STAFF REPORT
The area covered by this agreement is a 1.3 acre triangular parcel. The agreement
provides in general that the Diocese will allow the area to be used for public re-
creational purposes. Through previous agreement, the parcel has been improved to
include an irrigation system, grass, trees, and a chain link fence.
The Diocese will pay utilities and property taxes. t1aintenance will be provided
by the Parks, Recreation and Community Services Department at an estimated cost of
$60 per week or $3,120 per year. The agreement may be terminated by either party
by giving 60 days written notice.
The agreement will be for a term of three years and may be extended for an additional
three year period commencing on the day following the expiration of such three year
period.
It is recommended the resolution be adopted.

RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF A FIRST AMENDMENT TO AGREEMENT WITH THE DIOCESE OF
SAN BERNARDINO EDUCATION AND WELFARE CORPORATION RELATING TO
EXTENDING THE USE BY CITY OF CERTAIN PROPERTY FOR PUBLIC
RECREATIONAL PURPOSES.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is herebY1

8 authorized and directed to execute on behalf of said City a First I
9 Amendment to Agreement with the Diocese of San Bernardino
10 Education and Welfare Corporation relating to extending the use
11 by City of certain property for public recreational purposes, a
12 copy of which is attached hereto, marked Exhibit "An and
13 incorporated herein by reference as fully as though set forth at
14 length.

3 THIS FIRST AMENDMENT TO AGREEMENT is made and entered into
4 this
day of
, 1986, by and between the CITY
5 Of SAN BERNARDINO, a municipal corporation, hereinafter referred
6 to as "City", and the DIOCESE OF SAN BERNARDINO EDUCATION AND
7 WELfARE CORPORATION, a California nonprofit corporation,
8 hereinafter referred to as "Diocese".
9 The parties hereto agree as follows:
10 1. Recitals.

A. City and Diocese entered into an agreement on June 2,
12 1983 (hereinafter "the agreement"), relating to the use by City of
13 certain property for public recreational purposes.

B. City and Diocese now desire to amend the agreement to
15 provide for an additional three year term.
16 2. Amendment. The term of the agreement is extended for an
17 additional three year period, commencing April 17, 1986, and
18 terminating April 16, 1989.
