STAFF REPORT
The original agreement stipulated that Jadent Productions provide public liability
insurance and property damage insurance. Each is in the sum of one million dollars.
Jadent has stated that their insurance agent has tried to get this insurance coverage
from companies in four states. The highest amount of insurance available is $500,000.
Ron Solheim, Director of Risk Management, has stated that $500,000 is an acceptable
level. The amendment to the original agreement will reduce the liability requirement
from one million dollars to $500,000. No other condition or requirement will change.

SECTION 1. The Mayor of the City of San Bernardino is hereby!

8 authorized and directed to execute on behalf of said City a
9 First Amendment to Agreement between the City of San Bernardino,
10 San Bernardino/Redlands Special Olympics Program, and Jadent
11 Productions, Inc., to reduce the liability insurance and property
12 damage insurance from one million dollars to five hundred thousand
13 dollars, a copy of which is attached hereto, marked Exhibit "A"
14 and incorporated herein by reference as fully as though set forth
15 at leng th.

1 FIRST AMENDMENT TO AGREEMENT
2 THIS FIRST AMENDMENT TO AGREEMENT is made and entered into
3 this
day of
, 1986, by and between JADENT
4 PRODUCTIONS, INC., hereinafter referred to as "Exhibitor", and the
5 CITY OF SAN BERNARDINO. a municipal corporation of the State of
6 California, and the SAN B~RNARDINO/REDLANDS SPECIAL OLYMPICS
7 PROGRAM, hereinafter referred to as "sponsors".
8 The parties hereto agree as follows:
9 1. Recitals.

A. The parties entered into an agreement on October 15.
11 1985 (hereinafter "the agreement"), relating to the promotion and
12 production of a variety show.
13
B. The parties now desire to amend the agreement to
14 reduce the liability insurance and property damage insurance from
15 one million dollars to five hundred thousand dollars.
16 2. Amendment. Paragraph 6 of the agreement is amended to

"6. Exhibitor shall hold Sponsors harmless from any
liability for damage or claims for damage for personal injury,
including death, as well as from claims for property damage which
21 may arise from Exhibitor's operations under this agreement,
22 whether such operations be by Exhibitor or by anyone or more
23 persons directly or indirectly employed by or acting as agent for ,

24lExhibitor.

Exhibi tor agrees to and shall defend Sponsors from any i
25 suits or actions at law or in equity for damages caused or alleged I
26 to have been caused, by reason of any of Exhibitor's operations.
27 Exhibitor shall procure and maintain in force during the term of

2 occurrence for said show to protect the Sponsors and the location
3 of the show. Such insurance policy(s) shall provide coverage for
4 Sponsors contingent liability on such claims or losses. City

7 3. Other Provisions. All other terms, conditions and
8 covenants of said agreement shall remain the same and be in full
9 force and effect.
