At the request of the depart- ment and in co-ordination with the Equipment Superintendent, appropriate specifi- cations were prepared, published and furnished to area suppliers. Of the 10 bidders solicited, two responded with bids, three responded with reasons for not bidding which ranged from not having contracts for this class of equipment with manufacturers, do not handle this specific line, unable to supply. Both Dieterich International and Carmenita Truck took exception to the transmission size of Allison MT654. Both thought the specification was overkill and indicated the manufacturer would not provide as requested. This situation was reviewed by the Equipment Superintendent and the MT653 offered by both was accepted. Having resolved the specification adjustment which was equal to both bidders, the exception to the $25.00 per day liquidated damages clause in the City boiler plate is insurmountable. Dieterich International Truck has not complied with the bid requirements. The City attorney's office concurs with this determination. It is therefore recommended that the bid of Dieterich International Truck be rejected on the grounds the vendor took outright exception to Sec. 17 - liquidated damage pro- tection to the City. Any bidder believing liquidated damages should be in a lessor amount may so specify as an alternate bid, which the City may accept or reject. It is recommended the bid of Carmenita Truck Center, the next bidder in line according to price and meeting the specifications and requirements be accepted for contract. The amount of $54,000.00 was included in the 1985/86 Budget for this equipment. Background For Councils Consideration Dieterich International Truck has of late taken exception to the liquidated damages clause in the City bid specifications. Namely F-86-11, F-86-12, F-85-47, No Bid on F-86-5 & F-86-6. In this past year there ha~1 been no vendors who have taken exception to the liquidated damage clause in any commodity area. 75-0264 - - ---------..... > . . . . BID SPEC: F-86-11 In view of the fact new vendors are asking for bid consideration and there exists no long standing association when the liquidated damges might be omitted and rather than subject the City to danger the liquidated damages are a necessity. . . . RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A BID TO CARMENITA TRUCK CENTER FOR THE FURNISHING AND DELIVERY OF ONE NEW 1986 BRUSH CHIPPER TRUCK IN ACCORDANCE WITH BID SPECIFICATION F-86-11. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BER- NARDINO AS FOLLOWS: SECTION 1. The bid of Dieterich International Truck. for one new 1986 brush chipper truck at $46.110.00 is hereby rejected as not meetin9 spec i I j- cations in 1 separate area. SECTION 2. Carmenita Truck Center is the lowest and best bidder for the furnishing and delivery of one new 1986 brush chipper truck in accordance with Bid Specification F-86-11 for the total amount of $47.888.68; pursuant to this determination. the Purchasing Agent is hereby authorized and directed to issue a purchase order for said one new 1986 brush chipper truck to said lowest and best bidder; such award shall only be effective upon the issuance of a purchase order by the Purchasing Agent; and all other bids therefor are hereby rejected.
