferences to re-enter the Project Area. Section IV. ENFORCEMENT In the event a property is not developed or used in conformance with the Redevelopment Plan, and with a Certificate of Conformance, or a Participation Agreement, then the Agency is authorized to (1) purchase the property, (2) purchase any interest in the property sufficient to obtain conformance, or (3) take any other appropriate action sufficient to obtain such conformance, with the exception of eminent domain which is precluded by the Redevelopment Plan. -3- . .. . . . . . Section V. AMENDMENTS OF OWNEll. PARTICIPATION RULES The Agency may amend these Rules at any meeting held after their adoption but only after notice to the Agency Members.
