ORDINANCE NO.
2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER
15.57 OF THE SAN BERNARDINO MUNICIPAL CODE REVISING DEFINITION
3 FOR NEW CONSTRUCTION AND RECONSTRUCTION AND RESTRUCTURING
EXISTING CULTURAL DEVELOPMENT FEES.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
5 DO ORDAIN AS FOLLOWS:

SECTION 1. Chapter 15.57 is amended as follows:

15.57.020 Definitions.

C.
'New Construction' shall mean all new commercial
9 construction.
D.
'Reconstruction' shall mean additions, alterations,
11 repairs, or remodels made to an existing commercial structure.
12 Reconstruction is required to conform to the requirements for new
13 buildings pursuant to the Uniform Building Code and Title 15 of
14
this Code.
Reconstruction necessitated by natural disaster or
15 accidental damage shall not be subject to this Chapter provided,
16 however, that damage in the normal cause of business shall be
17 included.

15.57.030 Cultural Development Construction Fee Imposed.
A.
A cultural development construction fee is imposed on
20 the privilege of new commercial construction or reconstruction as

defined in Section 15.57.020, Subsections C and D.
22 shall be equal to one-half (1/2) of one (1) percent of the
23 construction cost.
